Criminal Procedure Act [Cap. 20 R. E. 2022]; Section 27 (1) (a) and (b) of the Drugs and
Prevention of Illicit Traffic in Drugs Act [Cap. 95 R:E. 2019]; and any other enabling provisions
of the Law)

charge of illicit Trafficking in Narcotic Drugs contrary to Section 15A (1) and (2) (c) of the
Drug Control and Enforcement Act (Cap 95 R.E 2019) as amended, instituted and
pending determination of the Resident magistrate court at kisutu at Dar es salaam.
2. Any other order (s) the Honourable court deem proper to grant in the circumstance of
the application

I, NYAKISIRYA S/O MUGOYA, an adult Tanzanian, resident of Butiama District, Christian by faith
do hereby take oath and state as follows; -
1. That I am the accused person in Criminal Case No.90/2022 pending in the District Court
of Musoma, hence conversant with facts I am deposing hereunder in support of the
application for bail
2. That on 05/07/2022 I was arrested at Butiama District and on 05/08/2022 I was
arraigned before the District Court of Musoma with the offence of Trafficking in Narcotic
Drugs contrary to section 15A (1) and (2) (c) of the Drug Control and Enforcement Act,
Cap 95 R.E 2022
3. That before the District Court of Musoma the charge was read against me and I was told
that I cannot be granted bail as the amount of 37.8 kilograms of Narcotic Drugs is high.
4. That no any proof does exist as of right now, on the presence of 37.8 kilograms of
Narcotic Drugs in terms of weight measuring (scales) and forensic report
5. That I am available and reliable person who is not likely to jump bail or breach condition
(s) of bail if granted.
6. That I was informed by my advocate, which information I believe to be true that the
amount stated in the charge as the value of the subject matter of the offence cannot
justify denial of bail as of right now if I am capable to fulfill bail condition (s).
7. That I am the husband and father on whom the family depends on.
8. That I am suffering from eyes illness which needs close monitoring by clinical officers
and administration of medics.
9. That in the circumstances, it is just that the applicant who is me be admitted to bail.

Cap 95 R.E 2022
3. That before the District Court of Musoma the charge was read against me and I was told
that I cannot be granted bail as the amount of 32.3 kilograms of Narcotic Drugs is high.
4. That no any proof does exist as of right now, on the presence of 32.3 kilograms of
Narcotic Drugs in terms of weight measuring (scales) and forensic report
5. That I am available and reliable person who is not likely to jump bail or breach condition
(s) of bail if granted.
6. That I was informed by my advocate, which information I believe to be true that the
amount stated in the charge as the value of the subject matter of the offence cannot
