11 I, Detective Kenneth Reynolds DPSST #37287, swear that the above-named defendant
was arrested on November 26th, 2022 at approximately 0034 hours for the crime above, and that

... the crime occurred in the City of Portland, County of Multnomah, State of Oregon.

13 The information contained within this affidavit is based upon information I have gained
from my investigation, my personal observations, and/or information relayed to me by other law
14 enforcement officers and/or agents. Since this affidavit is being submitted for the limited

purpose of assisting in establishing probable cause, I have not included each and every fact
13 known to me concerning this investigation.

16 The probable cause for this arrest is as follows:

17 On November 26, 2022 Officer Carlos Pagan of the Portland Police Bureau DPSST
#3 8061 told me that he responded to 10834 NE Sandy Blvd for a reported robbery. Officer
18 Pagan told me upon arrival at the location DANIEL MITCHELL was being detained by Jonathan
Nguyen and Thang Le. Officer Pagan told rne that Cynthia Nguyen handed him a BB Gun pistol
19 that she told Officer Pagan had been taken off MITCHELL.

20 Officer Pagan told me that he spoke with Johnathan Nguyen, (the owner of the establishment)
who told Officer Pagan the following;

Mitchell entered the tavern and walked to the bar and asked for a drink. Nguyen told
22 Mitchell to pull down his mask and show him identification. Mitchell responded by
pulling out a pistol and demanding money. Nguyen pulled out a taser and deployed it on
23 Mitchell but it missed. Nguyen was then assisted by a Thang Le in detaining Mitchell at
the bar.

I spoke with Daniel Mitchell who told rne that he was forced to rob to do a robbery to pay off a
25 drug debt. Mitchell told rne that he drove to the location entered the location and went up to the
bar. Mitchell stated he went up to the bar pulled out a fake pistol and demanded money.
26 Mitchell stated he was unsuccessful because a patron pulled out a real gun so he placed his fake
