Defendant. For Official Use

Complainant, an Assistant District Attorney, being first duly sworn on oath, deposes and says
that:

Count 1: HOMICIDE BY INTOXICATED USE OF A VEHICLE

The above-named defendant on or about Tuesday, April 18, 2023, in the City of Green Bay,
Brown County, Wisconsin, did cause the death of RH, by the operation of a vehicle while
under the influence of an intoxicant, contrary to sec. 940.09(1)(a) Wis. Stats., a Class D
Felony, and upon conviction may be fined not more than One Hundred Thousand Dollars
($100,000), or imprisoned not more than twenty five (25) years, or both.

And furthermore, invoking the provisions of Wisconsin Statute 343.31(3)(c), upon conviction,
the department shall revoke the defendant's operating privilege for five (5) years.

And furthermore, invoking the provisions of Wisconsin Statute 940.09(1c)(a), upon conviction,
the court shall impose a bifurcated sentence under s. 973.01 and the term of confinement in
prison portion of the bifurcated sentence shall be at least 5 years except that a court may
impose a term of confinement that is less than 5 years if the court finds a compelling reason
and places its reason on the record.

Count 2: HIT AND RUN - RESULTING IN DEATH

The above-named defendant on or about Tuesday, April 18, 2023, in the City of Green Bay,
Brown County, Wisconsin, did operate a vehicle involved in an accident that resulted in death
of RH and failed to reasonably investigate what was struck and if the operator knew or had
reason to know that the accident resulted in injury or death of a person or in damage to a
vehicle that is driven or attended by a person, and failed to stop the vehicle he was operating
as close to the scene of the accident as possible and remain at the scene of the accident until
he did the all of the following: give his name, address and the registration number of the
vehicle he or she was operating to the operator or occupant of or person attending any vehicle
collided with and, upon request and if available, exhibit his operator's license to the operator or

occupant of or person attending any vehicle collided with and render reasonable assistance to
any person injured in the accident, including transporting, or making arrangements to transport
the person to a physician, surgeon, or hospital for medical or surgical treatment if it is apparent
that medical or surgical treatment is necessary or if requested by the injured person, contrary
to sec. 346.67(1)&346.74(5)(d) Wis. Stats., a Class D Felony, and upon conviction may be
fined not more than One Hundred Thousand Dollars ($100,000), or imprisoned not more than
twenty five (25) years, or both.

And furthermore, invoking the provisions of Wisconsin Statute 343.31(3)(j), the Department
shall revoke the defendant's operating privilege for five (5) years.

Complainant is an Assistant District Attorney with the Brown County District Attorney's Office
and knows of the above offense(s) based upon:

1. Complainant’s review of the reports of Sgt. Hamill of the Green Bay Police Department,
who indicates that on April 18, 2023, at approximately 1:15 P.M. in the City of Green Bay,
Brown County, Wisconsin:

I was assigned as a day shift patrol sergeant and I am also a member of the GBPD Crash
Reconstruction Unit. At approximately 1315 hours, I was dispatched to a report of a hit and
run crash to a pedestrian at W Mason St and 16th Av, City of Green Bay, Brown County, WI.
Dispatch advised that CPR was in progress for the victim, who was later identified by other
officers as RH. As I was responding, other officers located the run vehicle and took the
operator, Trevor R Scheel ( /00), the defendant, into custody at E Mason St and S Clay
St.

When I arrived at the crash scene at 1322 hours, RH was already loaded into an ambulance
and being transported to St Vincent's Hospital, where she would be declared to be deceased.
Other officers were on scene and had the roadway shut down in both directions and were
speaking with witnesses. Officer J Allen assisted me in viewing his AXON body cam footage
to locate where RH had come to rest following the crash. I also located a pair of prescription
glasses laying in the right eastbound lane of W Mason St on the east edge of the intersection
with 16th Av. The distance between the glasses and where RH had come to rest was
approximately 90 feet.

There were numerous car parts scattered on the eastbound lanes of W Mason St to the east
of 16th Av. One piece was much larger than the rest. This piece was a black plastic ring
roughly rectangular in shape. I initially suspected this to be a headlight bezel. I spoke with
SGT Schilling, who had been at the scene were Scheel was taken into custody, and he
informed me that this piece was a part of the grille from Scheel's vehicle. I did not locate any
tire markings at the crash scene.

Sgt Jacobs with the WI State Patrol arrived on scene and asked what his agency could do to
assist. I had been informed that Scheel was suspected of being impaired. I asked Sgt Jacobs if
he had a trooper who could handle the OWI investigation portion of the crash investigation and
he stated that he did. I was later informed by Trooper Schultz that he had arrested Scheel for

OWI and Scheel was transported to jail by GBPD officers. Trooper Schultz informed me that
Scheel had stated that he had been coming from the casino.

2. Complainant’s review of the reports of Officer Fuerst of the Green Bay Police Department,
who indicates that on April 18, 2023, at approximately 1:13 P.M. in the City of Green Bay,
Brown County, Wisconsin:

I, Officer Timothy J. Fuerst, was working in full uniform and a fully marked squad car for the
Green Bay Police Department, Green Bay, Brown County, Wisconsin, assigned as 1C3. At
approximately 1313 hours, I heard officers being dispatched to a vehicle versus pedestrian
accident located at the intersection of W. Mason Street and 16 th Avenue. The suspect vehicle
was advised over the air to have left and it was a black BMW with an unknown license plate. I
heard over the radio Officer Hermans advise that he was at the intersection of Webster and E.
Mason Street. I began to respond to the intersection when I heard that Officer Hermans had
located the suspect vehicle and that the vehicle was located at the intersection of E. Mason
Street and S. Clay Street with a license plate of AEC9861.

I responded to the traffic stop location where I observed the vehicle to be a gray BMW that was
pulled onto S. Clay from E. Mason Street and stopped on the side of the road with Officer
Hermans’ squad behind it with his emergency lights activated. I positioned my squad car next
to Officer Hermans’ squad car to set up for a high-risk traffic stop. I had my department-issued
sidearm pointed at the vehicle while I made verbal commands for the male to exit the vehicle.
The male was later identified by a valid Wisconsin driver's license and as the registered owner
of the vehicle, Trevor R. Scheel, the defendant.

I ordered Trevor out of the vehicle and had him walk backwards to the sound of my voice after
lifting up his shirt to show me that he had no weapons on his beltline. While Trevor was being
placed in handcuffs, I heard him make an utterance without being prompted that he knew that
he had struck somebody. Trevor was placed in handcuffs at that time. I assisted Officer
Hermans in clearing the vehicle to make sure that there was no further threat from the vehicle.
Upon approaching the vehicle, I observed that the front bumper on the passenger side front as
well as the hood of the vehicle and the windshield were broken, dented, and cracked. I
observed that the windshield was smashed in multiple places where it appeared the victim had
struck the windshield after striking the hood of the vehicle. Trevor did also make an utterance
that he had just finished building the car.

A male approached the traffic stop after officers had cleared the vehicle and identified himself
with a valid Wisconsin driver's license as JM. JM stated that he was willing to provide a written
statement and that he had witnessed the Trevor’s vehicle striking the victim. I obtained a
written statement from JM. In his written statement, he advised that he was traveling
eastbound on W. Mason Street in the left lane. JM stated that he saw a gray BMW go past him
at a high rate of speed. He saw the car hit a female who was crossing the street, causing her
to fly approximately 10 feet in the air and then strike the ground. The female who had been
struck by the vehicle was observed by JM to be wearing a white and blue striped shirt and one
of her shoes had flown off. JM saw that the car did not attempt to brake, slow down, or stop
before striking the woman. JM then followed the car from a distance to see if the car turned off
until law enforcement had arrived on scene.

While on scene at the suspect vehicle that had been stopped by Officer Hermans, I was
approached by a female, YV, who stated that she was Trevor’s girlfriend and had received a
phone call from Trevor at approximately 1:14 to 1:15 p.m. The duration of the phone call was
very short, and he stated, “Gavi baby, I messed up, I’m probably going to jail.” YV stated that
she believes that Trevor said something along the lines that he had hit somebody, but she
couldn’t remember exactly what he had stated.

3. Complainant’s review of the reports of Officer Skeens of the Green Bay Police Department,
who indicates that on April 18, 2023, at approximately 1:13 P.M. in the City of Green Bay,
Brown County, Wisconsin:
I activated my emergency lights and sirens and headed towards Mason St. I headed West
on Mason from Baird St when I noticed a high risk traffic stop being initiated by Green Bay
Police Officers on Clay St. I pulled up behind them and drew my department issued firearm.
Officers gave commands to the driver later identified as Trevor R. Scheel. I moved in and
placed Trevor in handcuffs and transported him to the back of the nearest squad to search
him. Trevor repeatedly stated that he hit someone and he was intoxicated. Officers asked
how many he had to drink. Trevor stated he had two vodka red bulls at the Oneida Casino
on W Mason. I placed Trevor in the back of my squad and seat-belted him in.

I transported Trevor to St. Mary 's Hospital where I met with State Trooper K. Schultz whom
took over the Standardized Field Sobriety Tests (SFSTs). During the SFSTs Trevor
interrupted Trooper Schultz multiple times, saying, "you got me I did it." Trevor repeatedly
asked if the person he hit was okay. Officers explained that we would go over that once
we've completed the SFSTs. Trevor consented to a Preliminary Breath Test which read
0.222. Officers told Trevor prior to transporting to Brown County Jail that he is going to Jail
for Homicide by Intoxicated Use of a Vehicle. During transportation to the Brown County Jail
Trevor started crying repeating, "I killed someone."

4. Complainant’s review of the reports of Trooper Schultz of the Wisconsin State Patrol, who
indicates that on April 18, 2023, at approximately 1:35 P.M. in the City of Green Bay, Brown
County, Wisconsin:

At approximately 1:35 pm, I was requested to investigate a driver involved in a hit and run
crash for Operating While under the Influence, (OWI). The driver allegedly struck a pedestrian
on W Mason Street near 16th Street in the City of Green Bay. The pedestrian sustained fatal
injuries. The driver fled the scene in his vehicle and was located by Green Bay Police in his
vehicle. The driver was detained on suspicion of operating a motor vehicle while under the
influence and hit and run involving death.

I arrived at St Mary’s Hospital to investigate the driver. Officer Skeens and Officer Skenandore
of the Green Bay Police Department arrived at St Mary’s Hospital with the driver. The driver
was identified with a Wisconsin photo driver’s license as Trevor R. Scheel.

I introduced myself to Scheel and my purpose for contact. I asked Scheel if he would perform
Standardized Field Sobriety Tests (SFSTs) and he agreed. I asked Scheel about his alcohol
use and he stated, “I was an alcoholic last year, almost four months being sober, and I went to
the casino today and had two vodka red bulls.”

The first test was the Horizontal Gaze Nystagmus (HGN). I confirmed that Scheel’s eyes were
red, glossy and droopy and I could smell the odor of intoxicants coming from him. Without
being asked any questions, Scheel stated, “The person I hit, are they gonna be ok?” Scheel
again stopped the test and stated without being asked, “I’m not trying to, I’m drunk, okay, you
got me.” I observed six clues.

The next test was the Walk and Turn. I observed six clues.

The next test was the One Leg Stand. I observed four clues.

I asked Scheel if he would consent to a Preliminary Breath Test (PBT). Scheel gave a
voluntary sample and indicated a breath alcohol reading of 0.222g/210L

I informed him that he was under arrest for Operating While under the Influence. I read Scheel
the Informing the Accused verbatim. When I asked Scheel if he would submit to an evidentiary
chemical test of his blood and he replied, “Yes.” I provided Scheel with a signed copy. Scheel
was issued citations for Homicide by Intoxicated Use of a Motor Vehicle and Hit and Run
Involving Death.

Scheel’s blood was drawn at 2:45 pm by a phlebotomist at St. Mary’s Hospital. The
phlebotomist packaged Scheel’s blood and I sealed it in a legal blood kit. Scheel was turned
over to Officer Skeens and Officer Skenandore. Officer Skeens and Officer Skenandore
transported Scheel to the Brown County Jail.

5. Complainant’s review of the reports of Sgt. Brester of the Green Bay Police Department,
who indicates that on April 18, 2023, at approximately 8:36 P.M. in the City of Green Bay,
Brown County, Wisconsin:

I Sgt. Kurt Brester was on full uniformed patrol for the City of Green Bay. While on patrol, I was
contacted by Officer Stuedemann who advised me that there was a missing person call in the
stack of calls to be dispatched. He advised me that location was very close to the fatal crash
we had earlier in the day in the City of Green Bay at W. Mason St. and 16 th Ave.

As I looked at the call, I ran the female’s information who was possibly missing and also ran
her through my MDT. I checked her DOT photo and the photo which came up appeared to be
the same female that was the victim of the fatal vehicle vs. pedestrian crash earlier in the day
that we were unable to identify. I had a photograph of the victim that was sent to me by
Detective Secor.

At that time, myself and Sgt. Krueger responded to the call address to make contact with the
caller, who was the female victim’s husband.

Upon arrival, we ultimately made contact with the male, who was verbally identified as SH. In
speaking with SH, I advised him that there was an incident earlier in the day at approximately
1:15pm where a pedestrian was hit by a car and killed on W. Mason St. at 16th, which is not far
from his address. While speaking with SH, I advised him that the photograph I got back from
DOT of his wife, who he identified as RH, appeared to the be the same female that I had a
photograph of who was the victim in this case. I advised SH that he could contact the medical
examiner’s office in the morning to positively identify RH, or I could show him the picture that I

had on my phone, and he advised me that he would like to look at the picture. At that time, I
showed him the picture of the victim on my department issued cellphone and he advised that
that was his wife, RH.

SH said he worked until approximately 5:00pm and when he got home, he noticed that the
door was locked. He said that he went into the residence and noticed that RH’s purse was still
on the kitchen table and searched their house for her and could not locate her. SH said that he
attempted contact at hospitals and was unable to locate RH and that’s when he contacted law
enforcement, and he was notified by his neighbor that there was a bad crash on W. Mason St.
at 16th Ave. earlier in the day. As I spoke with SH, he advised me that it was normal for RH to
be sleeping at 2 in the morning when he left for work and that she did not have a driver’s
license and either walked or took the bus whenever she went places. SH did tell me that RH
did go to the US postal box often to drop off items on W. Mason St. on the opposite side of the
street and advised that’s what she may have been doing.

6. The written report of Trooper Schultz of the Wisconsin State Patrol indicates that on the
above date and time, he had the defendant, after reading the “Informing the Accused”, submit
to a blood test at St. Mary’s Hospital.

Complainant believes the reports of Sergeant Hamill, Officer Fuerst, Officer Skeens, Trooper
Schultz, and Sergeant Brester because he has relied on their reports in the past and has found
them to be accurate. Complainant believes the information from the Department of Motor
Vehicles because it is kept in the ordinary course of business and he knows that the
Department regularly sends notices to each person whose operation privilege has been
revoked or suspended.
