The undersigned, being first duly sworn, states that:

Count 1: FIRST DEGREE RECKLESSLY ENDANGERING SAFETY


The above-named defendant on or about Thursday, April 6, 2023, in the City of Kaukauna, Outagamie
County, Wisconsin, did recklessly endanger the safety of Office Lau, under circumstances which show
utter disregard for human life, contrary to sec. 941.30(1), 939.50(3)(f), 973.046(1r), 973.047(1f) Wis.
Stats., a Class F Felony, and upon conviction may be fined not more than Twenty Five Thousand
Dollars ($25,000), or imprisoned not more than twelve (12) years and six (6) months, or both.

And furthermore, invoking the provisions of Wisconsin Statute 973.046(1r), if the court imposes a
sentence or places a person on probation, the court shall impose a deoxyribonucleic acid analysis
surcharge, calculated as follows: (a) For each conviction for a felony, $250 (b) For each conviction for a
misdemeanor, $200.

And furthermore, invoking the provisions of Wisconsin Statute 973.047(1f), if the court imposes a
sentence or places a person on probation, the court shall require the person to provide a biological
specimen to the state crime laboratories for deoxyribonucleic acid analysis. The court shall inform the
person that he or she may request expungement under s. 165.77 (4).

Count 2: ATTEMPTING TO FLEE OR ELUDE AN OFFICER


The above-named defendant on or about Thursday, April 6, 2023, in the City of Kaukauna, Outagamie
County, Wisconsin, while operating a motor vehicle on a highway, after having received a visual or
audible signal from a traffic officer, federal law enforcement officer, or marked or unmarked police
vehicle that the operator knew or reasonably should have known was being operated by a law
enforcement officer, did knowingly flee or attempt to elude a traffic officer by increasing the speed of the
vehicle in an attempt to flee, contrary to sec. 346.04(3), 939.50(3)(i), 973.046(1r), 973.047(1f) Wis.
Stats., a Class I Felony, and upon conviction may be fined not more than Ten Thousand Dollars
($10,000), or imprisoned not more than three (3) years and six (6) months, or both.

And furthermore, invoking the provisions of Wisconsin Statute 343.31(3)(d)1, upon conviction the
department shall revoke the defendant's operating privileges for 6 months.

And furthermore, invoking the provisions of Wisconsin Statute 973.046(1r), if the court imposes a
sentence or places a person on probation, the court shall impose a deoxyribonucleic acid analysis
surcharge, calculated as follows: (a) For each conviction for a felony, $250 (b) For each conviction for a
misdemeanor, $200.

And furthermore, invoking the provisions of Wisconsin Statute 973.047(1f), if the court imposes a
sentence or places a person on probation, the court shall require the person to provide a biological
specimen to the state crime laboratories for deoxyribonucleic acid analysis. The court shall inform the
person that he or she may request expungement under s. 165.77 (4).

Count 3: RESISTING AN OFFICER

The above-named defendant on or about Thursday, April 6, 2023, in the City of Kaukauna, Outagamie
County, Wisconsin, did knowingly resist an officer, while such officer was doing an act in an official
capacity and with lawful authority, arrest, contrary to sec. 946.41(1), 939.51(3)(a), 973.046(1r),
973.047(1f) Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more than Ten
Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

And furthermore, invoking the provisions of Wisconsin Statute 973.046(1r), if the court imposes a
sentence or places a person on probation, the court shall impose a deoxyribonucleic acid analysis
surcharge, calculated as follows: (a) For each conviction for a felony, $250 (b) For each conviction for a
misdemeanor, $200.

And furthermore, invoking the provisions of Wisconsin Statute 973.047(1f), if the court imposes a
sentence or places a person on probation, the court shall require the person to provide a biological
specimen to the state crime laboratories for deoxyribonucleic acid analysis. The court shall inform the
person that he or she may request expungement under s. 165.77 (4).

PROBABLE CAUSE:
AND PRAYS SAID DEFENDANT BE DEALT WITH ACCORDING TO LAW; AND THAT THE BASIS
FOR THE COMPLAINANT'S CHARGE OF SUCH OFFENSE IS AS FOLLOWS:

Complainant is a sworn law enforcement officer and bases this Complaint upon the investigation of the
officers named below, who are presumed truthful and reliable as sworn law enforcement officials.

Officer Lau reports that on Thursday, April 6, 2023 at approximately 2:40 a.m., he was near the
intersection of County Trunk CE and Ann Street in the City of Kaukauna, in Outagamie County, in the
State of Wisconsin, when he was approached by a female citizen, who pulled over on her way home
from work. The female told Officer Lau she just got done working at Saint Paul's and saw a red truck
parked in the Jimmy John's parking lot. The female said the vehicle had been there for a while, and it
was running with possibly someone inside of it. Officer Lau advised that he would go and check it out
and traveled to 1402 Crooks Avenue in the City of Kaukauna, Outagamie County.
As Officer Lau arrived near the business, he saw a red Chevrolet Silverado with its lights on parked at
an angle near the drive-through window. Officer Lau reports that normally at this time of night, (or very
early morning) the only vehicle parked in the business lot is a dark-colored sedan, which is parked in
the northeastern-most parking stall closest to East 14th Street. The business has three driveway
entrances, one located on East 14th Street and two located near the northbound number two lane of
Crooks Avenue. Officer Lau drove onto 14th Street and parked on the southern side of the road and
observed the vehicle. Officer Lau observed that the windows were tinted, as such Officer Lau was
unable to see how many people were inside the vehicle. Officer Lau also reports that as he pulled to
the side of the road, he saw the vehicle perform a slow backing maneuver, travel towards the western

portion of the building, activate its brake lamps, perform another backing maneuver, then travel
eastbound while still in the parking lot and attempt to park in one of the northern parking stalls, which
was nearest to Officer Lau’s position. As the vehicle neared the parking stall, the lights extinguished on
the vehicle, and it came to a stop.
Officer Lau exited his squad car and approached the driver side closed window. The window rolled
down and revealed that a single male occupant was sitting in the driver seat. This male individual told
Officer Lau he was attempting to park. Officer Lau told the male his reason for the contact and asked
him where he was coming from tonight. The male, later identified as Jeremy Dismuke via his Florida
State issued driver's license, stated he was coming from a friend's house and some stuff happened
tonight where he did not want to get anyone in trouble. Officer Lau attempted to ask Jeremy where he
was going to, and Jeremy said he has to figure that out. Officer Lau reports that he observed Jeremy to
be wearing a tan button up polo, large metal decorative watch and smelled strongly of cologne. Given
his observations, and the totality of the circumstances, Officer Lau suspected Jeremy possibly was
coming from the bar which was located nearby. Officer Lau indicates that occasionally, patrons will park
their cars in the parking lot after hours.
Officer Lau reports that Jeremy went on to tell him something happened, which we (police) knew about,
and he told "them" "we all could go to jail tonight." Jeremy also said he was trying to set his kids on a
better path. Given these strange statements, Officer Lau asked Jeremy if he needed help tonight, and
Jeremy said he did not know. Officer Lau asked Jeremy if he had been drinking tonight, and Jeremy
said, no. Officer Lau noted that Jeremy's demeanor appeared to be nervous and not forthcoming about
why he was parked in the lot or where his next destination was. Officer Lau again asked Jeremy why he
was parked in the lot, and he said "well, I wasn't stalking," but said some of his family got into some
trouble, and he just wanted to be close in case they needed him.
Officer Lau asked Jeremy if he had his ID, and Jeremy said that he did. Jeremy reached into his back
left pocket and produced a dark-colored wallet, and Officer Lau immediately saw his ID, but Jeremy
looked into other compartments in his wallet even though the ID was right on top. Jeremy eventually
grabbed the ID but continued to look in the wallet and reach towards a pull-out compartment
underneath the radio. Officer Lau asked Jeremy what he was looking for, and he turned toward Officer
Lau and provided his ID. Officer Lau told him to wait there and walked back to his squad vehicle. Officer
Lau moved his vehicle to better position it behind Jeremy's driver side door, as where it was originally
parked was unsafe.
As Officer Lau pulled into the parking lot, he noticed the truck perform a backing maneuver and position
itself as if to go parallel next to Officer Lau’s driver side window. Officer Lau immediately exited his
squad and asked Jeremy what he was doing. Jeremy said he was just getting closer to the squad
vehicle, and Officer Lau told him not to move. Officer Lau warning Jeremy about moving his vehicle,
due to officer safety reasons, and told him his behavior and his vague statements on what he was
doing tonight concerned Officers. Officer Lau reports that Jeremy stared off towards Crooks Avenue
and did not answer or respond to his rebuke. Officer Brandt arrived on scene, and Officer Lau told
Jeremy to stay in his vehicle and not to move it. Jeremy looked at Officer Lau blankly and did not
acknowledge. Officer Lau told him two more times and asked him two more times if he understood.
Jeremy continued to stare at Officer Lau as if he was not even there. Officer Lau moved my squad car
until I was in a better position to have a better view of the vehicle.
Officer Lau briefed Officer Brandt of Jeremy's behavior and his vague story and odd statements. Officer
Lau ran Jeremy's information through his computer and saw Jeremy had a possible active warrant for
felony probation violation. Officer Lau also noticed an in-house contact, which indicated Jeremy was
involved in a high speed chase in California where he displayed a firearm. As Officer Lau was checking
his information on the computer, he noticed the brake lamps of the truck would activate on and off, and

the window was three quarters of the way pulled up. Officer Lambie arrived on scene, and Officer Lau
was able to run Jeremy's information through Outagamie Dispatch. Outagamie Dispatch confirmed
Jeremy had an active warrant through Tennessee for a felony probation violation warrant with full
extradition.
As Officers got the confirmation regarding the warrant and extradition, Officer Lau heard the truck's
engine ignite. Given Jeremy’s past actions of fleeing from law enforcement in California, his strange
actions tonight, and the vehicle being turned back on, Officers placed a stinger device under one of the
rear tires.
Sergeant Treichel arrived on scene and told Officer Lau to call Jeremy out of the truck. Officer Lau
yelled out for Jeremy to exit the vehicle, but did not receive any compliance. Officer Lau yelled out to
him again to exit the vehicle, and also withdrew his pistol from its holster. Jeremy still did not comply
until Officer Lau again yelled out another time. Officer Lau saw two hands come out from inside the
driver side. The hands went back inside the vehicle, and Jeremy still refused to obey Officer Lau’s
command to exit the vehicle.
Outagamie Deputy Lastusky arrived on scene and advised he had a pepper ball gun. Officer Lau
remained in a cover position near his squad car as Deputy Lastusky fired multiple rounds of pepper
balls into the partially open driver side window. After seeing multiple rounds go off inside the vehicle,
Officer Lau watched as the window rolled up. Deputy Lastusky met with Sergeant Treichel about using
a nonlethal device to break the back window in order to administer more pepper balls at Jeremy. The
back passenger driver side window was shattered by a nonlethal projectile, and Jeremy had more
pepper balls fired at him. During this time, the vehicle would start up and then turn off multiple times.
After the last round of pepper balls had been administered, the truck started up, and Officer Lau
watched as the vehicle began to travel west through the lot towards Crooks Avenue. The tire deflation
device was successful, and Officer Lau called out the vehicle was heading southbound on Crooks
Avenue. Officer Lau returned to his squad and activated his emergency lights and began to pursue the
truck. The truck traveled south on Crooks Avenue and turned east onto East 15th Street. The roads
were clear due to the time of the night/morning, they were dry, and the average speed was
approximately 25 miles per hour. Officer Lau was the lead car, and he could hear Officer Lambie taking
control of the radio traffic. The fleeing vehicle started to speed up as it headed towards Oakridge
Avenue. The vehicle turned southbound onto Oakridge at a wide turn.
Officer Lau caught up to the vehicle, but as he neared the vehicle, he noticed the vehicle began to
make a slow wide turn southbound into the northbound lane of Oakridge Avenue. Fearing the vehicle
was going to be taking off at a high rate of speed in a residential area, Officer Lau turned sharply and
connected the front quarter panel of his squad with the truck's back tire. The truck spun around Officer
Lau’s squad car and came to a parallel stopping position with Officer Lau’s passenger side door. Officer
Lau exited his squad and ran towards the driver side of the truck. Officer Lau withdrew his pistol from
his holster and pointed it directly at Jeremy's head through the busted window of the back driver side
passenger window. Officer Lau reports that he watched as Jeremy turned around, looked at him,
ducked and grabbed the steering wheel. During this time, Officer Lau reports he was strongly ordering
Jeremy to exit the vehicle. However, as Officer Lau was yelling his commands, he heard the squeal of
tires and saw the vehicle accelerate forward.
Officer Lau reports that he ran out of the way, so as to not get hit by the back portion of the truck. As
Officer Lau was in the middle of the road, he saw the headlights spin around and start to drive towards
him. Officer Lau sprinted towards a telephone pole located on the west portion of the road and could
hear the vehicle accelerating toward him as he is running. Officer Lau reports he yelled out "Oh Shit."
Officer Lau indicates that he was able to turn around quickly enough to see the vehicle swerving from

right to left on Oakridge Street as it continued southbound. I saw the back driver side tire was gone,
and the vehicle was traveling on its axle. I ran back to my squad car and again had to force open the
door in order to get inside.
Officer Lau reports that he continued to follow in the chase of the fleeing truck, that nearly hit him.
Eventually, the truck, which had a flat tire and another tire missing, was on County Trunk CE, the
vehicle swerved over the grass median and attempted to accelerate over it. However, the vehicle was
stuck, despite attempting to accelerate multiple times. Officer Lau and other responding officers took up
positions of cover as other additional units blocked off traffic and also took positions of cover.
Eventually, Outagamie County’s Emergency Response Team arrived to handle the scene.
Officer Vosters of the Emergency Response Team reports that officers from Outagamie County and
Winnebago County arrived to the area in MRAP, (armored vehicles) and boxed the vehicle in. Over
several hours, negotiations were attempted with Jeremy to exit the vehicle and surrendered. However,
additional tear gas had to be fired into and towards the vehicle. Officer Vosters reports that Jeremy did
eventually exit the vehicle, and proceeded to attempt to flee, on foot, down the CE trail. However,
Officers were able to quickly catch up to him. Due to Jeremy’s resistive efforts, the use of a taser was
necessary to safely get Jeremy into custody. Officer Vosters reports, that despite being hit with a taser,
Officer Vosters still had to sit on Jeremy’s legs and hold Jeremy’s left arm in the small of his back, while
other officers got his right arm behind his back and into hand cuffs.
Jeremy was eventually transported to Outagamie County Jail, for new charges and also regarding his
extradition warrant from out of State.
