AFFIDAVIT IN SUPPORT OF THE ARREST WARRANT

Your Affiant is Detective George Otero, badge number 1848, of the Hialeah Police
Department (HPD). Your Affiant has been a police officer for ten (10) years. Your Affiant is
currently assigned to the Special Victims Bureau/Sexual Crimes (SVB/SC), Internet Crimes
Against Children (ICAC) squad. Your Affiant has been a sexual battery detective for five (5) years,
and has investigated over five hundred (500), cases of persons who collect and/or distribute child
pornography and internet crimes against children cases. Your Affiant has received training in
search and arrest warrants preparation from the Miami-Dade Police Department and other training
courses. Your Affiant is a Task Force. Officer (TFO) with Homeland Security Investigations and
has assisted in cases involving sexual battery, child exploitation, pedophiles, and preferential child
molesters. Your Affiant has attended approximately 200 hours of training in the field of Computer
Crimes and Internet Crimes Investigations. Your Affiant is a member of the South Florida Internet
Crimes Against Children Task Force (SFLICAC), which is a multi-agency task force focused on
the investigation and prosecution of child exploitation facilitated by the use of the internet.
Your Affiant now makes application for a Warrant for the arrest of Jose Robell Hernandez,
W/M, bom on also known as “Yey Hernandez” or ‘Jay Hernandez’ and (hereinafter
referred to as the “The Subject”) for UNLAWFUL SEXUAL ACTIVITY WITH SPECIFIED
MINORS F.S.S. 794.05 and CONTRIBUTING TO THE DELINQUENCY OF A MINOR F.S.S.
827.04(1) based upon testimonies by victim F.G.R., a 17 year old minor at the time, (W/F DOB
05/21/2005; hereinafter referred to as the “The Victim”) Also through facts gathered personally
by your Affiant and those conveyed by other officers involved, your Affiant states the following:

On Monday, May 08, 2023, Your Affiant was assigned this case under Hialeah Police case
2023-013064 after the victim disclosed to Miami Gardens Police and Fort Lauderdale officers that
she had been involved in a consensual sexual relationship with a 28-year-old male called “Yey or
Jay Hernandez” later identified as the subject, Mr. Jose Robell Hernandez, a Miramar Police
Officer.
The incident came to light on April 13, 2023, while the victim was walking a dog in Miami
Gardens. The victim came across a garbage bag which she suspected contained a dead body. The
victim called 911 and Miami Gardens Police responded in emergency mode to her location. When
officers arrived, they saw the victim screaming erratically and pointing at a garbage bag.
Officers inspected the garbage bag and determined there was no deceased body and that
the victim appeared to be suffering a mental health crisis. The victim appeared dirty, frantic, and
unkempt. The victim said she was not taking her medication. The victim stated, “I’m so confused.
I’m so nervous.” Prior to transporting the victim to a facility for services, Officers asked the victim
for her parent’s information. The victim handed her phone to Officer Prudent #449 and provided
consent to use her phone. Officer Prudent viewed her text messages to see if the last person she
spoke to would answer the phone.
Officer Prudent noticed the victim had been communicating with a uniform officer she
referred to as “Yey” or “Jay” In English. Officer Prudent read several text messages between them
which suggested they had a sexual relationship. In the text messages, the victim was accusing the
subject of getting her pregnant. The subject’s reply stated the victim had her period two days after
they had sexual intercourse. The subject also stated he never ejaculated inside of her. Officer
Prudent noticed the subject was an adult male and had suspicions the victim was a juvenile. Officer
Prudent asked the victim for her age and she said she was seventeen years old. Officer Prudent
continued scrolling through the victim’s text messages and saw a photo of the subject, “J.
Hernandez” in his Miramar Police uniform (Miami Gardens Police 2023-006158).
Miami Gardens Special Victims Detectives interviewed the victim who disclosed she had
a sexual relationship with the officer. The victim said the sexual encounter occurred in “Hialeah”
and/or “Ft. Lauderdale” Miami Gardens Police contacted Ft. Lauderdale Police and Sergeant
Hector Martinez assumed the investigation. On April 26, 2023, Sergeant Hector Martinez
interviewed the victim. The victim cooperated and provided a sworn recorded statement. The
victim said she met the subject on Tinder, which is a dating website. The victim said when she

created her Tinder account she used her real name, and her real birthday save for the year, which
she changed to make herself appear to be twenty-three (23) years old.
Sergeant Hector Martinez showed the victim a photograph of the subject obtained from her
cell phone and she positively identified the subject. The victim said she met the subject online on
or about March of 2023 on Tinder when they “matched” They communicated on Tinder for about
two weeks, the subject gave her his phone number, and suggested they talk via text
messages. The victim and subject began texting and talking. The victim recalled talking about her
former high school but not her age. On March 14, 2023, the victim sent the subject a voice note
stating, “I lied about my age on the page, I’m about to be 19 ... ” suggesting she was 18 years old.
The victim said they began texting daily and she believed she was in a ‘relationship’ with
the subject. The victim said she would “do things for him” explaining that she removed some of
her friends and “guys” from her phone to gain his trust so they wouldn’t have jealousy issues. The
victim said she did this on her own. The victim knew the subject was a police officer because his
Tinder profile had a photograph of him in his police uniform. The victim said she knew he was 28
years old because he told her so. The victim explained “Yey” or “Jay” would often FaceTime her
and she could see his uniform, his computer, and his coworkers. The victim said she copied the
photograph from his Tinder profile to setup his contact profile on her phone, and this was the
photograph Miami Gardens Officers stumbled upon while trying to locate a next of kin.
The victim said she met the subject in person a total of 3 times. The first time was at a
Starbucks (on Sheridan Street by a Publix), the second time was at the same Starbucks, and the
third time was at the same Starbucks, but they also went to West Lake Park, and then a hotel in
Hialeah where they engaged in sexual activity. The victim said the name of the hotel was
“Fantasy.” She conducted a Google search and identified “Executive Palace Hotel” located at 2125
W. Okeechobee Road, Hialeah, FL 33010. However, Your Affiant determined the correct hotel
was “El Paraiso” located at 1615 W. Okeechobee Road, Hialeah, FL 33010. Both hotels belong to
the Executive “Fantasy” Hotel chain.
The victim provided law enforcement with consent for her phone, a digital forensic
examination was conducted of her device, and digital evidence was retrieved which assisted Your
Affiant in obtaining an investigative timeline which corroborated the victim’s statement:
On March 16, 2023, the subject and victim met for the first time. The subject drove to the
victim’s home and picked her up in a white Scion TC. The subject confirmed his arrival, at 11:34

a.m., “Parked in the street in front of your apartments” in a “white scion to.” The subject drove her
to a Starbucks on Sheridan (near a Publix). Asked her to stay in the car, took their order and came
back to the car. The victim said they talked in the car for one or two hours. She said there was no
kissing or touching “because it was the first date.” After that date, they continued talking, most of
their communication was via text, but they also called each other.
On March 29, 2023, the subject and victim met for the second time. The subject confirmed
his arrival, at 11:30 a.m. “I’m here.” The subject drove to the victim’s home and picked her up in
a white Scion. He drove her to the same Starbucks. He asked her to stay in the car. The subject
took their order and returned to the car. The victim and subject had agreed to smoke marijuana
inside of his car. And allegedly did so. The subject dropped her off at work. On this date, the victim
and subject kissed, “making out.”
On March 30, 2023, the subject and victim met for the third time. The subject confirmed
his arrival, at 8:24 a.m., “I’m here.” The subject drove to the victim’s home, picked her up in the
white Scion and went to Starbucks a third time. After that, they went to Westlake Park in
Hollywood. At the park, the subject showed the victim pictures of a hotel, suggesting they should
go, and the victim agreed to go. The victim explained that she knew something else was going to
happen suggesting she knew they would engage in sexual activity.
Your Affiant conducted investigative research on the subject and his associates and
determined the subject’s fiance’s sister had a registered white 2007 Toyota scion TC bearing FL
tagKNRZ63.
Your Affiant conducted investigative research on License Plate Readers and determined
the subject’s white scion entered the city of Hialeah Westbound from E. 10 Avenue / E. 49 Street
on March 30, 2023 at 11:15 a.m. A license plate reader photographed the vehicle again on March
30, 2023, at 12:00 p.m. at West 8 Avenue / Hialeah Expressway heading Southbound toward the
hotels on Okeechobee.
Your Affiant located surveillance video corroborating the victim’s statement. On March
30, 2023 at 12:03 p.m., the white scion is depicted driving into “El Paraiso” hotel on March 30,
2023, at 12:03 p.m., the subject exits the vehicle, a white 2007 Toyota scion with dark tinted
windows bearing FL tag KNRZ63. The subject is depicted entering the lobby, paying for the room
with cash and receiving a complimentary bubble bath from the attendant. The victim stayed in the

car as the subject filled out the “paperwork” and she was not visible on surveillance video due to
dark tinted windows on the vehicle.
On May 19, 2023, Your Affiant responded to “El Praiso” hotel, obtained a copy of the
surveillance video, the subject’s room registration, #246, which provided a scan of the subject’s
driver’s license, and his payment receipt.
On May 19, 2023, Your Affiant obtained a consent to search from the hotel, conducted a
walk through of room #246, and had crime scene document photographs. The victim’s description
of the room was corroborated.
The victim described the hotel room: parking garage, two levels, bar, dancing pole, jacuzzi,
mirrored ceiling. The victim said the subject bought bubble bath for the jacuzzi in the room. They
both got naked and “talked for a while” and “kissed.” The victim said they never discussed her age
while they were at the hotel.
The victim said once they exited the jacuzzi, “it happened” explaining they engaged in
sexual activity, penile/vaginal sex where the subject penetrated her vagina with his penis. The
victim also said they performed oral sex on each other. The victim said the subject wore a condom
and ejaculated outside the condom which he later discarded in the trash. The victim estimated they
were at the hotel for about three hours because that was the hotel limit.
The victim said the subject took one picture of them naked on the bed. The subject took
the picture with his phone. Afterwards, he drove her home and dropped her off. On March 30,
2023, at 2:42 p.m., the victim texted her friend, “With my future husband” who was inquiring as
to her whereabouts.
On March 30, 2023 at 3:16 p.m., The victim texted her friend “I just got home.” On March
30, 2023 at 3:43 p.m., the subject texted the victim, “I’m home” after dropping her off. A few
hours later, at 7:58 p.m., the victim texted the subject, “You lucky cuz I just got my period.”
The victim said that the subject stopped talking to her afterward. The victim explained she
tried talking to him “but it was not the same” and at one point she told him she was pregnant
because she missed her period. She described he got mad and told her “I did not come inside of
you.” She said, “it got dark and it did not go well after that.” The text message conversation about
being pregnant was the one Miami Gardens Police found on her phone. She expressed that after
that text exchange she blocked the subject.

On or about May 19, 2023, T-Mobile responded to a legal subpoena for phone number
which provided the subject’s subscriber information and call logs:

On or about May 11, 2023, Your Affiant reviewed the victim’s digital forensic phone
extraction and located Tinder “dating” photographs which depict the subject posing in “selfies” at
the gym, home, or police uniform. The following information was below his photographs: “Jay”
“28” “Lives in Hollywood” “4 Miles away” “Virgo” “Gym” and a Cuban flag. Your Affiant also
located text messages between the victim and subject which corroborated the sexual relationship:
On April 3, 2023, the subject wrote, “Right after we had sex I started my work week that
same day. Literally it was my Monday and I’ve worked the past 4 days while you’ve had
your period and been going around places”
On April 3, 2023, the subject wrote, “I haven’t called you in a while even before we had
sex”
On April 12, 2023, the victim wrote, “I’m pregnant.”
On April 12, 2023, the subject responded, “You had your period after we had sex”
On April 12, 2023, the victim responded, “For 2 days.”
On April 12, 2023, the subject wrote, “II didn’t come inside of you.”
On April 12, 2023, the subject wrote, “2 I don’t have fertile sperm because I’m in
shots.”
On April 12, 2023, the subject wrote, “It’s not even possible for me to get you pregnant.
It’s way too soon.”
On May 23, 2023, Your Affiant interviewed Ms. Alexandra Roman, DOB: 12/20/1994, the
subject’s fiance who agreed to provide a sworn recorded statement. Ms. Roman said she has been
dating the subject for 10 years and she is engaged to be married. Ms. Roman said she has never
rented a room in Hialeah nor has she rented a room with the subject in the Hialeah Okeechobee
area. Ms. Roman said on March 30, 2023, she must’ve been at work during the time of the incident.
Ms. Roman said even though the vehicle is registered to her sister, the white scion is exclusively
driven by the subject or herself. Ms. Roman corroborated that the subject takes
shots. Ms. Roman said she resides with the subject in Hollywood, FL which is Broward County.
On May 25, 2023, Your Affiant interviewed the victim and she provided the same
statement. The victim added that she was not forced, threatened, or coerced into having sexual

intercourse with the subject. The victim said she never disclosed she was 17. The victim said she
received a call on Tuesday, May 23, 2023 from a blocked number. The victim answered and it was
the subject who asked her if she lied about her age, he told her he was in trouble, and he was going
to lose his job. The victim said the subject did not ask her to become uncooperative with law
enforcement, he did not threaten her or say anything of the sort. The victim hung up on him.
On May 31, 2023, Your Affiant conferred with Special Agent Medina from Homeland
Security Investigations who confirmed travel records from Cuba matched the victim’s name and
date of birth. Confirming that on March 30, 2023, the victim would have been a 17-year-old minor.

Due to the facts provided Your Affiant believes The Subject resides in Broward County.

Based upon the above information, your Affiant believes there is probable cause to arrest
“The Subject”, Jose Robell Hernandez, a W/M, born on also known as “Yey
Hernandez” or “Jay Hernandez” for UNLAWFUL SEXUAL ACTIVITY WITH SPECIFIED
MINORS F.S.S. 794.05 and CONTRIBUTING TO THE DELINQUENCY OF A MINOR F.S.S.
