    PETITION

    COMES NOW, the undersigned petitioner and before the Office of the register of Deeds
    of General Santos City, most respectfully state and manifest:

    1. That the petitioners are both legal, Filipino, and with residence and postal address at Prk.
    Malipayon, Brgy. San Isidro, General Santos City, South Cotabato, Philippines;

    2. That the petitioners are the registered owner in fee simple of a certain parcel of land known
    as designated as Lot 932-G-21, PSD-12-038698, containing an area of One Hundred Seventy-
    two (172) square meters, more or less, situated in the Barangay of Lagao, City of General
    Santos, covered by TCT No. 147-2013004567 of the registry of Deeds of General Santos City;

    3. That appearing and inscribed at the front portion of page 3 of the said Certificated of Title is
    a clause stating that the above-mentioned parcel of land was made subject to Section 4,
    Rule 74 of the New Rules of Court of the Philippines re: claim of other possible heirs, third
    person and/or creditors under Entry No. 497001; and

    4. That the said lien over the said real property had already prescribed and/or lapsed without
    anybody having filed any claim or claims against it whatsoever, considering that a period of
    two (2) years had already lapsed since the execution of the Extra-Judicial Settlement of
    Estate under Entry No. 497001; dated December 07, 2004.

    WHEREFORE,in view of the foregoing petitioner prayed that Entry No. 497001 registered in the
    names of the herein petitioners be cancelled.
