PETITION

COMES NOW, PETITIONER, through the Bureau of Agrarian Legal

Assistance, unto this honorable board, respectfully files this petition and alleges
that:
1. Petitioner is a Filipino citizen, of legal age, and a resident of Barrio of
Pangil, Malty, Lala, Lanao del Norte, where he may be served with
summons and other processes of this Honorable Board;

2. Respondents are government agencies, viz: the DAR EP-CLOA generation

of Lanao del Norte with office address at Socor Residences, J.T. Lluch
Subdivision Purok 5, Doña Juana Road, Palao. Iligan City, and the Register
of Deeds of Lanao del Norte with office address at Pigcarangan, Tubod,
Lanao del Norte respectively where they may be served with summons and
other processes of this Honorable Board;

3. Respondents are in-charged with the generation of CLOA title and the
custody of the titles of real properties in Lanao del Norte including the
subject of this petition, the TCT CLOA No. – 2, 728;

4. Petitioner is one of the farmer beneficiaries duly instituted by the DAR

Lanao del Norte of an agricultural land located at Barrio of Pangil, Malty,
 Lala, Lanao del Norte, covered by TCT CLOA No. – 2,728 containing an
area of One Hundred Fifty Four Thousand Nine Hundred Eight (154,908)
square meters more or less;

5. The said TCT CLOA No. – 2,728 was registered in the Registry of Deeds of
Lanao del Norte on December 27, 1968;

6. Sometime in 2014, when the office of DARMO Kapatagan, Lanao del Norte
processed the inclusion/exclusion of farmer beneficiaries, the subject title
cannot be found in their office files, and neither of the farmer beneficiaries
reflected in the said Certificate of Land Ownership Award (CLOA) have the
Owner’s Duplicate Copy in their possession;

7. That despite diligent efforts to locate said title, the same could no longer be
retrieved and so, on Auguat 2021, Petitioner executed an affidavit of loss
before a Notary Public of Atty. Saidali C. Gandamra;

8. That said affidavit of loss was annotated at the back of the said title as
evidenced by Entry No. 2018002270 dated September 12, 2018 for TCT
CLOA No. – 2,728; [A copy of the said Affidavit is hereto attached and marked as
Annex “A”, and the annotation at the dorsal part of the title, marked as Annex “B”]

9. That petitioner is sure and certain that he have not delivered the title to any
person, either for sale, loan, mortgage, for whatever encumbrance, so to
speak;

10.That upon verification of the said title with the Registered of Deeds, Lanao
del Norte, it was confirmed that TCT CLOA No. – 2,728 is clean and free
from all encumbrances whatsoever;

11.The Original Copy of the abovementioned title is still intact under the
custody of the Register of Deeds of Lanao del Norte; [Copy of the Electronic
Copy of TCT CLOA No. 2, 728 is attached herein marked as Annex “C” and formed an
integral part hereof.]

12. That the petitioner now comes to this Honorable Board, through the Bureau
of Legal Assistance of Department of Agrarian Reform in order to have the
missing title subject of this petition declared as lost and without any legal
effect and to obtain an order for its replacement;

13.That this petition is filed in good faith and not for any evasion or to defraud
others. The granting hereof will not prejudice the government nor cause
damage to anyone.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of the

Honorable Adjudication Board that after due notice and hearing, judgment
 shall be issued declaring the owner’s duplicate copy of TCT CLOA No. –
2,728 that was lost, as null and void, and ordering and directing the Office of
the DAR-Lanao del Norte, thru the EP-CLOA-GENERATION, to issue in
place of the lost one, new corresponding TCT CLOA No. – 2,728, which
will contain a memorandum that the same were issued in place of the lost
one, and should in all respect be entitled to like faith and credit as the
Original duplicate in accordance with law.

Other just and equitable reliefs under the foregoing are likewise being
prayed for.

18.The said TCT CLOA No. – 2,728 was registered in the Registry of Deeds of
Lanao del Norte on December 27, 1968;

19.Sometime in 2014, when the office of DARMO Kapatagan, Lanao del Norte
processed the inclusion/exclusion of farmer beneficiaries, the subject title
cannot be found in their office files, and neither of the farmer beneficiaries
reflected in the said Certificate of Land Ownership Award (CLOA) have the
Owner’s Duplicate Copy in their possession;
20.That despite diligent efforts to locate said title, the same could no longer be
retrieved and so, on Auguat 2021, Petitioner executed an affidavit of loss before

PETITION

COMES NOW, PETITIONER, through the Bureau of Agrarian Legal

Assistance, unto this honorable board, respectfully files this petition and alleges
that:

1. Petitioner is a Filipino citizen, of legal age, and a resident of Barrio of

Pangil, Malty, Lala, Lanao del Norte, where he may be served with
summons and other processes of this Honorable Board;

2. Respondents are government agencies, viz: the DAR EP-CLOA generation

of Lanao del Norte with office address at Socor Residences, J.T. Lluch
Subdivision Purok 5, Doña Juana Road, Palao. Iligan City, and the Register
of Deeds of Lanao del Norte with office address at Pigcarangan, Tubod,
Lanao del Norte respectively where they may be served with summons and
other processes of this Honorable Board;

3. Respondents are in-charged with the generation of CLOA title and the
custody of the titles of real properties in Lanao del Norte including the
subject of this petition, the TCT CLOA No. – 2, 728;
4. Petitioner is one of the farmer beneficiaries duly instituted by the DAR
Lanao del Norte of an agricultural land located at Barrio of Pangil, Malty,
Lala, Lanao del Norte, covered by TCT CLOA No. – 2,728 containing an
area of SIX HUNDRED FOURTEEN THOUSAND FORTY-EIGHT
(614,048) square meters more or less;
5. The said TCT CLOA No. – 2,728 was registered in the Registry of Deeds of
Lanao del Norte on December 27, 1968;

6. Sometime in 2014, when the office of DARMO Kapatagan, Lanao del Norte
processed the inclusion/exclusion of farmer beneficiaries, the subject title
cannot be found in their office files, and neither of the farmer beneficiaries
reflected in the said Certificate of Land Ownership Award (CLOA) have the
Owner’s Duplicate Copy in their possession;

7. That despite diligent efforts to locate said title, the same could no longer be
retrieved and so, on Auguat 2021, Petitioner executed an affidavit of loss
before a Notary Public of Atty. Saidali C. Gandamra;

8. That said affidavit of loss was annotated at the back of the said title as
evidenced by Entry No. 2018002270 dated September 12, 2018 for TCT
CLOA No. – 2,728; [A copy of the said Affidavit is hereto attached and marked as
Annex “A”, and the annotation at the dorsal part of the title, marked as Annex “B”]

9. That petitioner is sure and certain that he have not delivered the title to any
person, either for sale, loan, mortgage, for whatever encumbrance, so to
speak;

10. That upon verification of the said title with the Registered of Deeds, Lanao
del Norte, it was confirmed that TCT CLOA No. – 2,728 is clean and free
from all encumbrances whatsoever;

11.The Original Copy of the abovementioned title is still intact under the
custody of the Register of Deeds of Lanao del Norte; [Copy of the Electronic
Copy of TCT CLOA No. 2, 728 is attached herein marked as Annex “C” and formed an
integral part hereof.]

12.That the petitioner now comes to this Honorable Board, through the Bureau
of Legal Assistance of Department of Agrarian Reform in order to have the
missing title subject of this petition declared as lost and without any legal
effect and to obtain an order for its replacement;

13. That this petition is filed in good faith and not for any evasion or to defraud
others. The granting hereof will not prejudice the government nor cause
damage to anyone.
PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of the

Honorable Adjudication Board that after due notice and hearing, judgment
shall be issued declaring the owner’s duplicate copy of TCT CLOA No. –
2,728 that was lost, as null and void, and ordering and directing the Office of
the DAR-Lanao del Norte, thru the EP-CLOA-GENERATION, to issue in
place of the lost one, new corresponding TCT CLOA No. – 2,728, which
 will contain a memorandum that the same were issued in place of the lost
one, and should in all respect be entitled to like faith and credit as the
Original duplicate in accordance with law.

Other just and equitable reliefs under the foregoing are likewise being
prayed for.
