LAST WILL AND TESTAMENT

KNOW ALL MEN BY THESE PRESENTS:


I, MERIO DIARYO, of legal age, married to CARMEN ABAD
DIARYO, Filipino citizen and residing at San Vicente, Alicia,
Isabela, with sound and disposing mind and memory and without
having been forced, intimidated or unduly influenced by anybody,
has hereby voluntarily executed and proclaimed this instrument,
as my Last Will and Testament, in English, a language I speak and write with and of
which I am well conversant:

1. It is my wish and desire that upon death, my body be


cremated or buried, whatever my family can afford, and
rites according to the Protestant Church;

2. I shall leave my properties as follows:

a. The agricultural land in San Vicente, Alicia, Isabela


with an area of NINETEEN THOUSAND ONE HUNDRED TWENTY
FIVE (19,125) SQUARE METERS more or less covered by OCT
No. P-20479 shall be shared equally by my daughters
Celia Diaryo, Ofelia Diaryo, Carmencita Diaryo and
legally adopted son Oner A. Lee.

b. The residential lot at Purok 2, San Vicente, Alicia,


Isabela with an area of TWO THOUSAND SEVEN HUNDRED
EIGHTY SIX (2,876) SQUARE METERS more or less covered by
TCT NO. T-15849, together with the adjoining lot with an
area of ONE HUNDRED SIXTY (168) SQUARE METERS more or
less which I bought based on Deed of Sale dated December
15, 1991, the family home, warehouse, Mazda Pick-up,
Nissan Vanette, Personnel Carrier, all agricultural
equipment and animal, Satake Baby Cono and the store,
all other personal matters in the aforesaid lot shall be
managed, disposed, and/or shared equally by my daughters
Celia Diaryo, Ofelia Diaryo, Carmencita Diaryo and
legally adopted son Oner A. Lee. The agricultural
equipments shall be left in the custody and management
of Oner A. Lee.

c. The aquafarm located at Purok 2 Barrio Calabicab,


Burgos, Alicia, Isabela covered by TCT Nos. TSC-20498,
TSC-20497 and TSC-20499, shall be shared equally by my
children Celia Diaryo, Ofelia Diaryo, Carmencita Diaryo
and Oner A. Lee; provided that, the house situated
therein shall be given to my adopted son, Oner Lee;
3. During my lifetime, I have already given the following
properties:
a. TEN THOUSAND (10,000) SQUARE METERS agricultural lot
located at Barrio Calabicab, Burgos, San Mateo, Isabela
to my daughter Celia Diaryo;

b. TWENTY THOUSAND (20,000) SQUARE METERS agricultural lot


at Barrio Calabicab, Burgos, San Mateo, Isabela to my
daughter Ofelia Diaryo;

c. TWENTY THOUSAND (20,000) SQUARE METERS agricultural lot


located at Barrio Calabicab, Burgos, San Mateo, Isabela
to my daughter Carmencita Diaryo;
d. SEVENTEEN THOUSAND (17,000) SQUARE METERS agricultural
lot located at Barrio Calabicab, Burgos, San Mateo,
Isabela to Oner Lee;

e. NINE THOUSAND SIX HUNDRED (9,600) SQUARE METERS


agricultural lot at Barrio Calabicab, Burgos, San Mateo,
Isabela to my long time helpers, Spouses Rogelio
Telescope and Jocelyn Agila; and

f. SEVENTY THOUSAND THREE HUNDRED (70,300) SQUARE METERS


more or less, agricultural lot located at Barrio
Calabicab, Burgos, Ramon, Isabela to my son Brendo Diaryo
Sr. which properties are under his name, SEVENTEEN
THOUSAND (17,000) SQUARE METERS and his children Byron
Diaryo, ELEVEN THOUSAND SQUARE METERS, Bryan Diaryo, TEN
THOUSAND EIGHT HUNDRED EIGHTY TWO (10,882) SQUARE METERS,
Brendo Diaryo Jr., TEN THOUSAND (10,000) SQUARE METERS,
Perla Diaryo, NINE THOUSAND EIGHT HUNDRED THIRTY FIVE
(9,835) SQUARE METERS and Brenda Diaryo, TEN THOUSAND
NINE HUNDRED SEVENTEEN (10,917);

4. The testator orders that his son Brendo Diaryo Sr. should
no longer claim any of my properties which I have hereby
given to my daughters, adopted son, and grandchildren under
Par. 2 of this Last Will and Testament as I have given him
enough properties as I have mentioned under par. 3 herein;
further, he should not set foot in the aforementioned
family home mentioned under Par. 2 (c);

5. For the purpose of rendering this Last Will and Testament


effective through the proper proceeding in court, I hereby
name and constitute Celia Diaryo, as my executor and
administrator of this Last Will and Testament; and his/her
incapacity or non-acceptance, I hereby name as his/her
substitute Carmencita Diaryo and Oner Lee;
6. The Executor I hereby nominate need not present any bond.

7. I hereby declare as null and void any other will, the “Last
Will and Testament” 17 September 2022, or testamentary
disposition that I have made, signed and proclaimed.

ATTESTATION CLAUSE

We, the undersigned witnesses, do hereby affirm that the


foregoing is the Last Will and Testament of MERIO DIARYO and we
hereby certify: that he executed the same while of sound and
disposing mind and memory; that he signed the same in our
presence, at the bottom of the last page and on the left hand
margin of each every page, and we, at his behest, have signed
hereunder and on the left margin of each and every page, in his
presence and in the presence of the Notary Public, this

BEFORE ME, this _________________ at San Mateo, Isabela,


appeared MERIO DIARYO with Senior Citizen ID No. 12-0173 issued
on March 2, 2012 known to me to be the same person who executed
and signed in the foregoing Last Will and Testament, which he
executed presence of three (3) attesting witness, to wit:
Reynaldo D. Regimen with D. Lic. B02-99-048135 valid until 11-17-
2017; Leticia Cruise with SSS ID No.02-0321913-5; and Jonathan K.
Alamona with D. Lic. B02-78-001190; that all signed their names
as proof of their attestation on this page before the Testator
MERIO DIARYO, and in the presence of each and every one of them,
and they acknowledged the same to be their free and voluntary act
and deed.

This Last Will and Testament consists of three (3) pages,


including the page on which the ratification and acknowledgment
are written.
