APPLICATION UNDER SECTION 436 OF THE CODE OF CRIMINAL


PROCEDURE, 1973

The Accused begs to submit as under:-

1. The complainant has filed a false and frivolous complaint


against the accused for the alleged offences punishable under Sec.138 of
Negotiable Instruments Act, 1881. The accused are innocent of the
alleged offence.

2. That the said offence is bailable in nature. That the alleged


offence is neither heinous nor punishable with death or life
imprisonment. That the accused are businessmen by profession and
are law abiding citizens and permanent residents of Bangalore. The
accused have not committed any offence as alleged by the Complainant.

3. The accused hail from respectable family and have deep roots
in the society. The accused’s father has recently suffered a heart attack
and needs his son’s support. If the accused are not enlarged on bail, it
will cause great deal of difficulty to the family. If the accused are
enlarged on bail the Complainant will not suffer any loss or injury.

4. The accused’s brother in law is are solvent. The accused


undertake to appear before this Hon’ble Court and will comply with the
terms and conditions that may be imposed by this Hon’ble court for
their enlargement on bail. Since the alleged offences are bailable in
nature, the accused may be enlarged on bail on self bond.

WHEREFORE, the accused most humbly prays that this Hon’ble


Court be pleased to allow the application by enlarging the accused on
bail, in the interest of justice and equity.

The Accused begs to submit as under:-

1. The complainant has filed a false and frivolous complaint against


the accused for the alleged offences punishable under Sec.138 of
Negotiable Instruments Act, 1881. The accused are innocent of the
alleged offence.

2. The accused are permanent resident of Bangalore and they are law
abiding citizen and hail from a respectable family, having high respect
and deep roots in the society. The accused are solvent. The accused
are willing to offer cash security in lieu of surety, for their enlargement
on bail.

WHEREFORE, the accused humbly prays that this Hon’ble Court


may be accept cash security in lieu of the surety and enlarge them on
Bail, in the interest of justice.
