Subject: LEGAL NOTICE

Dear Sir,

Under the instructions from the complainant having its residence at ___________, I serve you
upon the following Legal Notice with the following facts:

1. That complainant is a law-abiding citizen of India, having its residence at ___________


2. That the opposite party as a matter of fact is a business organization namely M/S. Megha
Traders Damyanti Villa, Kanchan Vihar, Jain Mandir Road, Vijay Nagar, Jabalpur,
Madhya Pradesh- 482002
3. That the complainant entered a Water Plant Deal with the opposite party.
4. That the complainant paid a total sum of Rs. 5,04,198/- (Rupees Five Lakh Four
Thousand One Hundred Ninety-Eight Only).
5. That after the payment of the said amount the complainant received information
regarding the actual price of the water plant is Rs. 1,50,000/- (One Lakh Fifty
Thousand Only).
6. That complainant thereby cancelled the Water Plant Deal with the opposite party.
7. That the opposite party returned a sum of Rs. 1,50,000/- (Rupees One Lakh Fifty
Thousand Only).
8. That a total of Rs. 3,54,192/- (Rupees Three Lakh Fifty-Four Thousand One Hundred
Ninety-Two Only) is yet to be paid to the complainant by the opposite party due to the
cancellation of the said deal.
9. That when the complainant tried to contact the opposite party about the dues, at this point
the opposite party did not clear the stand and assured the complainant that they would
examine the statement of the dues and would do the needful. On the assurance the
complainant kept waiting for your response, however, finally the opposite party did not
take note of this matter which throws criminal intention of cheating and fraud.

10. That the complainant suffered a loss due to this unprofessional response and negligence.

I, therefore, through this notice call the opposite party to return to the complainant a sum of Rs.
Rs. 3,54,192/- (Rupees Three Lakh Fifty-Four Thousand One Hundred Ninety-Two Only)
at earliest along with an interest of 21% from the date of you retained the amount with you till
realization, further a sum of Rs. 10,000/- towards damage on account of the mental pain and
agony or wrongful or dishonest act suffered by the complainant on your part, within 15 days
from the date of receipt of this notice failing which my client shall be constrained to initiate civil
proceeding or the recovery of the above said amount and in such eventuality the opposite party
will be liable for all costs, risks and consequences that may ensure.

That the complainant will also file a case of Cheating under Section 420 of IPC as this matter
involves the contents of cheating, fraud and unjust enrichment on the part of the opposite party
which can only be investigated and tried by a Competent Criminal Court.

Further, the opposite party is liable to pay an amount of Rs. 1000/- towards Legal Notice
Charges. Please take notice accordingly.

A copy of this notice is kept in my office for further reference/action, if necessary.
