AFFIDAVIT OF WITNESS
I, MELLY M. BALUNO, of legal age, married, Filipino and

resident of Kalawag I, Isulan, Sultan Kudarat, duly sworn to in
accordance with law, hereby depose and state;
1. Herein affiant is the witness in favor of the respondent, RICKY

P. UMADHAY, in NPS DOC. NO. XII-09-INV-22B-00073 for
Frustrated Murder. Herein affiant vehemently denied the
accusations hurled against the respondent, the truth being that;
a. That, the incident happened on December 25, 2021 during

the Christmas Party of Baluno Family at Arguelles’
Residence;
b. That, I went there at around 2:00 in the afternoon. When I

arrived, there were already lots of family members. I
immediately join my relatives and had few chitchat. Around
2:30 in the afternoon, Ricky arrived and went to shanty
where my husband and children were sitting. After a while,
we were called to eat then afterwards, the parlor games
started. Then, Ricky along with my husband, sons and their
friends also prepared to have drinking spree;
c. That, around 6 in the afternoon, when I was walking around

the place, I saw Rodel D. Bode also known as “Bading” and

his friends having a drinking spree and seemed to be under
the influence of alcohol already as there were several bottles
of consumed beer on their table Since, they were just
drinking, I did not mind them;
d. That, around 8 in the evening, the Emcee called and

announced to prepare for the exchange gift. I was 1 meter
away from Ricky when I saw him left Rojelem and my sons
and went to other table to prepare. Then suddenly I heard
“Bading” who was half-naked shouted in vernacular, “Baw!
Gin-una mo pa si Angkol Lito hatagan ba!” I was confused
where it was coming from but I did not mind it. Then after
few minutes, I saw “Bading” who was mad and beside
Ricky. Then he shouted to Ricky in vernacular, “Ano kaw?
Pa-hero2x ka naman?! Pa-hero2x ka naman!” then Ricky
responded in vernacular, “Hindi ka lang bala magahod”. Then I
called Erickylle to advise her father to prepare because we
were leaving after the exchange gift to which Erickylle
adhered. Since, Ricky was still beside “Bading” and I fear
that something bad will happen, I asked Ricky myself to
leave;
e. That, after few minutes, Ricky already left, I thought

“Bading” will no longer pursue him but the latter followed
Ricky. When Ricky looked back to “Bading”, the latter threw
his fist on Ricky. I thought Ricky punched back but later on,
I realized that Ricky was holding something on his hand.
After few seconds, I heard my granddaughter, Erickylle,
shouting in vernacular, “Papa! Nauna ka?” Ricky stopped
and then my granddaughter went in the middle and pushed
Ricky. Because of fear and to avoid serious fight, Ricky went
outside and left;
2. That, I can attest that Ricky P. Umadhay did not bring the
complainant, Rodel aka “Bading” Bode to the dark area of the
place. I saw with my own eyes that he left but Rodel Bode
followed him. Ricky has no intention to kill Rodel Bode but he
just made it to defend himself.

3. Thus, I hereby execute this Counter-Affidavit to attest to the
truth of the foregoing facts and circumstances, and to pray for
the outright DISMISSAL of this case.
