RE : INQUIRY ON THE ISSUANCE/TRANSFER OF TAX DECLARATION


IN CASES OF INCREASE IN AREA

Sir,

Greetings!

My client has a pending application in the transfer of tax declaration in her name due to the
inconsistency of areas indicated in her title and tax declaration. The area indicated in her title
with title number TCT No. -057-2013010261, issued in the name of MARIVIC R. DIAZ is
One Hundred Forty-Four (144) Square Meters, whereas, the area indicated in the tax declaration
with Tax Declaration No. AA-10 0002 00220, issued in the name of IRVIN ROSARDA is
only One Hundred Twenty Three (123) Square Meters.

One of the requirements in the correction of area is the AFFIDAVIT OF ADJOINING


OWNERS, stating among others, that there should be no conflict in its boundaries. However, all
the three adjacent owners refused to sign the said AFFIDAVIT OF ADJOINING OWNERS.

In this regard, may we ask for any ALTERNATIVE DOCUMENT in lieu of the AFFIDAVIT
OF ADJOINING OWNERS that we can submit in order to prove that there is no conflict in my
client’s property boundaries.

Attached herewith are: 1. Copy of Title; 2. Copy of Tax Declaration; 3. Copy of Survey Plan
made by the undersigned; and 4. Photo of the property.
