    Dear Sirs,

    We are concerned for our clients 1. Mr. Danish Mohammed Hussain Thote,

    2. Mr. Kamran Mohammed Hussain Thote, 3. Ravish Mohammed Hussain Thote,

    4. Mrs. Rubina Abdul Malik Kungle having their address at Near Chand Tara Masjid

    4th Nizampura, Bhiwandi, Dist. Thane-421302 who have instructed us to addressed

    to you as under:

    1. Our clients’ states that Late Mrs. Ashrafunisa Mohammed Thote was the

    owner of the Agricultural Land Bearing C.T.S. No. 4191/ Survey No. 29/1,

    situated at Nadi Naka, Amina Baug, Barkiya Compound, Bhiwandi, Thane-

    421302 who expired on 21st March, 2021 leaving behind 1. Mr. Danish

    Ravish Mohammed Hussain Thote, 4. Mrs. Rubina Abdul Malik Kungle, her

    only legal heirs and representatives entitled to his estate as per the law of

    succession applicable to her. A copy of the 7/12 extract showing name of Late

    Mrs. Ashrafunisa Mohammed Thote as owner of the said agricultural land

    dated 15th June, 2021 is attached herewith for your reference.

    2. Our clients’ states after the death of Late Mrs. Ashrafunisa Mohammed Thote

    her legal heirs got to know that the lot of illegal construction has already been

    done on the said Agricultural Land Bearing C.T.S. No. 4191/ Survey No. 29/1

    without obtaining consent/ permission from Late Mrs. Ashrafunisa

    Mohammed Thote and also without obtaining any permission from Municipal

    Corporation or any concerning authorities.

    3. Our clients states that when our clients visited on the said land and saw some

    new illegal construction was going on the said land. Our client’s start getting

    inquire who is doing illegal construction on the their land without obtaining

    consent/ permission from our client. After some time from the relevant

    sources our client got to know that one Mr. Mohammed Faisal Fakrul Islam

    Siddique residing at M-1, Flat No. 103 1st Floor, Marina Tower, Millat Nagar,

    Bhiwandi, Thane- 421302 is currently doing illegal construction on the said

    land on approximately 3798 sq.ft , without obtaining any consent or

    permission from our clients as the owner of the said Agricultural land or from

    Municipal corporation who is the plaining authority or any other concerning

    authorities. A copy of Photographs dated 21 st November, 2022 which shows

    new illegal construction has started on the said land is attached herewith for

    your reference.

    4. Our clients have instructed us to call upon your office to act upon this letter

    within a period of 3 days from the date of receipt of this letter by you, failing

    which our clients have given us preemptory instructions to adopt legal

    proceedings by way of filling a write petition before the Hon’ble High Court at

    Bombay for various reliefs against you. You are hereby requested to kindly

    investigate in the matter and take immediate and necessary actions against

    illegal construction on the said agricultural land or issued stop work notice to

    Mr. Mohammed Faisal Fakrul Islam Siddique who is doing illegal construction

    on the said agricultural land. An immediate action in the matter shall be highly

    appreciated.
