THE STATE’S ATTORNEY, for Anne Aruridel County, State of Maryland,

informs and charges, Austin Kirk Smith with having committed the following offenses

on or about May 27, 2021 in Anne Arundel County.

COUNT ONE

NEGLIGENT MANSLAUGHTER—AUTO/ BOAT/ OTHER VEHICLE

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did cause the death of Leah Mae Foster, While driving,

operating and controlling a vehicle in a grossly negligent manner. (CR.2.209) (Penalty

COUNT TWO

NEGLIGENT MANSLAUGHTER—AUTO/ BOAT/ OTHER VEHICLE

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did cause the death of Nicholas Raymond Harris, while

driving, operating and controlling a vehicle in a grossly negligent manner. (CR.2.209)

COUNT THREE

CRIMINALLY NEGLIGENT MANSLAUGHTER VEHICLE / VESSEL

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did cause the death of Leah Mae Foster, as the result of

COUNT FOUR

CRIMINALLY NEGLIGENT MANSLAUGHTER VEHICLE / VESSEL

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did cause the death of Nicholas Raymond Harris as the

result of operating a vehicle in a criminally negligent manner. (CR.2.210.b) (Penalty - 3

y / $5,000) (Criminally Negligent Manslaughter Vehicle / Vessel *1 1611)

COUNT SEVEN

RECKLESS DRIVING

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did drive a motor vehicle in a manner that indicated a

vvanton and willful disregard for the safety of persons and property. (TA.21.901.1.a)

COUNT EIGHT

NEGLIGENT DRIVING

THE STATE’S ATTORNEY INFORMS AND charges that the aforesaid defendant

on or about the aforesaid date, did drive a motor vehicle in a careless and imprudent

manner so as to endanger the property and the life and person of any individual.

THE STATE’S ATTORNEY further avers and alleges that the offenses charged

hereinabove were committed contrary to the form and Act of Assembly in such cases

made and provided and were against the peace, go nment and dignity of the State of

Maryland.
