IMPLEMENTING  

RULES   AND   REGULATIONS   OF   ORDINANCE   NO.   022   -­‐9TH   SP,  


ENTITLED   “AN   ORDINANCE   REGULATING   THE   OPERATION   OF   TRICYCLES   IN   THE  
CITY   OF   TACURONG,   CREATING   THE   CITY   TRICYCLE   FRANCHISING   AND  
REGULATORY   BOARD   (CTFRB),   PROVIDING   GUIDELINES   FOR   THE   GRANT   OF  
FRANCHISES   AND   FIXING   THE   LICENSE   AND   PERMIT   FEES   THEREOF   AND   FOR  
OTHER  PURPOSES”  

ARTICLE  I  
GENERAL  PROVISIONS  

RULE  1.  Short  Title.    This  AdministraNve  Order  shall  be  known  as  the  ImplemenNng  Rules  
and   RegulaNons   (IRR)   of   City   Ordinance   No.   022   -­‐9th   SP,   otherwise   known   as   the   “Tricycle  
RegulaNon  and  Franchising  Ordinance  of  the  City  of  Tacurong.”  

RULE  2.  DefiniNon  of  Terms.  For  the  purpose  of  this  ImplemenNng  Rules  and  RegulaNons  
(IRR),  the  following  terms  shall  mean  and  be  understood  to  be  as  herein  defined,  as  follows:  

a. CTFRB-­‐  refers    to  the    City    Tricycle    Franchising    and    Regulatory  Board;  

b. Cluster  –  is  a  conNguous  land  area  or  a  group  of  adjoining  barangays  within  which  a  
tricycle-­‐for-­‐hire  and  assigned  by  the  owner  to  drive  a  specific  tricycle;    

c. Driver-­‐   is   the   duly   licensed   person   by   the   Land   TransportaNon   Office   (LTO)   for  
tricycles  for  hire  and  assigned  by  the  owner  to  drive  a  specific  tricycle;  

d. Franchise-­‐   a   formal   agreement   for   someone   to   operate   a   motorcycle   for   hire   as   a  


tricycle  in  coordinaNon  with  the  Land  TransportaNon  Office  which  is  renewable  every  
three  (3)  years;  

e. Motorized  Tricycle-­‐for-­‐Hire  –  a  motor  vehicle  composed  of  a  motorcycle  fiaed  with  


single  wheeled  side  cab  operated  to  render  service  to  the  general  public  for  a  fee;  

f. Motorized   Tricycle   Operator’s   Permit   (MTOP)   –   a   document   issued   by   the  


Sangguniang   Panlungsod   which   grants   franchise   or   license   to   operate   to   a   person,  
natural   or   juridical,   allowing   him/it   to   operate   tricycle-­‐for-­‐hire   over   zone   specified  
therein;  

g. Owner/Operator-­‐   is   the   registered   owner   of   a   tricycle   as   shown   by   the   Official  


Receipt/CerNficate   of   RegistraNon   issued   by   the   LTO   or   other   document   issued   by  
the  City;  

h. Out  of  Route/Line  -­‐  tricycles  operaNng  outside  their  designated  or  authorized  area  of  
operaNon;

i. Route  –  A  path  with  defined  starNng  and  ending  points  that  a  public  transportaNon  
unit  is  authorized  to  operate,  as  provided  in  the  MTOP;  

j. Terminal   -­‐   is   the   temporary   space   designated   by   the   CTFRB   through   the  
recommendaNon  of  TRU  and  duly  approved  by  the  Sangguniang  Panlungsod  where  
the  tricycles  may  be  allowed  to  queue  while  waiNng  for  passengers;    

k. Terminal   Permit   -­‐   a   permit   issued   annually   by   the   CTFRB   through   the  
recommendaNon  of  TRU  authorizing  the  said  TODA  to  manage  the  terminals  in  their  
zone  of  operaNon  subject  to  the  terms  and  condiNons  specified  therein;  

l. Tricycle   Regulatory   Unit   (TRU)   -­‐   is   the   SecNon   under   the   Office   of   the   City   Mayor  
tasked   to   monitor   the   operaNon   of   tricycles,   and   is   in   charge   of   enforcing   the  
implementaNon  of  this  Ordinance;  

m. Tricycle  Task  Force-­‐  shall  refer  to  the  City  Tricycle  Task  Force  of  the  City  of  Tacurong;  

n. UNlity   Motorized   Tricycle   -­‐   is   a   tricycle   rendering   transport   services   for   hire   or  
delivery  services  for  a  legiNmate  and  registered  business  enNty  of  the  same  owner;  
and    

o.   Zone   -­‐   is   a   conNguous   land   area   or   block,   e.g.   a   subdivision   or   a   barangay,   where  
motorized  tricycle-­‐for-­‐hire  may  operate  without  a  fixed  origin  and  desNnaNon;  

ARTICLE  II  
CITY  TRICYCLE  FRANCHISING  AND  REGULATORY  BOARD  

RULE   3.   Crea%on.   –   To   effecNvely   exercise   and   perform   the   devolved   powers   and  
funcNons  relaNve  to  the  administraNon  and  control  of  the  operaNon  of  motorized  tricycles-­‐for-­‐
hire,  there  shall  be  created  in  the  City  of  Tacurong  the  City  Tricycle  Franchising  and  Regulatory  
Board  (CTFRB).  It  shall  primarily  serve  as  policy-­‐making  body  and  shall  supervise  the  franchising  
and/or  regulaNon  of  the  operaNon  of  motorized  tricycles-­‐for-­‐  hire.    

RULE  4.  Composi%on  of  the  Board.  –  The  City  Tricycle  Franchising  and  Regulatory  Board  
shall  be  composed  of  the  following.  

Chairperson     -­‐   The  City  Mayor  or  his  designate;  

Vice-­‐Chairperson     -­‐   The  Chairperson,  Sangguniang  Panlungsod  Member    


              Commiaee  on  TransportaNon;

Members     -­‐   The  Chairperson,  Sangguniang  Panlungsod  Member      
          Commiaee  on  Barangay  Affairs;  
-­‐              The  Chief  of  Police,  Tacurong  City    Police  StaNon    
-­‐     The  President,  Tacurong  City  Tricycle  Operators  and  Drivers      
      AssociaNon  (TFTODA)  FederaNon;  
-­‐ A  RepresentaNve  from  the  Local  Price  Monitoring  Council;    
-­‐ The   Chief,   Land   TransportaNon   District   Office,   City   of  
Tacurong;  
-­‐ A  RepresentaNve  from  the  Senior  CiNzen  FederaNon;  
-­‐ RepresentaNve   from   Tacurong   City   Police   Office-­‐Traffic  
SecNon;  and    
-­‐ The   Head   of   the   City   Legal   Office,   or   his/her   duly  
authorized  representaNve  

4.1   –   RepresentaNves   of   TFTODA   and   Senior   CiNzen   shall   be   members   of   an  


accredited   Civil   Society   OrganizaNons   (CSOs)/Private   Sector   OrganizaNons   (Pos)   as   per  
Ordinance   07,   series   of   2016,   of   the   City   of   Tacurong,   DILG   Memorandum   Circular   No.  
2019-­‐72,  and  other  related  issuances.  

RULE  5.    Powers  and  Func%ons.  –  The  following  are  the  powers  and  funcNons  of  the  City  
Tricycle  Franchising  and  Regulatory  Board:  

5.1.  To  hear  peNNons  on  the  applicaNon  of  franchise.    

5.1.1.  A  duly  accomplished  PeNNon  (TF  FORM  NO.  1,  herein  aaached  as  “Annex  A”),  
with   all   its   necessary   aaachments,   shall   be   submiaed   to   the   Office   of   the   City   Legal  
Services  –  Tricycle  Franchising  Desk.  No  PeNNon  with  lacking  informaNon  and  incomplete  
aaachments  shall  be  received.    

5.1.2.  Duly  received  PeNNons  shall  be  forwarded  to  the  CTFRB  for  hearing  on  a  first-­‐
come-­‐first-­‐served  basis.  

5.2.  Upon  receipt  of  the  peNNon,  the  CTFRB  shall  convene  within  ten  (10)  days  in  order  
to  determine  if  there  is  sufficiency  of  the  peNNon  in  form  and  in  substance.    
     
5.2.1.   The   CTFRB   convenes   twice   in   every   month.   PeNNons   duly   received   on   or  
before  the  15th  day  of  every  month  shall  be  the  first  batch  of  PeNNons  to  be  heard  on  a  
scheduled  hearing,  depending  on  the  availability  of  the  CTFRB  Members,  but  in  no  way  
shall  be  scheduled  more  than  ten  (10)  days  from  the  15th  day  of  the  month.  

5.2.2.   The   Second   Batch   of   PeNNons   to   be   forwarded   to   the   CTFRB   will   those   duly  
received  from  the  16th  day  to  the  last  day  of  every  month.  The  hearing  for  this  batch  of  
PeNNons  shall  be  scheduled  in  the  same  manner  as  in  the  preceding  secNon.  

5.3.   The   CTFRB   shall   conduct   a   public   hearing   and   resolve   the   peNNon   within   (30)  
Calendar  days  aler  the  determinaNon  of  the  sufficiency  of  the  peNNon.

5.3.1.   To   shorten   the   Nme   needed   for   the   issuance   of   the   franchise,   the   public  
hearing  may  be  included  in  the  hearing  described  in  the  preceding  SecNon.  A  separate  
public  hearing  may  be  called  on  a  case-­‐to-­‐case  basis,  upon  determinaNon  of  the  CTFRB.  

5.4.   Any   recommendaNon   of   the   CTFRB   pertaining   to   its   findings   and   decisions   on   the  
peNNon   filed,   it   should   be   forwarded   to   the   Sangguniang   Panlungsod   for   the   plenary  
deliberaNon  and  approval.  

5.4.1.  If  the  CTFRB  finds  with  a  majority  vote  of  all  members  present,  that  the  PeNNon  
is  sufficient  and  that  there  is  no  reason  existent  that  will  merit  the  disapproval  of  the  
same,   the   CTFRB   shall   make   a   recommendaNon   to   the   Sangguniang   Panlungsod   for  
the  granNng  of  the  franchise.  

5.4.2.   However,   if   the   CTFRB   decides   to   the   contrary,   it   shall   issue   an   Order   laying  
down   the   reasons   of   the   disapproval   of   the   franchise.   The   Order   shall   be   served   to  
the  PeNNoner.  

5.4.3.  The  PeNNoner  whose  applicaNon  was  denied  shall  then  have  five  (5)  days  from  
the  receipt  of  the  Order  to  file  an  appeal.  The  CTFRB  shall  hear  the  said  appeal  on  the  
next   scheduled   hearing.   The   CTFRB’s   decision   on   the   said   appeal   shall   be   final   and  
executory.  

5.5.  To  recommend  the  issuance  of  a  tricycle  franchise  and  renewal  thereof  to  qualified  
tricycle  operators  to  the  Sangguniang  Panlungsod  for  approval.  

5.5.1.   The   Sangguniang   Panlungsod,   upon   receipt   of   the   recommendaNon   from   the  
CTFRB,   shall   include   the   PeNNon   in   the   agenda   of   the   next   plenary   session,   for  
deliberaNon  and  approval.  

5.5.2.   Upon   determinaNon   of   its   propriety,   the   Sangguniang   Panlungsod   shall   enact  
an  Ordinance  granNng  Franchise  to  the  PeNNoner.  

5.5.3.   Aler   receipt   of   the   Ordinance   granNng   franchise   from   the   Sangguniang  
Panlungsod,   the   PeNNoner   shall   then   proceed   to   the   City   Treasurer’s   Office   for   the  
payment  of  the  corresponding  fees,  as  likewise  indicated  in  this  IRR.  

5.5.4.  Issuance  of  CerNficate  of  Franchise  by  the  CTFRB  signed  by  the  City  Mayor  as  
Chairperson,  or  his/her  duly  authorized  representaNve.  (“Annex  B”).    

5.6.   To   recommend   amendment,   cancellaNon   or   suspension   of   franchise/s   for   any  


violaNon  of  this  Ordinance,  rules  and  regulaNons,  and  implemenNng  guidelines  thereof.  

5.6.1.   Complaints   against   a   Franchise   for   violaNon   of   the   Tricycle   Franchising  


Ordinance   and   these   rules   and   regulaNons   shall   be   filed   with   the   Office   of   the   City  
Legal  Services  –  Tricycle  Franchising  Desk.

5.6.2.  Said  complaints  shall  be  made  part  of  the  Agenda  of  the  next  scheduled  CTFRB  
Hearing.  

5.6.3.   The   CTFRB,   based   on   its   findings   and   upon   the   majority   vote   of   all   members  
present,  shall  then  forward  a  recommendaNon  to  the  Sangguniang  Panlungsod  either  
for  amendment,  cancellaNon  or  suspension  of  the  subject  franchise.    

5.7.  To  prescribe  and  regulate  the  route/zone  of  tricycle  operaNon.  

5.8.   To   recommend   any   fare   adjustment   for   tricycle   to   the   Sangguniang   Panlungsod   for   an  
appropriate  Ordinance.  

5.9.   To   periodically   review   and   recommend   reasonable   fees   and   other   related   charges   in   the  
regulaNon  of  motorized  tricycle  for  hire  but  such  review  shall  be  once  every  three  (3)  years.  

5.10.  To  propose  resoluNons  and  amendments  to  the  implemenNng  guidelines  pursuant  to  this  
Ordinance.  

5.11.   To   conduct   invesNgaNon   and   hearings   on   complaints   relaNve   to   franchising   and   other  
policies,  rules  and  regulaNons  issued  by  the  City  Tricycle  Franchising  and  Regulatory  Board.

ARTICLE  III  
TRICYCLE  REGULATORY  UNIT  (TRU)  

RULE   6.   Crea%on.   –   There   shall   be   created   a   Tricycle   Regulatory   Unit   (TRU)   under   the  
Office  of  the  City  Mayor.  The  TRU  shall  monitor  the  operaNon  of  all  motorized  tricycle  (Private  
Business  and  Public  UNlity)  operaNons  within  the  territorial  jurisdicNon  of  Tacurong  City  in  order  
to   avoid   proliferaNon   and   the   same   Nme   to   ensure   public   order   and   safety   for   the   common  
good  of  tricycle  sector,  commuters  and  pedestrian.  

RULE  7.    Composi%on.  –The  TRU  shall  be  composed  of  the  following:  

1. TransportaNon   Management   &   RegulaNons   SecNon   Head   under   the   Office   of  


the  City  Mayor  as  Head.

2. Regular   Staff/TransportaNon   Management   &   RegulaNons   SecNon   –   headed   by  
Senior   Traffic   RegulaNon   Officer   (STRO)   and   shall   be   responsible   for   the  
formulaNon   of   guidelines   on   training/seminars   and   conference   pertaining   to  
traffic.    
3. PNP  Traffic  Enforcement  SecNon-­‐  assist  Traffic  Enforcers  whose  main  duNes  and  
responsibiliNes   are   to   conduct   traffic   direcNon   and   control   of   their   respecNve  
place  of  assignment  
4.   Engineering   Office-­‐   tasked   to   conduct   inspecNon   on   road   safety   condiNon,  
traffic   signage   rerouNng   of   traffic   flow   and   business   establishments   for   traffic  
clearance  
5. Treasury   Office   -­‐   issues   receipts   pertaining   to   payments   regarding   tricycle  
regulatory  fees  and  traffic  violaNons.    
6. City   Planning   Development   and   CoordinaNng   Office   (CPDCO)   -­‐   monitors,  
prepares  staNsNcs  and  data  regarding  road  traffic  condiNons  in  the  City.  

RULE  8.    Staffing  Pa>ern.  –  The  following  is  the  staffing  paaern  of  the  TRU.  The  STRO,  
Traffic  OperaNons  Officer  II,  Traffic  OperaNons  Officer  I,  are  newly  created  posiNon  of  the  City  
Mayor’s  Office  under  SecNon  3  of  Ordinance  No.  11-­‐9th  SP,  Series  of  2022.

RULE  9.  Du%es  and  Func%ons.  –  The  Tricycle  Regulatory  Unit  (TRU)  under  the  Office  of  
the  City  Mayor  shall  perform  the  following  duNes  and  funcNons:  

1. To   process   CTFRB   approved   Tricycle   franchise   applicaNons/tricycle   franchise  


cerNficates  for  the  issuance  of  Motorized  Tricycle  Operators  Permit  (MTOP).  
2. To   provide   technical   support   to   the   City   Tricycle   Franchising   Regulatory   Board  
(CTFRB).  
3. To  issue  Ordinance  ViolaNon  Receipts  (OVR)  Tickets  and  impose  fines  and  penalNes  
to   violators   of   any   provision   of   this   Code,   or   laws   and   other   ordinances   relaNve   to  
tricycle  operaNon.  
4. To   iniNate   towing   and   impounding   procedures   to   violators   of   administraNve  
violaNons   and   recommend   the   suspension/cancellaNon   of   vehicle   registraNon/
driver's  licenses  to  the  LTO.

4.1. Impounding  Procedures  
4.1.1. Only  Traffic  Enforcers  shall  tow  and  impound  the  tricycle  unit;  
4.1.2. The   Traffic   Enforcer/s   shall   issue   Impounding   Receipt   (“Annex   D”)  
ciNng,  among  others,  the  nature  of  violaNon,  descripNon  of  the  tricycle  
unit,   name   of   the   owner/driver/possessor   and   the   name   of  
Apprehending  Officer/s;  and    
4.1.3. The  impounding  area  shall  be  designated  by  the  CTFRB.  

5. To  iniNate  the  filing  of  complaints  against  Tricycle  drivers/operators  for  violaNons  of  
any   provisions   of   this   Code   or   any   laws   or   other   ordinance   relaNve   to   tricycle  
operaNon.      

5.1. Complaint   against   tricycle   driver/operator   shall   be   filed   with   the   CTFRB   thru  
the  Office  of  the  City  Legal  Services—Tricycle  Franchising  Desk.  
     
6. To  take  charge  of  the  issuance  of  Order  of  the  payment  for  tricycle  regulatory  fees,  
release  of  MTOP,  issuance  of  annual  sNckers,  and  other  related  documents.    
7. To   recommend   the   designaNon   or   allocaNon   of   certain   porNons   of   the   streets   or  
spaces  for  terminals.    
8. To  implement  and  enforce  provisions  of  relevant  laws  and  ordinances  pertaining  to  
the  operaNon  of  tricycle.  
9. To   receive   public   complaints   and   take   acNon   against   complained   tricycle   drivers/
operators  and  tricycle  associaNon  in  accordance  with  the  provisions  of  this  Code.  
10. To   recommend   suspension   or   cancellaNon   of   Tricycle   franchise,   for   violaNons   that  
warrant  such  cancellaNon.  

10.1.RecommendaNon  for  and  cancellaNon  of  the  Tricycle  Franchise  shall  be  forwarded  
to  the  CTFRB.  

ARTICLE  IV  
CITY  TRICYCLE  TASK  FORCE    

RULE   10.   Crea%on.   –   There   shall   be   created   a   City   Tricycle   Task   Force   of   the   City   of  
Tacurong.  

  RULE  11.  Composi%on.  -­‐  The  Task  force  shall  be  composed  of  the  following:  

a. The  City  Mayor  as  Chairperson;  


b. The  Chief  of  Police  as  Vice  Chairperson;  
c. The   Sanggunian   Chairperson   of   the   Commiaee   on   TransportaNon   or   Public  
Safety  or  the  related  commiaee;  
d. The  President  of  the  Liga  ng  Barangay  in  the  city  as  member;  
e. The   Head   of   Tricycle   Regulatory   Board/Unit,   if   one   is   already   exisNng,   as  
member;  
f. The  Planning  and  Development  Officer  as  member;

g. The   Head   of   the   Traffic   Management   Office   or   (Senior   TransportaNon  
Management  &  RegulaNon  Officer),  if  any,  as  member;  
h. Local  Government  OperaNons  Officer  

RepresentaNves   from   the   Department   of   TransportaNon   and   its   aaached  


agencies  to  include  but  not  limited  to  the  Land  TransportaNon  Office  (LTO)  and  the  Land  
TransportaNon  Franchising  and  Regulatory  Board  (LTFRB),  in  the  City,  shall  be  invited  as  
resource  persons  in  all  the  acNviNes  of  the  task  force.  
     
  RULE  12.  Secretariat.  –  The  City  Legal  Officer  shall  provide  secretariat  support  to  the  task  
force.  

  RULE   13.   Du%es   and   Func%ons.   –   The   Tricycle   Task   Force   shall   have   the   following  
responsibiliNes:  
   

a. Conduct   meeNngs,   public   consultaNons   and   hearings   with   stakeholders,   and  


survey/ocular  inspecNon  of  the  /area  of  tricycle  operaNons  with  special  focus  on  
the  following:  
i. RaNonalizing   the   authorize   routes   of   all   tricycles   and   pedicabs   to   ensure  
that  they  are  banned  from  naNonal  highways;  
ii. IdenNficaNon  of  naNonal  roads  within  the  area  of  jurisdicNon  of  the  LGU;  
iii. DeterminaNon   of   the   porNons   of   the   naNonal   highway   presently   used   or  
proposed  to  be  traversed  by  tricycles  only  if  there  are  no  alternaNve  routes  
available.  

b. Dral  or  update  the  Tricycle  Route  Plan  (“TRP”).  –  Within  (thirty)  30  days  from  the  
issuance  of  this  Ordinance  and  the  adopNon  of  its  IRR,  the  commiaees  shall  come  
up  with  a  TRP  which  shall  be  the  basis  of  this  ordinance.  The  TRP  shall  contain  the  
following,  among  others:

i. All   the   locaNon   of   tricycle   terminals   and   tricycle   routes   authorized   by   the  
LGU;  
ii. The   naNonal   highways   within   the   area   of   jurisdicNon   of   the   LGU   which   is  
uNlized   by   4-­‐wheel   vehicles   greater   than   four   (4)   tons   and   where   normal  
speed  exceed  40kph;  and  
iii. PorNon(s)  of  the  naNonal  highway  to  be  allowed  use  by  the  tricycles  for  lack  
of  an  alternaNve  route.  

d. The  TRP  shall  also  detail  the  following,  among  others:  


i. InstallaNon   of   visible   and   appropriate   signages,   marks   for   lanes   and   other  
safety  features  to  guide  and  protect  all  vehicles  uNlizing  the  highways;  
ii. InformaNon   disseminaNon   plans   to   raise   awareness   among   residents   and  
other   motorists   about   the   new   tricycle   routes   and   the   porNons   of   naNonal  
highways  to  be  traversed  by  the  tricycles  for  lack  of  alternaNve  route;  
iii. Color-­‐scheme   or   any   visible   emblem/sign   imposed   on   tricycles   which   are  
allowed  to  ply  a  route  which  traverse  a  naNonal  highway;  and

iv. Proposed  penalNes  to  be  imposed  on  violators.  

The   Tricycle   Task   Force   shall   coordinate   with   the   Task   Forces   of   adjoining   LGUs  
that  traversed  the  same  naNonal  highway  to  come  up  with  coherent  TRPs.  
e. Speed  Limit  Enforcement  on  NaNonal  Highway.  

ARTICLE  V  
MOTORIZED  TRICYCLE  OPERATOR’S  PERMIT  (MTOP)  

  RULE   14.   Rules   of   Entry,   Policies,   Guidelines   and   Regula%ons   for   Applica%on   for   a  
Franchise  to  Operate  Tricycle  Service.  –    Compliance  of  all  the  requirements  herein  set  forth  is  
required  before  a  person  is  granted  a  Motorized  Tricycle  Operator’s  Permit  (MTOP)  to  operate  a  
tricycle  service.  

a. Motorized   Tricycle   Operator’s   Permit   (MTOP)   for   tricycle-­‐for-­‐hire   plying   within   the  
territorial   jurisdicNon   of   the   City   of   Tacurong   shall   be   granted   and   issued   ONLY   to  
bona  fide  residents  of  the  City  of  Tacurong.  

b. Motorized  Tricycle  Operator’s  Permit  (MTOP)  maybe  applied  for  the  issuance  which  
shall   be   valid   for   a   period   of   three   (3)   years   upon   saNsfactory   compleNon   of   the  
requirements   such   as   approved   by   the   City   Tricycle   Franchising   and   Regulatory  
Board.   The   Motorized   Tricycle   Operator’s   Permit   (MTOP)   maybe   renewed   every  
three  (3)  years  therealer.  
1. Tricycle   Units   with   2022   Business   Permit   shall   be   prioriNzed   in   the   granNng   of  
Franchise.  
c. Before  any  applicant  can  be  granted  a  Motorized  Tricycle  Operator’s  Permit  the  said  
applicant  must  comply  and  present  to  the  City  Tricycle  Franchising  and  Regulatory  
Board  the  following  requirements,  to  wit:  

1. Two   (2)   copies   of   duly   completed   applicaNon   form,   verificaNon   form   and   must  
be  notarized  by  a  notary  public;  

2. Two  (2)  copies  of  cerNficate  of  registraNon  of  motorcycle  ownership,  transfer  of  
cerNficate   of   registraNon   and   official   receipt   for   payment   of   registraNon   duly  
registered  with  the  Land  TransportaNon  Office  (LTO);  

3. Two  (2)  copies  of  sketch  and  locaNon  of  residence  with  parking  area;  

4. Two  (2)  copies  of  income  tax  return  (ITR);  

5. Two   (2)   copies   of   barangay   clearance   staNng   that   he/she   is   a   resident   with   no  
derogatory  record;  

6. Community-­‐based  Monitoring  System  (CBMS)/PhilSys  ID;  

7. One  (1)  copy  of  common  carrier  ‘s  Insurance;  

8. One  (1)  copy  of  Picture  of  Unit  (motorcycle  with  sidecar:  front  and  back);  

9. Two  (2)  copies  of  1x1  ID  picture  of  the  applicant;

10. Two  (2)  photocopies  of  police  clearance;  

11. Medical  CerNficate;  and  

12. Official  receipt  (O.R.)  of  payment  of  franchise  Fee;    

d. Renewal-­‐   A   Motorized   Tricycle   Operator’s   Permit   (MTOP)   may   be   renewed   for  


another  three  (3)  years  subject  to  the  condiNons  herein  stated,  to  wit:  
1. At   least   one   (1)   month   before   the   expiry   date   of   the   franchise,   the   owner/
operator  shall  apply  for  renewal  of  the  said  franchise  permit;  

2. Failure   to   apply   for   renewal   within   the   prescribe   period   as   stated   in   the  
immediately  preceding  paragraph  shall  result  to  a  fine  of  Three  Thousand  Pesos  
(P3,000.00)  to  be  added  on  top  of  the  other  charges  to  be  paid  by  the  owner/
operator  upon  submission  of  documents  for  renewal;  

3. Failure   to   renew   the   expired   franchise   permit   within   three   (3)   months   aler  
expiraNon   date   shall   be   sufficient   ground   for   the   denial   of   request   for  
subsNtuNon  of  unit,  and;  

4. Failure  to  renew  the  expired  franchise  permit  within  six  months  aler  the  expiry  
date  shall  result  to  dormancy  of  the  franchise.  Dormancy  for  a  period  of  three  
(3)   months   shall   be   allowed.   Units   with   dormant   franchise   are   not   allowed   to  
operate   for   the   duraNon   of   its   dormancy.   Aler   the   said   dormancy,   failure   to  
renew   the   said   franchise   shall   result   to   the   automaNc   cancellaNon   of   the   said  
franchise,  therealer,  no  request  for  renewal,  subsNtuNon  of  the  said  franchise  
shall  be  entertained  or  allowed.  

e. SubsNtuNon   of   Unit-­‐   Any   request   for   subsNtuNon   of   unit   may   be   considered  


subject  to  condiNons  herein  provided,  to  wit:  

1. The  Motorized  Tricycle  Operator’s  Permit  (MTOP)  has  been  duly  renewed;  

2. The  applicaNon  for  subsNtuNon  is  not  in  contravenNon  with  the  provision  for  
renewal  of  franchise  as  provided  for  in  SecNon  14  d  (iv)  of  this  ordinance;  

3. The  applicaNon  for  subsNtuNon  is  submiaed  at  least  one  (1)  month  aler  the  
approval  of  any  transfer  of  franchise;  and

4. The   applicaNon   for   subsNtuNon   is   accompanied   by   a   cerNfied   copy   of   an  
applicaNon   to   the   Land   TransportaNon   Office   (LTO)   that   the   unit   to   be  
subsNtuted  will  be  public  use  only.  

5. Documentary  requirements  for  subsNtuNon  of  unit:  

i. Two  (2)  copies  of  duly  completed  forms  and  verified  peNNon;  

6. Two  (2)  copies  of  valid  and  unexpired  Motorized  Tricycle  Operator’s  Permit  
(MTOP)  issued  by  the  City  Government  of  Tacurong;  

7. Two   (2)   copies   of   CerNficate   of   RegistraNon   of   motorcycle   ownership   and  


official   receipt   for   payments   of   registraNon   duly   registered   with   the   Land  
TransportaNon  Office  (LTO);  

8. Two  (2)  copies  of  Official  Receipt  (O.R.)  for  payment  of  franchise  permit  fee;  
and      

9. One   (1)   copy   of   Land   TransportaNon   Office   (LTO)   CerNficaNon   of   an  


applicaNon  that  the  unit  to  be  subsNtuted  has  been  applied  for  private  use  
only.  

10. Payment   of   subsNtuNon   of   unit   fee   in   the   amount   of   Five   Hundred   Pesos  
(P500.00)  

f. CancellaNon   of   Franchise   Permit.   -­‐   Any   franchised   unit   that   has   not   been  
renewed   for   six   (6)   months   aler   the   expiry   date   shall   be   automaNcally  
cancelled.   Therealer,   no   request   for   renewal,   subsNtuNon   or   transfer   of   said  
franchise  shall  be  entertained  or  accepted.  

  Any   tricycle   found   to   conNnue   with   its   operaNon   despite   a   cancelled   franchise   shall  
automaNcally   be   impounded   and   can   be   redeemed   only   upon   payment   of   Three   Thousand  
Pesos  (P3,000.00)  as  redempNon  fee.  
     
  RULE  15.  Fees.  –  The  following  fees  shall  be  collected  from  the  applicant,  to  wit:

  RULE  16.  Not-­‐for-­‐Hire  or  Private  Tricycles.  –  Private  tricycles  or  motorcycles  with  sidecar  
which  are  intended  for  private  use  only  shall  be  marked  bold  leaer  at  the  front,  lel,  right  sides  
of  the  sidecar  with  the  following  words,  namely  “PRIVATE  USE  ONLY”,  and/or  “NOT  FOR  HIRE”  
and  NOT  TO  TRAVEL  ALONG  NATIONAL  HIGHWAY”.  

  The   size   and/or   dimension   of   the   foregoing   marking   is   to   be   determined   by   the   City  
Tricycle  and  Franchising  Regulatory  Board  (CTFRB).  

16.1.    Top  of  the  unit  Franchise/Control  number-­‐  size  shall  be  8”  x  12”    with  white  color  
as   background   and   printed   in   black;   material   is   plainsheet   with   frame;   and   the   print   shall   be  
painted  on  the  plainsheet  back-­‐to-­‐back.  

16.2.  Front  of  the  Unit  –  the  Body  Number  is  the  same  with  Franchise  Number,  the  size  
shall  be  12”  x    12”  with  white  color  as  background  and  printed  in  black;  and  must  be  painted  on  
the  Body  directly.  

16.3.  Right  side  of  the  Unit  –  the  Body  Number  is  the  same  with  Franchise  Number  –  the  
size  shall  be  4”  x  12”  with  white  color  as  background  and  printed  in  black;  and  must  be  painted  
on  the  Body  directly.  

  RULE  17.  Limit  of  Tricycle  Units.  –  The  total  number  of  tricycles  that  will  operate  in  the  
City  of  Tacurong  is  limited  to  5,000  units  only.  No  increase  in  the  number  of  tricycles  shall  be  
allowed   unless   authorized   by   the   Sangguniang   Panlungsod   in   an   Ordinance   duly   adopted   and  
approved.  

  RULE   18.   Addi%onal   Body   Numbers.   –   There   shall   be   addiNonal   tricycle   body   numbers  
not  to  exceed  Five  Thousand  (5,000)  which  shall  be  controlled  and  allocated  by  the  CTFRB  upon  
the  recommendaNon  of  the  Business  Permits  and  Licensing  Office-­‐City  Mayor’s  Office  and  such  
body  numbers  shall  be  from  0001  to  5000.    

ARTICLE  VI  
TRICYCLE  CONFIGURATION  AND  TYPE  

  RULE  19.  Configura%on.  –  A  tricycle  is  motor  vehicle  composed  of  a  motorcycle  with  not  
more  than  two  cylinders  or  500cc  engine  capacity  fiaed  with  a  single-­‐wheel  sidecar  designed  to  
accommodate   six   (6)   passengers   including   the   driver   provided   that   the   backride   of   the  
passenger   shall   be   required   to   be   installed   a   protecNve   guard   and   adequate   handles   for  
passenger  seated  on  the  back  porNon  of  the  motorcycle.  

  RULE  20.  Prescribed  Type.  –  “Dumadag-­‐  type”  is  the  prescribed  tricycle  form  in  the  City  
of  Tacurong.

RULE   21.   Physical   Requirements   of   Tricycle   Unit.   –   No   motorized   tricycle   shall   be  
registered  unless  the  following  physical  requirements  are  complied  with  and  cerNfied,  to  wit:  

1. Durable   transparent   plasNc   or   any   similar   contrivance   must   be   used   as   sidecar  


windshield   and   must   be   free   from   unauthorized   sNcker/s   and   painNngs   that   will  
obstruct  the  outside  view  of  the  passenger;  
2. Garbage  receptacles  in  accordance  with  Ordinance  No.  03,  Series  of  2000  of  the  City  
of  Tacurong;  
3. FuncNoning  horn  (no  siren  or  any  sound  producing  gadget  or  instrument  other  than  
the  standard  horn);  
4. Two   (2)   signal   lights   front   and   back   for   turning   right   or   lel   or   for   emergency  
purposes  (no  flashing  emergency  blinkers  normally  used  for  emergency  vehicles);  
5. Tail  light  including  license  plate  light;  
6. Top  chain  guard  extending  to  rear  wheel;  
7. White   headlights   in   front   and   red   tail   light   with   funcNoning   stop   light   in   the   rear  
visible   at   least   fily   (50)   meters   from   the   front   and   rear   of   the   tricycle   and  
funcNoning  under  all-­‐weather  condiNon  and  lighted  starNng  6:00  pm  unNl  6:00  am;  
8. Lights  installed  inside  their  sidecars  and  kept  lighted  while  plying  their  routes;  
9. AnN-­‐noise  equipment/silencer;  
10. SNcker   containing   the   body   number   of   the   vehicle   and   placed   prominently   to   be  
idenNfiable  from  a  distance  (front  of  the  body  of  the  tricycle)  and  other  sNckers  that  
CTFRB  may  require  and  may  allow;  
11. Fully  operaNng  mufflers;  
12. Road  worthiness  of  the  tricycle  unit;  
13. Driver's  roof  and  windshield  for  sun  and  rain  protecNon;  
14. PlasNc  covering  as  protecNon  of  the  passengers  against  sun  and  rain;  
15. Fully  upholstered  seats  and  interiors;  
16. The  side  wheels  should  have  fender;  
17. The  standard  size  of  Nre  must  be  used  in  motorcycle  and  sidecar;  
18. PosNng  of  “No  smoking”  logo  inside  the  tricycle;  
19. PosNng  of  fixed  MTOP  Number  at  the  top  of  the  unit;  
20. PosNng  of  CTFRB  Case  Number  at  the  passenger  side  and  rear  of  the  sidecar;  
1. CTFRB  Case  Number  shall  be  printed  directly  on  the  unit  with  size  4”  x  12”  with

ARTICLE  VII  
FARES  AND  FREIGHT  

  RULE  23.  Condi%ons  for  Fares  and  Freight.  –  The  operator  can  charge  no  more  than  what  
are  provided  for  in  an  ordinance  passed  for  the  purpose  by  the  Sangguniang  Panlungsod.  Fares  
and  freight  shall  also  be  subject  to  the  following  condiNons:  

1. A  Senior  CiNzen  with  I.D.  shall  be  enNtled  to  a  twenty  percent  (20%)  fare  discount.  
2. A  student  with  valid  ID  shall  likewise  be  enNtled  to  a  student  fare  discount  of  twenty  
percent  (20%).  
3. PWDs  shall  be  also  enNtled  to  a  fare  discount  of  twenty  percent  (20%).    
4. Children  below  seven  (7)  years  old  may  be  considered  as  passengers  for  purpose  of  
fare   rate,   unless   otherwise   there   is   a   different   agreement   between   the   passenger  
and  driver.  
5. Each  passenger  is  enNtled  to  a  baggage  load  not  exceeding  ten  (10)  kilos  for  free.  
6. Cargoes  and  baggage  from  10  to  50  kilos  and  for  every  30  kilos  in  excess  of  50  kilos  
shall  pay  freight  equivalent  to  an  adult  passenger.  
7. Cargoes  whose  length  is  longer  than  6  meters  shall  not  be  allowed.  
8. Maximum  six  (6)  passengers  including  driver.  

  ViolaNon   of   any   of   the   condiNons   menNoned   in   this   SecNon   is   a   ground   to   cancel   the  
franchise  granted  to  the  owner  besides  the  administraNve  penalNes  hereinaler  provided.

  RULE   24.   Load/Capacity   Limit.   –   No   tricycle-­‐for-­‐hire   shall   be   allowed   to   carry   more  
passengers   and   goods   than   what   is   designed   for,   or   more   than   what   is   authorized   in   the  
franchise.  

  RULE  25.    Fare  Matrix.  –  A  matrix  of  the  lawful  fares  and  freight  shall  be  posted  below  
the  windshield.  Failure  to  provide  such  matrix  shall  authorize  apprehending  officer  to  take  the  
motorized  tricycle  to  the  nearest  police  staNon  and  release  same  only  upon  compliance  thereof  
and  payment  of  the  AdministraNve  Fine  of  P500.00.  

  RULE  26.  Fare  and  Freight  Rate  Adjustment.  –  The  fare  and  the  freight  rates  are  subject  
to   changes   as   deemed   necessary   by   the   Sangguniang   Panlungsod   or   upon   the   peNNon   by  
anybody  or  any  person,  associaNon  or  groups  interested  or  affected  by  the  fare  and  freight  rate  
adjustment   and   aler   a   public   hearing   and/or   consultaNon   to   amend   or   modify   the   fare   and  
freight  rates.  

  RULE   27.     Condi%ons   for   Fare   and   Freight   Rate   Adjustment.   –   The   CTFRB   may  
recommend  to  reduce  or  increase  the  fare  and  freight  rate  depending  on  the  world  supply  of  oil  
and   other   economic   factors   subject   to   the   concurrence   or   approval   of   the   Sangguniang  
Panlungsod.  

ARTICLE  VIII  
AREAS  OF  OPERATION  OF  FRANCHISED  TRICYCLES  

  RULE   28.   Areas   of   Opera%on   of   Franchised   Tricycles.   –   For   purposes   of   this   Ordinance,  
the   territorial   jurisdicNon   of   the   City   of   Tacurong   shall   embrace   the   Twenty   (20)   Barangays,  
namely:   Poblacion,   San   Pablo,   San   Emmanuel,   Tina,   V.F.   Griño   (Gansing),   D.   Ledesma,   San  
Antonio,   San   Rafael,   Buenaflor,   New   Lagao,   EJC   MonNlla,   New   Isabela,   Calean,   New   Carmen,  
Kalandagan,  Upper  Katungal,  Baras,  Lancheta,  New  Passi  and  Rajah  Muda.    

ARTICLE  IX  
OTHER  OPERATING  CONDITIONS  

All   operators   of   public   motorized   tricycle   for   hire   must   comply   with   the   following  
condiNons.    

  RULE  29.  Rules  of  Entry.  –  Only  Filipino  ciNzens  that  are  residents  of  the  City  of  Tacurong  
and   partnerships,   corporaNons,   or   associaNons   with   only   Filipino   equity   are   qualified   to   be  
operators  of  public  motorized  tricycle  for  hire.  

  RULE   30.   Restric%on   of   Opera%on.   –For   safety   reasons,   no   tricycle   shall   be   allowed   to  
operate/traverse  along  naNonal  roads,  highways,  and  major  thoroughfares  uNlized  by  4-­‐wheel  
vehicles   greater   than   4   tons   and   where   a   normal   speed   exceed   40   kph,   except   when   crossing  
the  same  if  it  is  provided.    

Motorized   tricycles   are   authorized   to   operate   along   secondary   and   terNary   roads   only.  
However,  the  CTFRB  may  provide  excepNons,  if  there  is  no  other  alternaNve  route.    

RULE   31.   Zone   Transfer.   –   Transfer   to   another   zone,   shall   be   permiaed   upon   wriaen  
applicaNon  by  the  registered  owner  with  the  TRU  staNng  his  willingness  to  surrender/terminate

his  tricycle  franchise  to  another  zone.  The  franchising  requirements  for  new  applicaNon  shall  be  
required.  

  RULE  32.  Suspension  of  Opera%on.  –  An  operator  wishing  to  stop  service  completely,  or  
suspend   service   for   more   than   one   (1)   month,   should   report   in   wriNng   such   terminaNon   or  
suspension  to  the  CTFRB,  through  the  TRU,  which  originally  granted  the  MTOP  prior  thereto.  

  RULE   33.   Non-­‐Transferable.   –   The   Motorized   Tricycle   Operators   Permit   are   hereby  
declared   strictly   non-­‐transferable   and   therefore   cannot   be   subject   of   Sale.   The   transfer   of  
franchise   or   sale   thereof   shall   be   null   and   void   without   the   approval   of   CTFRB   and   shall   be  
penalized  with  an  administraNve  fine  of  P5,000.00.  

  RULE   34.   Expired   Franchise.   –   Franchise   issued   to   public   motorized   tricycle   for-­‐hire  
operators   which   had   expired   for   more   than   three   (3)   months   shall   be   automaNcally   dropped  
from   the   service   without   a   need   for   the   noNce   of   demand   for   its   renewal   and   the   franchisee  
shall  be  subject  to  surcharges  and  other  fees  as  assessed  by  the  TRU.  Franchise  slots  which  were  
automaNcally  dropped,  subject  to  the  approval  of  the  CTFRB  upon  terms  and  condiNons  in  the  
interest   of   jusNce   and   equity,   filled   up   by   qualified   applicants   upon   recommendaNon   of   the  
CTFRB  with  the  confirmaNon  of  the  City  Council.  Those  persons  without  franchise  shall  be  given  
priority   and   preference   to   the   vacant   slots   heretofore   menNon   provided   that   they   possess   all  
qualificaNons  and  none  of  the  disqualificaNons  menNoned  in  this  Ordinance  for  the  issuance  of  
tricycle  franchise.  

  OperaNng   with   expired   franchise   shall   be   penalized   with   an   AdministraNve   Fine   of  


P5,000.00.  

  RULE  35.  Death  of  Franchisee.  –  The  franchise  of  the  deceased  may  be  transferred  to  the  
immediate   family   member   who   is   qualified   under   this   Ordinance   and   may   apply   before   the  
CTFRB,   within   thirty   (30)   days   aler   the   death   of   the   franchisee,   for   the   transfer   of   franchise  
ownership   under   his/her   name   provided   that   the   same   be   made   on   or   before   the   expiraNon  
thereof.  

  The  beneficiary/family  member  who  wishes  to  conNnue  the  operaNon  of  the  franchise  in  
the  same  zone  must  apply  with  the  CTFRB  for  a  transfer  of  franchise  operaNon.  

  In   addiNon   to   the   documentary   requirements,   the   applicant   must   present   the   death  
cerNficate  of  the  deceased  and  leaer  of  intent  to  conNnue  the  franchise  operaNon.  

  RULE  36.  Sale  of  Any  Units  with  Franchise.  –  Franchise  of  sold  unit/s  will  be  automaNcally  
dropped  from  the  service  and  the  vendee  who  wishes  to  operate  must  apply  with  the  CTFRB  for  
a  franchise  under  his  name.  

  RULE  37.  Franchise  Amendments/Change  of  Tricycle  Unit.  –  Change  of  ownership  of  unit  
or   transfer   of   MTOP   shall   be   construed   as   an   amendment   to   MTOP   shall   therefore   require  
appropriate  approval  of  the  CTFRB  and  confirmed  by  the  Sangguniang  Panlungsod.  Changing  of  
units,   as   a   condiNon   precedent   to   the   approval   of   the   same   require   the   submission   of   the  
evidence  showing  the  condiNon  of  the  motorcycle  sought  to  be  replaced-­‐such  as  but  not  limited  
to:  pictures,  affidavits  and  shall  state  the  reason/s  for  such  changing  of  unit.

to  the  operator.

RULE   38.   Parking   Prohibited   in   Specified   Places.   –   No   driver   shall   park   a   tricycle,   or  
permit   it   to   stand,   whether   aaended   or   unaaended,   upon   a   highway   in   any   of   the   following  
places  to  wit:  
a) Within  an  intersecNon;  
b) On  a  crosswalk;  
c) Within  six  meters  of  the  intersecNon  of  curb  lines;  
d) Within  four  meters  of  the  driveway  entrance  to  any  fire  staNon;  
e) Within  four  meters  of  a  fire  hydrant;  
f) In  front  of  a  private  driveway;  
g) On  the  roadway  side  of  any  tricycle  stopped  or  parked  at  the  curb  or  edge  
of  the  highway;  
h) At  any  place  where  official  signs  have  been  erected  prohibiNng  parking.  
   
RULE  39.  Driving  or  Parking  on  Sidewalk.  –  No  person  shall  drive  or  park  a  tricycle  upon  
or  along  any  sidewalk,  path  or  alley  not  intended  for  vehicular  traffic  or  parking.    

RULE  40.  Obstruc%on  of  Traffic.  –  No  person  shall  drive  his  tricycle  in  such  a  manner  as  to  
obstruct  or  impede  the  passage  of  any  vehicle,  nor,  while  discharging  or  taking  on  passengers  or  
loading  or  unloading  freight,  obstruct  the  free  passage  of  other  vehicles  on  the  highway.    

ARTICLE  X  
COLOR  CODING/  CLUSTERING  OF  UNITS    

RULE  41.  Color  Coding.  –  SecNon  V.2  of  Ordinance  No.  06,  series  of  2016  likewise  will  be  
added   with   SecNon   (t)   to   incorporate   the   desired   color   code   of   the   group   of   associaNons  
according  to  their  route  or  as  embodied  in  TFTODAI  ResoluNon  No.  02,  series  of  2016,  which  is  
hereto  designated  as  follows:  

“SecNon  V.2  (t)  –  The  Color  Code  of  Franchised  Motorized  Tricycle  is  divided  into  six  (6)  
groups  based  on  their  route  or,  as  follows:  

A.  Light  Blue:  

1. Barangay  Poblacion  

B. Yellow  Green:  

1. Barangay  New  Isabela

a. Free   Zone   in   Poblacion   –   All   tricycles   are   allowed   to   solicit   passengers   within   the  
Poblacion  of  the  City  of  Tacurong.  

b. Tricycle  of  a  barangay  from  the  same  zone  shall  be  allowed  to  convey  passengers  from  
their  point  of  origin  to  any  barangays  within  their  zone  only;  That  on  their  return  to  their  
barangay   or   point   of   origin,   they   shall   not   solicit   or   pick-­‐up   passengers   from   other  
barangays  within  their  zone  other  than  those  who  are  residents  of  their  own  barangays  
or  place  of  origin.  

c. Tricycles   of   any   barangays   shall   be   allowed   to   convey   student   passengers   from   their  
point  of  origin  to  any  schools,  colleges  and  universiNes  located  outside  their  zones;  That

on   their   return   to   their   barangay   or   point   of   origin,   they   shall   not   solicit   or   pick-­‐up  
passengers   from   other   barangays   other   than   those   who   are   residents   of   their   own  
barangays  or  place  of  origin.  

ARTICLE  XI  
TERMINAL  FOR  MOTORIZED  TRICYCLES    

  RULE  42.  Requirements  for  Applying  and  Approval  by  the  CTFRB  of  Tricycle  Terminal  for  
Motorized  Tricycles.  –  The  following  are  the  requirements  for  the  establishment  of  terminals  for  
motorized  tricycles:  

1. The  terminal  should  be  established  by  the  legiNmate  associaNon/cooperaNve  of  
tricycle  drivers  and  operators.  

2. The  associaNon/cooperaNve  is  recognized  as  legally  exisNng  by  the  TRU.  

3. A  proof  that  the  terminal  will  not  hinder  the  smooth  flow  of  traffic.  

4. A  proof  that  the  terminal  is  adequately  managed  by  the  associaNon/cooperaNve.  

5.   The   management   of   the   terminal   shall   see   to   it   that   the   tricycle   drivers   using  
the  terminal  are  following  all  the  ordinances,  rules  and  regulaNons  related  to  the  
operaNon  of  Motorized  Tricycle.  

6. Tricycles  shall  stop  engine  while  on  queue.  

7. Terminals  should  not  be  used  for  repair  work  on  tricycle  units.  

8. Gambling  and  other  vices  are  prohibited  within  the  terminal.  

9. Each  zone  must  employ  a  dispatcher.  

10. Payment  of  Terminal  Permit  Fee  in  the  amount  of  P1,000.00  per  annum.  
   
  RULE   43.   Terminal   Opera%on   System   and   Standards.   –   The   CTFRB   shall   prescribe   the  
locaNon   and   addiNonal   requirements   for   the   operaNon   system   and   standards   in   the  
establishment  of  terminals  for  tricycles.  All  tricycle  terminals  are  temporary  in  nature  subject  to  
the  infrastructure  improvements  thereon  for  the  benefit  of  the  general  public.  

  RULE  44.  Terminal  Permit.  –  The  CTFRB  shall  issue  Terminal  Permit  to  the  cluster  upon  
compliance  with  all  the  requirements  provided  for  by  this  Ordinance.  

  RULE  45.  Renewal  of  Terminal  Permit.  –  The  Terminal  Permit  shall  be  renewed  within  the  
first  month  of  the  year.

  RULE  46.  Inspec%on  of  Terminal.  –  The  terminal  shall  be  subject  to  the  regular  inspecNon  
by   the   TRU   to   determine   that   all   requirements   for   the   operaNon   of   the   terminals   are   being  
complied  with.  

  RULE  47.  Cancella%on  of  Terminal  Permit.  –  The  grant  of  Terminal  Permit  is  not  a  right  
but  only  a  privilege  and  may  be  cancelled  under  any  of  the  following  grounds:  

1. The   management   of   the   terminal   is   violaNng   any   provision   of   this   Ordinance  


and/or  any  of     the  terms  and  condiNons  stated  in  the  Terminal  Permit.  

2. Public  interest  and  welfare  demand  that  the  terminal  should  be  abolished.  

3. ExpiraNon  of  the  Terminal  Permit  and  failure  to  renew  the  permit.  

  ARTICLE  XII  
PENALTIES  AND  FINAL  PROVISIONS  

RULE  48.  Penal  Clause.  –  Any  person  who  violates  the  provisions  of  this  Ordinance  shall  
be  penalized  and/or  fined  as  follows:  

1. Any   tricycle   caught/apprehended   without   -­‐ AdministraNve  fine  of  P5,000.00


franchise   or   expired   franchise   carrying  
passenger  for  a  fee.
2. Any   tricycle   that   is   for   private   use   with   out   -­‐ AdministraNve  fine  of  P5,000.00
markings   “NOT   FOR   HIRE”,   “FOR   FAMILY   USE  
ONLY”,   “PRIVATE   USE”   and   any   other   similar  
markings  caught  carrying  passenger/s  for  a  fee.

3. Any   franchised   unit   that   did   not   comply   with   -­‐ AdministraNve  fine  of  P1,000.00
RULE   21.   PHYSICAL   REQUIREMENTS   OF  
TRICYCLE  UNIT.
4. Any   franchised   unit   that   did   not   comply   with   -­‐ AdministraNve  fine  of  P1,000.00
ArNcle  7,  FARES  AND  FREIGHT,  RULES  23-­‐27.

5. Any  motorized  tricycle-­‐for-­‐hire  to  be  without  a   -­‐ AdministraNve  fine  of  P3,000.00  
valid   franchise   issued   by   the   City   Government   (in   accordance   with   SecNon  
of   Tacurong,   even   if   the   said   unit   has   a   valid   B(l)   (Out   of   line   OperaNon)  
franchise   in   another   Local   Government   Unit   of   Ordinance   No.   018-­‐2019  
(LGU),   that   is   caught   operaNng/plying   within   of  the  City  of  Tacurong.)
the   territorial   jurisdicNon   of   the   City   of  
Tacurong,   except   when   conveying   passenger/s

and   “NOT   TO   TRAVEL   ALONG   NATIONAL

9. LiabiliNes   of   Tricycle   Drivers   and  


Operators  -­‐  For  violaNon  of  any  of  the  
provisions   of   this   Ordinance   in

for   the   amount   of   fine   corresponding

Ordinance.  

10. All   violators   shall   be   required   to  


undergo   traffic   reorientaNon   seminar  
for   one   day   to   be   conducted   by   city  
Traffic  Management  SecNon.

Where  the  violator  of  this  Ordinance  does  not  contest  his/her  apprehension  and  elect  to  
pay   the   fine   imposed   under   the   preceding   paragraph,   the   enforcement   officer   shall   forthwith  
issue  citaNon  Ncket  to  the  person  apprehended  without  resort  to  the  Court.  The  citaNon  Ncket  
shall  state  or  contain  (a.)  the  name,  signature,  age  and  address  of  the  person  apprehended;  (b.)  
the  material  facts  obtaining  in  the  commission  or  omission  of  the  crime  defined  and  penalized  
under  this  Ordinance;  (c.)  the  amount  of  fine  which  is  payable  in  favor  of  the  City  Government  
of  Tacurong;  and  (d.)  noNce  requiring  the  person  apprehended  for  extra-­‐judicial  sealement  of  
his/her   violaNon   by   paying   the   prescribed   amount   of   fine   at   the   City   Treasury   Office   within  
seventy-­‐two  (72)  hours  from  issuance  thereof,  otherwise,  appropriate  complaint  shall  be  filed  
against  him/her  before  the  Court  of  law.    

  RULE   49.   Amendment   of   the   Implemen%ng   Rules   and   Regula%ons.   –   The   Office   of   the  
City  Mayor  in  coordinaNon  with  the  CTFRB,  TRU  and  City  Tricycle  Task  Force  shall,  as  the  need  
arises,   convene   to   amend   the   necessary   provisions   of   these   rules   and   regulaNons   for   its  
effecNve  implementaNon.  
   
  RULE   50.   Budgetary   Requirements.     –   An   iniNal   amount   of   One   Million   Pesos  
(P1,000,000.00)  is  hereby  allocated  for  the  implementaNon  of  this  Ordinance.  

  RULE   51.   Separability   Clause.   –   If   any   part   of   this   ImplemenNng   Rules   and   RegulaNons  
(IRR)  be  declared  unconsNtuNonal  or  contrary  to  any  law  by  any  court  of  competent  jurisdicNon,  
the  porNons  not  so  declared  shall  remain  in  full  force  and  effect.  

  RULE   52.   Repealing   Clause.   –   All   resoluNons,   execuNve   orders   or   administraNve   orders  
which   are   inconsistent   with   this   ImplemenNng   Rules   and   RegulaNons   (IRR)   are   hereby   also  
repealed  and/or  modified  accordingly.

  RULE  53.  Effec%vity  Clause.  –    This  ImplemenNng  Rules  and  RegulaNons  (IRR)  shall  take  
effect  immediately  upon  its  approval.    

Let   copies   of   this   IRR   be   forwarded   to   all   offices   and   agencies   concerned   for   their  
informaNon,  guidance  and  appropriate  acNon.
