INTERVIEW SUSPECT:
Below is a summary of our conversation and should be used in conjunction with the BWC and in-car video. It
should be noted Lillywhite was not in-custody during our initial interview. After Lillywhite refused to perform
SFSTs and consent to a PBT, he was placed under arrest and read his Miranda Rights.
Upon initial contact with Lillywhite, I spoke with him in front of my patrol vehicle at approximately 0310 hours. I
began by asking Lillywhite what events led up to the crash. Lillywhite responded, “I’m just gonna tell ya, I’m not
sure what happened and, it is what it is.” I again asked Lillywhite what happened tonight and he replied, “I don’t
know, all I know is I went in the ditch and I don’t got no clue.” I then asked what happened before he went into
the ditch and Lillywhite responded, “No I wasn’t driving” even though I did not ask him that question. I asked
him multiple more times what events led up to the crash and he Lillywhite replied he did not know each time.
I then asked Lillywhite who was driving the vehicle he was in and he said, “I have no idea.” He then explained
the vehicle was owned by the county. I again asked who was driving the vehicle and Lillywhite stated, “To be
honest with you, bad, bad, bad, but no, I don’t.”
HANDCUFFED:
I handcuffed Lillywhite behind his back. I checked tension and double locked the handcuffs.
MIRANDA RIGHTS:
I read Lillywhite his Miranda Rights via my department issued card at 0322 hours. Lillywhite advised he
understood his rights and said he did not want to answer my questions.
TRANSPORTED / LODGED:
I transported Lillywhite in the front seat of my patrol car to Bronson Methodist Hospital for the consent blood
draw and to Kalamazoo County Jail for lodging.

INFORMATION:
I was contacted by Lt. Ernstes by telephone at 0300hrs on 2-26-23. I was told Tprs. Knaup and Burnside were
at a crash involving the St. Joseph County (Michigan) Sheriff. I was told there were indications the Sheriff was
the operator of the vehicle and was currently intoxicated. I was asked to respond to the scene to supervise
and assist in the investigation.
I arrived on scene at approximately 0350hrs. MSP Marshall Sgt. Lindsay had arrived on scene and was with
Tpr. Knaup/Burnside and the St. Joseph County vehicle.
The crash scene was on a straight portion of US 131 with a small grass median dividing the 2 southbound and
2 northbound lanes. I was coming south from Schoolcraft, Mi as I observed the crash. The northern most
vehicle I first came to was facing south in the northbound lane (left lane of travel). What was later learned to
be the suspect vehicle was facing south in the ditch on the west side of the southbound lanes approximately
100 yards south of the other vehicle.
This portion of US 131 is adjacent to empty fields that is used for crops in the summer months of the year. At
this time of year there was nothing growing with lighted visibility being approximately one mile in most
directions with no obstructions. The closest obstruction appeared to be a building I estimated to be over ½
mile to the south of the crash scene on the east side of US 131. The open terrain and lack of vegetation easily
allowed objects to be seen for a long distance.
I first stopped at the northern most vehicle (Indiana registration DDX580). I began speaking with Kalamazoo
County Sheriff Personnel on scene and spoke with Tpr. Knaup on scene a few minutes later.
I learned occupants of the vehicle from Indiana had been medically checked and left the scene by private car
prior to my arrival.
Mark Lillywhite was in custody in Tpr. Knaup/Burnside’s vehicle with Tpr. Burnside.
I learned the vehicle in the ditch was owned by St. Joseph County Sheriff Department. There were three guns
located in the vehicle along with several other items typically owned/used by police officers.
Tpr. Knaup had interviewed three un-involved witnesses that either witnessed the crash happen and
immediately stopped to help, or arrived shortly after the crash happened. All three identified Mark Lillywhite as

Tpr. Knaup had secured one firearm Mark Lillywhite told him was in the center console. Tpr. Knaup asked me
to photograph and collect two additional firearms that were in the back/trunk area of the vehicle.
I agreed to take photographs and collect any additional items from the scene while Tpr. Knaup and Tpr.

I photographed the scene of the damage to the vehicles. I also photographed items located in Mark
Lillywhite’s vehicles that were seized or taken for safe keeping.
Once at the post Tpr. Hug continued photographing the items retained as property and the other specialty
equipment that appeared to be owned by the Sheriff Department.
I was able to obtain the cell phone number of the St. Joseph County Undersheriff Jason Bingaman. I spoke
with the Undersheriff over the telephone on several occasions on 2-26-23. I asked him about the vehicle and
equipment, but was not given an immediate answer. On a subsequent phone call the Undersheriff understood
the situation and understood/agreed the vehicle would be towed to McDonald’s towing. I explained some of
the Sheriff Department items would be taken to the MSP Paw Paw Post where he could make arrangements to
pick them up.
SEIZED PROPERTY:
The rifle and handgun described in Property #2 and #3 in the tan pelican case were first observed by Sgt.
Lindsay and seized by me on scene. They were transported to the MSP Paw Paw Post where they were
entered into property on this original report. There were several live rounds loaded into magazines for each of
these guns inside the pelican case. All live rounds were combined by caliber and entered into Property #4 and
#5 in the original report.
After speaking with Undersheriff Bingaman the first couple times on 2-26-23 I did not receive an answer on
what to do with the other ID’s, Badges, keys, Tactical Gear, and Sheriff Dept. items in the vehicle that did not
have evidentiary value to this case but I did not want to have towed with the vehicle. The decision was made
that I would secure the items, and turn them over to MSP Paw Paw Lt. Ernstes to return to St. Joseph County
Sheriff Dept. These items were photographed and will be returned to the St. Joseph County Sheriff Dept.
VIDEO:
My in car video of vehicle 5102 and Body Worn Camera were activated while on scene until items were seized
and Mark Lillywhite was taken from the scene.
I completed a search warrant for a data download of the event data recorder on a silver, 2022, Chevrolet,

INFORMATION:
On the listed date and time I was requested by the Paw Paw Post F/Lt to assist troopers on an OWI
investigation just outside of the post area. A need for a sergeant on scene was due to an active law
enforcement official being investigated.
Upon arrival on scene, I contacted Trooper Knaup. The suspect was already arrested and inside a patrol car.
The driver was involved in a crash, was believed to be intoxicated, and there were no reported injuries. A gun
was also already recovered from the vehicle. I offered my assistance in attempting to locate the trunk latch as
the trooper was unable to locate it during the vehicle search.
I was unsuccessful in locating the trunk latch but I was able to take down the backseat to gain trunk access. In
the trunk I located a long gun case containing a rifle and a pistol. The gun case was placed back into the
vehicle after identification so photos could be taken.
Sergeant Coles took additional photos of the vehicle and department equipment in the vehicle. I assisted him
loading miscellaneous department items into his patrol car so they could be turned over to the department at a
later time.
I cleared the scene after I was no longer needed. TOT MSP Paw Paw

This vehicle did not have any unrepaired recalls associated with it.
VEHICLE INSPECTIONS:
Traverse
Seat Belt Use: The front driver and passenger seat belts were not being utilized when the crash
occurred. This was determined due to the seat belt pre-tensioners deploying and pulling all seat belt
webbing into the receiver. If the seat belt was being utilized, excess webbing would have been stuck
outside the retractor.
Airbag Deployment: The front driver airbag was the only airbag which deployed as a result of this
crash.
Headlamp Inspection: This vehicle was equipped with LED lamps. LED lamps are not conducive to
inspections to determine if they were illuminated or not due to there being no filament to inspect. I am
unable to verify if the headlights were on or not at the time of crash.
Stuck Speedometer: The speedometer was stuck at 100 mph. I photographed it in this location. Upon
applying external power to the vehicle to complete the CDR image process, the speedometer and
gauges reset to 0.
Vehicle Damage: The Traverse had left front impact damage. The font left tire was missing from the
vehicle due to impact damage.
Rogue
Seat Belt Use: The front driver and passenger seat belts were determined to be used. This was
determined as the seat blet pre-tensioners deployed with excess webbing outside the retractor.
Airbag Deployment: The left and right side-impact airbags and the right seat airbags deployed as a
result of this crash. The frontal airbags did not deploy, which is understandable given the crash
dynamics involved.
Vehicle Damage: The Rogue’s initial impact damage was to the right rear of the vehicle. The impact
caused the right rear tire assembly to become nearly completely torn away from the vehicle. The
vehicle rolled post impact and sustained rollover damage and impact damage to the left front of the
vehicle due to post impact dynamics.
MSP – Paw Paw informed me they received consent for me to image the Rogue. I imaged the Rogue on
02/28/2023 after obtaining a special cable to complete the image.
The data within the CDR image matches the crash dynamics for this impact. It shows the driver was not seat
belted, which matches my observations of the seat belt pre-tensioner being deployed with no excess webbing
outside the retractor. The passenger occupancy sensor status shows empty, this indicates there was not a
person sitting in the front passenger seat when the crash occurred.
The data shows the Traverse was traveling between 96 and 99 mph within the 5 seconds of pre-crash data.
The data shows the driver never applied the brakes between -5.0 and -0.5 seconds pre-impact.

Event Recording Complete: Yes

Maximum Delta-V, Lateral: -3.1 mph at 130 msec

Safety Belt Status, Passenger: Buckled
The data within the CDR image matches the crash dynamics for this impact. It shows the driver and
passenger were utilizing their seat belts, which matches my observations of the front seat belt pre-tensioners
being deployed with excess webbing outside the retractor.
The data command information matches the airbag deployment on the vehicle. The data shows the front
airbags did not deploy, the front seat belt pre-tensioners did deploy along with the side and side curtain airbag
deployment. This matches my observations of deployed equipment within the vehicle from the crash under
investigation.
The data shows the Rogue was traveling 55 mph within the 5 seconds of pre-crash data. The data shows the
driver was traveling in a straight line without any steering input when the collision occurred.

I took 49 photographs of the vehicles while conducting the CDR images. The photographs were uploaded to
Crime Scene Manager.
SUMMARY:
The Rogue was traveling at 55 mph, which is the speed limit on US 131. While traveling on US 131, the
Rogue was rear ended by the Traverse. The traverse was determined to be driving between 96 and 99 mph in
the five seconds prior to impacting the Rogue. This crash occurred due to the excessive speed of the traverse.

Recorded Crash Events:
There are two types of recorded crash events for Front, Side, and Rear (FSR) Events. The first is the Non-Deployment Event. A Non-Deployment
Event records data but does not deploy the air bag(s). The minimum SDM Recorded Vehicle Velocity Change, that is needed to record a Non-
Deployment Event, is five MPH [8 km/h]. A Non-Deployment Event contains Pre-Crash and Crash data. The oldest Non-Deployment event can be
overwritten by a Deployment Event, if all three records are full and the Non-Deployment Event is not locked. A Non-Deployment Event can be
overwritten by a more recent Non-Deployment Event if all three records are full and the Non-Deployment is older than approximately 250 ignition
cycles. Also, a Non-Deployment event can be recorded if one of the following occurs without the Deployment of any of the frontal air bags, side air
bags, pretensioners, or roll bars:
-Head Rest Deployment
-Battery Cut-Off Deployment
The second type of SDM recorded crash event for FSR Events is the Deployment Event. It also may contain Pre-Crash and Crash data.
Deployment Events cannot be overwritten or cleared by the SDM.
Rollover Events contains Pre-Crash and Crash data. Rollover event follow the same rules as FSR Deployment events.
The SDM can store up to three Events.
There are two types of PedPro crash events. The first is the Non-Deployment PedPro Event. A Non-Deployment PedPro Event records data but
does not deploy anything. A Non-Deployment PedPro Event may contain Pre-Crash and Crash data. The second type of PedPro recorded crash
event is the Deployment PedPro Event. It also may contain Pre-Crash and Crash data. Deployment Events cannot be overwritten or cleared by the
SDM.
The SDM can store up to two PedPro Events.
Data:
For FSR Events, SDM Recorded Vehicle Velocity Change reflects the change in velocity that the sensing system experienced during the recorded
portion of the event. SDM Recorded Vehicle Velocity Change is the change in velocity during the recording time and is not the speed the vehicle
was traveling before the event and is also not the Barrier Equivalent Velocity. For Deployment and Non-Deployment Events, the SDM will record up
to 300 milliseconds of data after time zero. The SDM will also record up to 300 milliseconds of Vehicle Acceleration data after time zero.
For Rollover Events, the SDM may record Lateral Acceleration, Vertical Acceleration, and Roll Rate data, if the SDM is rollover capable. This data
reflects what the sensing system experienced during the recorded portion of the event. For Rollover Deployment Events, the SDM will record up to
700 milliseconds of data before the Deployment criteria is met and 290 milliseconds after the Deployment criteria is met.
-Time between events is recorded in 10 msec intervals and is displayed in seconds for a maximum time of 655.33 seconds. The counter measures
the time from the start of one event to the start of the next event, if both events occur within the same ignition cycle.
-The Maximum SDM Recorded Vehicle Velocity Change may occur between the recorded 10 millisecond sample points of the SDM Recorded
Vehicle Velocity Change.
-Event Recording Complete will indicate if data from the recorded event has been fully written to the SDM memory or if it has been interrupted and
not fully written.

-SDM Recorded Vehicle Speed accuracy can be affected by various factors, including but not limited to the following:
-Significant changes in the tire’s rolling radius
-Final drive axle ratio changes
-Wheel lockup and wheel slip
-Brake Switch Circuit Status indicates the open/closed state of the brake switch circuit or the commanded state of the brake lamps.
-Pre-Crash data is recorded asynchronously. The 0.5 second Pre-crash data value (most recent recorded data point) is the data point last sampled
before Time Zero. That is to say, the last data point may have been captured just before Time Zero but no more than 0.5 second before Time Zero.
All subsequent Pre-crash data values are referenced from this data point.
-Pre-Crash Electronic Data Validity Check Status indicates “Data Invalid” if:
-The SDM receives a message with an “invalid” flag from the module sending the pre-crash data
-Pre-Crash Electronic Data Validity Check Status indicates “Data Not Available” if:
-No data is received from the module sending the pre-crash data
-For diesel powered vehicles, the data displayed as Throttle Position (%) is actually the data for the Air Inlet Flap Position. This is not the same as
the throttle position for a gasoline powered engine.
-Belt Switch Circuit Status indicates the status of the seat belt switch circuit.
-The ignition cycle counter will increment when the power mode cycles from OFF/Accessory to RUN. Applying and removing of battery power to
the module will not increment the ignition cycle counter.
-Ignition Cycles Since DTCs Were Last Cleared can record a maximum value of 253 cycles and can only be reset by a scan tool.
-Dynamic Deployment Event Counters tracks the number of Deployment events that have occurred during the SDM’s lifetime.
-Dynamic Event Counters tracks the number of qualified events (either Deployments, Non-deploy, or Rollover events) that have occurred during the
SDM’s lifetime.
-For Deployment Events, DTC B0052 (Deployment commanded) shall be recorded with the remainder of the data for this event even though it
occurred after Event Enable.
-For frontal Deployment Events, only the highest severity event is reported. For example, Stage 2 severity events include Pretensioner severity and
Stage 1 severity.
-Once a firing loop has been commanded to be deployed, it will not be commanded to be deployed again during the same ignition cycle. Firing loop
times for subsequent deployment type events, during the same ignition cycle, will record the deployment times as N/A.
-The airbag control module may continue to function after the vehicle has been turned off or to accessory, for a set period of time, this is called
Prolongation. However, all other vehicle modules may have their functions shut down during Prolongation. For example, if the SIR warning lamp is
commanded on by the airbag control module, during Prolongation, and is recorded in the EDR as being commanded on, the actual state of the
warning lamp would be off to an observer since the vehicle display cluster would have been in the off state. Vehicle pre-event and system data may
be recorded in the EDR as their commanded state, default state, or data invalid state.
-A Concurrent Event is when two events are happening nearly simultaneously. The “Concurrent Event Flag Set” parameter will indicate “Yes” if one
event begins, but before that event is qualified, another event begins and is qualified.
A Non-Deployment event typically becomes qualified if that event exceeds the 5 MPH (8 km/h) delta V recording threshold and the event has
concluded. A deployment event (FSR or Rollover) becomes qualified when a deployment has been commanded for that event.
Example of a Concurrent Event:
A Rollover event begins. Before the Rollover event is qualified, a Non-Deployment event begins and is qualified. Sometime after the Non-
Deployment event is qualified, the Rollover event is qualified. The Non-Deployment event will be recorded in the first open record even though the
Rollover event enabled before the Non-Deployment event. The Rollover event will be recorded in the next open record. The “Concurrent Event
Flag Set” parameter will indicate “Yes” for the Rollover event. The “Time Between Events” parameter will indicate the time from the start of the
Rollover event to the start of the Non-Deployment event.
-The GM parameter name is displayed in parentheses after the NHTSA Part 563 parameter name.
-All data should be examined in conjunction with other available physical evidence from the vehicle and scene.

All SDM recorded data is measured, calculated, and stored internally, except for the following:
-Vehicle Status Data (Pre-Crash) is transmitted by the Body Control Module, via the vehicle’s communication network.
-The Belt Switch Circuit is wired directly to the SDM.
Hexadecimal Data:
Data that the vehicle manufacturer has specified for data retrieval is shown in the hexadecimal data section of the CDR report. The hexadecimal
data section of the CDR report may contain data that is not translated by the CDR program. The control module contains additional data that is not
retrievable by the CDR tool.

Data Limitations
General Information:
Data limitations are intended to assist in reading event data that has been imaged from the vehicle's Air bag Control Unit (ACU). Ev ent data should
be considered in conjunction with other available physical evidence from the vehicle and scene.
- The ACU can record up to two events. If additional events occur subsequently, the older of the two events already recorded (i.e. the one which
occurred first) is overwritten.
- A Non-Deployment Event can be overwritten by another Non-Deployment event, or by a Deployment Event.
- A Deployment Event has higher priority than a Non-Deployment Event, and cannot be interrupted or overwritten by another event.
- The data pertaining to a Deployment Event is locked after being recorded. However, a second event can still be recorded subsequently in
the portion of the event memory which is not locked.
- "Life Time Counter (sec)" indicates the elapsed time, in seconds , from the vehicle’s first ignition activation until the start of the first recorded
event. The counter is incremented whenever the vehicle’s ignition is on. The counter is reset to 0 if the ACU is replaced.
- "Complete File Recorded" indicates whether a complete EDR data s et has been stored after the event. "Yes" indicates that a complet e data set
has been recorded. "No" indicates that only a portion of the data set has been recorded, for example due to the power to the ACU being lost
during the event.
- "Multi-Event, Number of Events (1, 2)" indicates the number of events whi ch are stored during a given ignition cycle. A Multi-Event occurs
whenever the time between Event 2 trigger threshold and Event 1 trigger threshold is less than or equal to 5 seconds during the same ignition
cycle, and "2" will be recorded in this case. Otherwise, "1" will be recorded.
- "Air Bag Warning Lamp (On, Off)" indicates whether the ACU was i n trouble mode or in normal operation mode at the time of the even t. "On"
indicates that the air bag warning lamp was illuminated at the tim e of the event, and the ACU was in trouble mode. "Off" indicates t hat the air
bag warning lamp was not illuminated at the time of the event, and the ACU was in normal operation mode.
- "Frontal Air Bag Suppression Switch Status" indicates whether fr ont passenger air bag deployment was suppressed at the time of the event. "On"
indicates that the front passenger air bag was suppressed at the t ime of the event (deployment inhibited). "Off" indicates that the front
passenger air bag was not suppressed at the time of the event (dep loyment enabled). This data will not be available for all vehicles.
- "Delta-V, Longitudinal" indicates the cumulative change in velocity along the longitudinal direction.
- "Acceleration, Longitudinal" indicates the rate of change of vel ocity with time along the longitudinal direction.
- "Delta-V, Lateral" indicates the cumulative change in velocity along the lateral direction.
- "Acceleration, Lateral" indicates the rate of change of velocity with time along the lateral direction.
- "Engine Throttle, % full" indicates the position of the accelera tor pedal as a percentage of the fully depressed position.
- "Service Brake (On, Off)" indicates whether the service brake is activated ("On") or not activated ("Off").
- "Steering Input (deg)" indicates the angular displacement of the steering wheel measured in degrees. -250 deg indicates a 250 degree turn to the
right of the steering wheel, 0 deg indicates the straight-ahead steering wheel position, and 250 deg indicates a 250 degree turn to the left of the
steering wheel.
- The notation "CLP" indicates that the measurement captured by a sensor exceeded the design range of the sensor.
- "Seat Track Position Switch, Foremost, Status, Driver (Yes/No)" indicates whether the driver’s seat is positioned within a designated threshold
value of the most forward adjustment position. "Yes" indicates tha t the driver’s seat is positioned within a designated threshold value of the most
forward adjustment position. For all other adjustment positions, " No" is displayed. This data will not be available if the seat trac k position switch
is not installed in the vehicle.
- "Occupant Size Classification, Right Front Passenger, Child (Yes /No)" indicates whether or not the right front passenger is classi fied as a child
(as defined in 49 CFR part 572, subpart N or smaller). This data will not be available for all vehicles.
- "e-pedal ON/OFF Status" indicates whether "e-pedal" is activated (ON), or not activated (OFF). This data will not be available for all vehicles.
- "ABS Warning lamp, on/off" indicates whether "Anti -lock Brake System" was in trouble mode or in normal operation mode at the time of the
event. This data will not be available for all vehicles.
- "AEB/FCW switch status ON/OFF (from ADAS)" indicates whether the switch of "Automatic Emergency Braking or Forward Collision Warni ng
controlled by ADAS unit" was ON, or OFF at the time of the event. This data will not be available for all vehicles.
- "AEB Warning lamp (from ADAS)" indicates whether "Automatic Emer gency Braking controlled by ADAS unit" was in trouble mode or in normal
operation mode at the time of the event. This data will not be ava ilable for all vehicles.
- "ABS regulation status" indicates whether "Anti-lock Brake System" was activated (ABS in regulation), or not activ ated (no ABS regulation). This
data will not be available for all vehicles.
- "VDC switch status ON/OFF" indicates whether the switch of "Vehi cle Dynamic Control" in ON, or OFF. This data will not be availabl e for all
vehicles.
- "VDC status/warning" indicates whether "Vehicle Dynamic Control" was in normal operation mode and not activated (No failure and no control), in
trouble mode and not activated (Failure), or in normal mode and ac tivated (In active control). This data will not be available for all vehicles.
- "Adaptive Cruise Control status" indicates whether "Intelligent Cruise Control status" was activated (ACC activated), waiting (ACC waiting),
suspended (ACC suspended), or not activated (No display request). This data will not be available for all vehicles.
- "AEB operating capability" indicates whether "Automatic Emergenc y Braking" was in trouble mode (Impossible to execute request) or in normal
operation mode (Braking fully operational). This data will not be available for all vehicles.
- "AEB Brake request (from ADAS)" indicates whether "Automatic Eme rgency Braking controlled by ADAS unit" was activated (Brake Torque AEB
Maximum), or not activated (No Brake Request). This data will not be available for all vehicles.
- "VIN retrieval from other ECU " indicates VIN data retrieval from other ECU when CDR connect to vehicle by using OBD system if avail able.
- "VIN retrieval from ACU " indicates VIN data retrieval from ACU. I t will not be available for all vehicles.
- "Motor RPM " indicates RPM of motor used for vehicle drive on electric or hybr id vehicles. In case of ICE vehicles, this indicates input shaft
revolution that is input to Gearbox. This data will not be available for all vehicles.
- "Motor RPM2" indicates RPM of motor used for vehicle drive on electric vehicle s. This data will not be available for all vehicles.
Hexadecimal Data:
All data that has been specified for retrieval is shown in the Hexadecimal Data section of this report. However, the Hexadecimal Data section may
contain data that is not translated by the CDR tool.
Data Sources:
- Crash data is measured internally in the ACU.
- Pre-crash data is not measured internally in the ACU, but is transmitt ed from other control units through the Controller Area Network (CAN).
- Pre-crash data and crash data are asynchronous.
