AFFIDAVIT OF DESISTANCE
  
        I, RENALYN C. CANLOM, of legal age, and a resident of Purok 5, Bagor,
Kadingilan, Bukidnon, after having duly sworn to in accordance with law
hereby depose and state:
 
1. I am the complaining witness for violation of RA 9262 (Psychological
and Economic Abuse) against WELKIE B. GARCES in the case entitled "People
of the Philippines versus Welkie Garces y Basalo", Criminal Case No. 40078-
22, Regional Trial Court, Branch No. 8, Malaybalay City, Bukidnon;
 
2. On March 6, 2023, I and the accused Welkie B. Garces appeared
before the Office of the Punong Barangay of Barangay Bagor, Kadingilan,
Bukidnon in an effort to amicably settle our differences which brought about
the above-mentioned case.
 
  3. During the said appearance, I and the said accused have reached an
amicable settlement which we principally agreed that the accused will give
TWO THOUSAND PESOS (PHP 2,000.00) through Palawan Express Pera
Padala or through any Money Remittance Center on every 11th day of every
month as his sustenance for our two common-law children, namely:

1. Bea Garces
2. Rhea Garces

  4. We also came to an agreement during the said appearance that the

accused will no longer annoy, vex, or in any way harass me through text, call,
or chat and to refrain from meddling on my private affairs; (Copy of the
“MINUTOS SA HUSAY” is hereto attached as Annex “A” to form an integral
part hereof)
 
5. That in view of the foregoing, I manifest that I now withdraw my
complaint against the accused and that I am no longer interested, and I
hereby desist, in prosecuting the above-mentioned case;

6. This Affidavit of Desistance should, however, not be understood as a

waiver or relinquishment of any of my lawful rights to pursue any legal action
that I may file in connection with any act or omission that the accused may
commit in the future;

7. I hereby release the accused from any and all criminal liabilities and
waive any right of action against the accused in connection with the above
case;

8. I fully understand the legal consequences of this Affidavit of

Desistance and I am executing this affidavit to attest to the truth of the
foregoing statements and respectfully pray that the aforementioned case
against WELKIE B. GARCES be withdrawn and/or dismissed.
