AFFIDAVIT OF WITNESS
I, ERICKYLLE B. UMADHAY, minor (DOB: 11/19/2006),

single, Filipino and resident of Kalawag I, Isulan, Sultan Kudarat,
duly sworn to in accordance with law, hereby depose and state;
1. Herein affiant is the witness in favor of the respondent, RICKY

P. UMADHAY, in NPS DOC. NO. XII-09-INV-22B-00073 for
Frustrated Murder. Herein affiant vehemently denied the
accusations hurled against the respondent, the truth being that;
a. That, the incident happened on December 25, 2021 during

the Christmas Party of Baluno Family, side of my mother at
Arguelles’ Residence;
b. That, I went there at around 3:00 in the afternoon. When I

arrived, there were already lots of family members. Since I
entered to the back gate, I saw Rodel D. Bode also known as
“Bading” and his friends having a drinking spree and
seemed to be under the influence of alcohol already as there
were several bottles of consumed beer on their table. I also
noticed my father, Ricky P. Umadhay, my grandfather and
my uncles inside a shanty sitting and talking with each
other. After a while, we were called to eat then afterwards,
the parlor games started;

c. That, around 6 in the afternoon, I felt uncomfortable because
of my sweat after I played parlor games. So, I decided to go
home for a while to take a bath. I went to my father’s table to
ask for the keys and there I saw Rojelem Parcon talking with
him;
d. That, few minutes after I took a bath, I immediately went

back. Around 8 in the evening, the Emcee called and
announced to prepare for the exchange gift. I was so excited
that time for my gift when I suddenly heard Kuya “Bading”
shouted in vernacular, “Baw! Gin-una mo pa si Angkol Lito
hatagan ba!” Because I was so happy with my cousins that
time, I did not mind it;
e. That, around 8:15 in the evening while the exchange gift was
on going, my grandmother asked me to tell my father to
prepare as we were about to leave after the exchange gift. So,
I went to my father who was with Kuya “Bading” and did
the same thing my grandmother asked me. I went back to
my grandmother and told her to advise my father again then
I went back to my cousins. After few minutes, when I looked
at my father, I saw that he was leaving and Kuya “Bading”
was laughing with his friends and pointing his finger
towards my father. I was confused of what was going on but
I still did not mind it. Then, when I looked back again to my
father, I was shocked when I saw that they were already
fighting. I immediately shouted, “Papa! Naano ka?” and ran
towards my father and pushed him. Because of fear and to
avoid serious fight, my father went outside and left;
2. That, I can attest that my father did not bring the complainant,
Rodel aka “Bading” Bode to the dark area of the place. I saw
with my own eyes that my father left and Rodel Bode was
laughing with his friends and pointing his finger towards my
father. My father has no intention to kill Rodel Bode but he just
made it to defend himself.
3. Thus, I hereby execute this Counter-Affidavit to attest to the

truth of the foregoing facts and circumstances, and to pray for
the outright DISMISSAL of this case.
