1. What is a constitution? 5 pts
- it is a system of fundamental laws and principles of government of a nation
corporation or other aggregation of individuals which may either be written or
unwritten.
2. Differentiate warrant of arrest and arrest warrant. 10 pts

Warrant of arrest is a document issued by a judge or magistrate that authorizes the


police to take someone accused of a crime into custody.

3. Discuss the 3 major parts of a constitution. 15 pts

a. Legislative Department

- is the one who deals with the making deliberation over, enactment, amendment
and repealing of laws.

- their responsibilities are to make a new law or change existing laws for a
betterment.

b. Judicial Department

- the judicial branch holds the power to settle controversies involving rights that are
legally demandable and enforceable.

- judicial department is the one who determines whether or not there has been a
grave abuse of discretion amounting to lack or excess of jurisdiction on the part and
instrumentality of the government.

c. Executive Department
- this is the largest component of the executive branch of the government of the
Philippines.

- this executive branch is composed of the president and the vice president who are
elected by direct popular vote and serve a term of six years. the constitution grants
the president authority to appoint his cabinet.

- the president is the head of state and head of government and functions as the
commander-in-chief of the armed forces of the Philippines. As chief executive, the
president exercises control over all the executive departments, bureaus, and offices.

4. What is warrantless arrest? 5 pts

Warrantless arrest is under the rules of court, Rule 113, Section 5 of the Revised rules of
Criminal Procedure, a peace officer or a private person may, without a warrant, arrest a
person, but for them to arrest them, the person they should arrest is the person who
committed crime or is committing the crime, or is attempting an offense; and another
instance is when the person to be arrested is a run-away prisoner who is seen in the
public.

5. What is Philippine Constitution Article III. Bill of Rights Bill of rights? Discuss it. 10 pts

- it is a declaration and enumeration of a person’s Exemptions: rights and privileges


which the constitution is a designed warrantless search/Search without a valid search to
protect against violation by the government and other warrant individuals.

6. Discuss what is Preamble? 5 pts.


- The Preamble is an introductory statement in a constitution which states the reasons and
the guiding values of the Constitution
