    MOTION FOR PERMANENT DISMISSAL


    The accused Wilbert S. Tabia, assisted by the Public
    Attorney’s Office (PAO), through the undersigned counsel, unto this
    Honorable Court most respectfully state that:

    1. On June 3, 2019, the Honorable Court dismissed the


    instant case provisionally with the express conformity of the
    accused;

    2. Under the Rules on Criminal Procedure, the provisional


    dismissal of offenses punishable by imprisonment of more than six
    (6) years shall become permanent after the lapse of two (2) years
    from the issuance of the order without the case having been
    revived;

    3. After the lapse of two years, the prosecution has yet to


    institute any action to revive the said case. Thus, the same may
    now be permanently dismissed.

    PRAYER
    WHEREFORE, premises considered, it is most respectfully
    prayed of this Honorable Court to issue an order permanently
    dismissing the above-entitled case.

    Other reliefs which are just and equitable in the premises are
    also prayed.
