The undersigned law enforcement officer of the Fond du Lac Sheriff’s Office, being first duly sworn, states that:

Count 1: INTENTIONALLY SET FIRE TO ANOTHER'S LAND

The above-named defendant on or about March 27, 2020, Fond du Lac County, Wisconsin, did intentionally set
fire to the land of another or a marsh, contrary to sec. 26.14(8), 939.50(3)(h) Wis. Stats., a Class H Felony, and
upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6)
years, or both.

Count 2: INTENTIONALLY SET FIRE TO ANOTHER'S LAND

The above-named defendant on or about 11/04/2021, Fond du Lac County, Wisconsin, did intentionally set fire to
the land of another or a marsh, contrary to sec. 26.14(8), 939.50(3)(h) Wis. Stats., a Class H Felony, and upon
conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6)
years, or both.

Count 3: INTENTIONALLY SET FIRE TO ANOTHER'S LAND

The above-named defendant on or about April 26, 2021, Fond du Lac County, Wisconsin, did intentionally set fire
to the land of another or a marsh, contrary to sec. 26.14(8), 939.50(3)(h) Wis. Stats., a Class H Felony, and upon
conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6)
years, or both.

Count 4: INTENTIONALLY SET FIRE TO ANOTHER'S LAND

The above-named defendant on or about April 21, 2022, Fond du Lac County, Wisconsin, did intentionally set fire
to the land of another or a marsh, contrary to sec. 26.14(8), 939.50(3)(h) Wis. Stats., a Class H Felony, and upon
conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6)
years, or both.

Count 5: INTENTIONALLY SET FIRE TO ANOTHER'S LAND

The above-named defendant on or about April 28, 2022, Fond du Lac County, Wisconsin, did intentionally set fire
to the land of another or a marsh, contrary to sec. 26.14(8), 939.50(3)(h) Wis. Stats., a Class H Felony, and upon
conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6)
years, or both.

Count 6: ARSON OF PROPERTY OTHER THAN BUILDING

The above-named defendant on or about Thursday, April 28, 2022, in the Town of Ashford, Fond du Lac County,
Wisconsin, by means of fire, did intentionally damage the property (other than a building) of Citizen, valued at
$100 or more, without that person's consent, contrary to sec. 943.03, 939.50(3)(i) Wis. Stats., a Class I Felony,

and upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than
three (3) years and six (6) months, or both.

Count 7: ARSON OF PROPERTY OTHER THAN BUILDING

The above-named defendant on or about Friday, April 29, 2022 at 12:14 AM, in the Town of Empire, Fond du Lac
County, Wisconsin, by means of fire, did intentionally damage the property (other than a building) of Fond Du Lac
County, valued at $100 or more, without that person's consent, contrary to sec. 943.03, 939.50(3)(i) Wis. Stats., a
Class I Felony, and upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned
not more than three (3) years and six (6) months, or both.

PROBABLE CAUSE:

Your Complainant is a court officer with the Fond du Lac Sheriff’s Office and for this Complaint relies upon the
written reports of Fond du Lac County Detective Ryan Murphy, Deputy Tikkanen and Deputy Krafft and Wisconsin
Department of Natural Resources (hereinafter DNR) Conservation Wardens William Hankee and Joshua
Wiedenhoeft, which reports your Complainant believes accurate and reliable inasmuch as they are kept and
maintained in the ordinary course of business.

Warden Hankee reports that on March 29, 2020, he was assigned to investigate a suspicious wild fire that
occurred on March 27, 2020, at approximately 9:48 p.m., on state land in the Kettle Moraine State Forest, west of
Forest View Road, in Fond du Lac County, Wisconsin. Warden Hankee reported that he has been a credentialed
law enforcement officer with the DNR since 2016. He reported that he is trained in FI-210, Wildland Fire
Investigations, and is skilled in determining cause of wildland fires, documentation and evidence collection.
Warden Hankee reports that he concluded that the investigation did not find any evidence of natural causes or
accidental ignition and he suspected the fire was lit by hand with a fire or similar device using natural vegetation
as a fuel source.

On February 1, 2023, Warden Hankee and Detective Murphy interviewed Daniel Enright, Defendant herein.
Defendant admitted to lighting fires in the area over the last three years, starting in 2020. He lit fires to relieve
stress and some of his stress started with the birth of his child three years ago. He stated that he didn’t
specifically recall this one as it had been so long ago.

On February 1, 2023, DNR Warden Joshua Wiedenhoeft interviewed an adult female identified in full, but for
purposes of this Complainant as Witness. Witness advised that she is engaged to Defendant. Until about a year
before this interview, she and Defendant were living together at W2680 Meadow Road. Witness stated that on
March 27, 2020, she and Defendant had a fight and she stayed at her parent’s home that night. She produced a
text message for Warden Wiedenhoeft from Defendant to her dated March 27, 2020, at 8:09 p.m., which stated
that he was on his way home from working at a farm near Kewaskum.

On November 5, 2020, Warden Hankee investigated a suspicious marsh fire on state property off County Road
W, GPS coordinates approximately 43.631675, - 88.279992, in Fond du Lac County, Wisconsin, which occurred
on November 4, 2020, and was called in to Fond du Lac County dispatch at approximately 7:10 p.m. Warden
Hankee reports that his investigation did not find any evidence of natural causes or accidental ignition and it is
suspected the fire was lit by hand with a lighter or similar device using natural vegetation as a fuel source.

During the February 1, 2023, interview, Defendant advised that he was living with his fiancé’s father and mother
at their farm during this time at W2680 Meadow Road, Campbellsport, Wisconsin. He remembered lighting this
fire. He went home after lighting the fire by the bridge. He was “pretty much” able to watch the fire and fire trucks
from where he was living at the time. He rode his ATV down to the stop sign and area of the fire afterwards. The
fire was “a little bit” bigger than he expected.

On April 27, 2021, Warden Hankee and Warden Gavin Keefauver investigated a suspicious fire that occurred on
state property along Forest View Road in Fond du Lac County, Wisconsin. The suspicious fire occurred at Forest
View Road, GPS coordinates 43.57351, -88.16096 on April 26, 2021, and was reported to Fond du Lac County
dispatch at approximately 10:22 PM. Warden Hankee reports that their investigation did not find any evidence of
natural causes or accidental ignition and it is suspected the fire was lit by hand with a lighter or similar device
using natural vegetation as a fuel source.

During the February 1, 2023, interview, Defendant advised that he “may have lit it” this fire and he watched the
fire trucks from across the road. Later in the conversation, he clarified by saying “yeah” when asked if he lit this
fire. He remembered “going for a ride”, pulling over, lighting some grass, and watching the fire trucks. He then
drove home after watching the fire trucks.

In addition, Warden Hankee reports that he has reviewed the documents he received from Google and US
containing data, including GPS tracking location, on devices owned by Defendant. Your Complainant believes
these records to be accurate and reliable inasmuch as they are the regularly kept business records of these
organizations. Warden Hankee reports that Google records show a datapoint (WIFI signal) is detected from a
device using Enright’s Gmail account at 9:54PM about 1500 feet from the fire location.

On April 22, 2022, Warden Hankee along with WDNR Forest Ranger Nathan Siglinsky investigated a fire that
occurred on state property along Forest View Road, Fond du Lac County, Wisconsin, GPS coordinates 43.57380,
-8816105 on April 21, 2022. The fire was reported to Fond du Lac County dispatch at approximately 10:55 PM on
April 21st. Prior to this fire, Warden Hankee and other wardens placed surveillance cameras in the area. Upon
review of the surveillance video, Warden Hankee observed what appeared to be a pickup truck parked on the
shoulder of Forest View Road. A person exited the vehicle and within minutes a fire was seen in the nearby
vegetation at approximately 10:12 P.M. The individual re-entered the vehicle and left the area driving southbound
on Forest View Road. Warden Hankee reports that their fire scene investigation revealed that the fire appeared
to be lit by hand using a lighter similar device with natural dry vegetation as a fuel source.

During the interview of Defendant on February 1, 2023, Defendant stated that he was stressed at the time of this
incident. He admitted that he was the person seen on the surveillance video lighting this fire.

In addition, the data received by Warden Hankee from US Cellular’s nearest datapoints show Defendant’s cellular
device at the approximate location of the fire (Forest View Road and Brazelton Drive), between 10:11p.m. and
10:13p.m.

On April 28, 2022, Warden Hankee responded to and investigated another fire on state property on Forest View
Road in Fond du Lac County Wisconsin, as it was occurring. (GPS coordinates 43.57511, -88.16066) The fire
was reported to Fond du Lac County Dispatch at approximately 9:40 PM on April 28th. Upon review of the
infrared surveillance video, Warden Hankee observed what appeared to be an adult male, wearing a ball cap,
hooded or large collared type outerwear and pants exit a vehicle that appeared to be a small SUV consistent in
appearance with what Warden Hankee later learned to be Witness’ Kia Soul at approximately 9:28 p.m. He
observed this male light a fire by hand on the west side of Forest View Road. The individual left the area driving
northbound on Forest View Road immediately after lighting the fire. Warden Hankee’s investigation of this fire led
him to conclude that the fire was suspected to have been lit by hand using a lighter or similar device and local dry
vegetation as fuel.

During the interview of Defendant on February 1, 2023, Defendant admitted to lighting the fire and admitted that
he was the person driving the Kia Soul. He stated that he was trying to relieve some stress that night as he and
Witness had an argument regarding money issues prior to lighting the fires. He was upset and left the house
“very crabby”. He stated that he “left and went for a ride” and did “something (he) shouldn’t do”. He stated that
he did want to “see what it (the fire) looked like”. He pulled “into his grandparent’s yard” adjacent to the fire and
observed the area including the fire trucks responding after lighting the fire.

Reviewing the data obtained from Google, Warden Hankee reports that the nearest datapoints show a device
using Defendant’s Gmail account at the approximate location of the fire (Forest View Road and Brazelton Drive)
between 9:41p.m. and 10:14p.m.

On April 28, 2022, at 11:07 PM, while on scene of the Forestview Road fire, Warden Hankee reports that he
overheard the Fond du Lac Sheriff’s Department receive a 911 call for a marsh fire located near the intersection
of County Road W and Rolling Drive in Fond du Lac County, Wisconsin, GPS coordinates 43.560705, -
88.340699. Warden Gavin Keefauver responded to the scene with Fond du Lac County Sheriff Deputies and
local fire personnel. Warden Hankee reported that he later learned there was no evidence located of natural or
accidental causes to this fire and that it is suspected to be lit by hand similar to the Forest View Road fires.

Fond du Lac County Deputy Sheriff Tikkanen reported that he responded to that location at approximately 11:07
p.m. There was a grassy brush marsh type area on fire. He reported that this was the second fire of that nature

to which he was being dispatched, the original first fire, which occurring on Forest View Rd. near CTH S and was
at approximately 9:40 p.m. Upon arrival at this second fire, he observed the Campbellsport Fire Department
actively trying to put out the fire. The Campbellsport Fire Department directed Deputy Tikkanen to a male subject
who had called who was standing near a vehicle.

Deputy Tikkanen verbally identified the adult male, who for purposes of this Complaint is identified as Witness 2.
Witness 2 stated that he was at his residence located on CTH W when he thought he noticed somebody having a
bonfire and then he realized that the fire was happening at a place where nobody resided and then thought it was
odd so he went to check it out. When he arrived, he found the fire burning on the west side of Rolling Dr. north of
CTH W. This fire was burning through a marshy portion of the field that was about two acres or three acres worth
of land. It appeared the fire started on the northern end of this marshy area near the ditch line of Rolling Dr. and
started burning to the west from there.

Detective Murphy’s report indicated that the property owner of the above-described land is an adult male
identified in full, but for purposes of this Complaint as Victim, therefore your Complainant knows the land which
burned as described in this second incident on April 28, 20222, was not the property of Defendant.

During the February 1, 2023 interview, Defendant told Warden Hankee and Detective Murphy that he “hit” it,
referring to starting this fire, however, he did not “remember” the details of the fire. He stated that he used to work
on a farm that has land in that area.

Warden Hankee reports that according to the data received from Google, the nearest datapoints to the location of
this fire show a device associated with Defendant’s Gmail account in this approximate area between 10:44 p.m.
and 10:49 p.m. Using GPS information from US Cellular, the nearest datapoints show Defendant’s cellular device
in the approximate area at between 10:31p.m. to 10:46p.m.

Deputy Andrew Krafft reports that on April 29th 2022 at 12:14am, he was dispatched to a report of a brush fire at
CTH H at Grandview Rd in the Township of Empire, Fond du Lac County, Wisconsin. While he was in route, he
learned that Deputy Tikkanen was close by and also responded. Deputy Tikkanen had just cleared from two
brush fires that had happened earlier in the night. Upon pulling up to the scene, Deputy Krafft observed visible
flames coming from the ditch line on the south side of CTH H about 50 feet along the fence row. Deputy Krafft
grabbed his fire extinguisher and put the fire out. He inspected the area for anything that might have been left
which started the fire, but was unable to locate anything. He learned from the fire chief that he suspected it might
be related to the other fires that had happened that same evening. Deputy Tikkanen reports that this was the
third similar fire to which he responded within a period of a couple hours. Detective Murphy reports that the
owner of the land which was damaged by this fire is Fond du Lac County.

Your Complainant believes the statements of Witness, Witness 2 and Victim to be truthful and reliable inasmuch
as they are citizens who witnessed the events described. Your Complainant believes the statements of Defendant
to truthful and reliable insofar as they are against his penal interest. Your Complainant believes the statements of
Detective Murphy, Deputy Tikkanen, Deputy Krafft, Warden Hankee and Warden Wiedenhoeft to be truthful and
reliable inasmuch as they are the statements of sworn law enforcement officers made during the ordinary
performance of their official duties.

Based on the foregoing, your Complainant believes this Complaint to be true and correct.
