Dealer Connection: Fall 2019 October 28, 2019

The South Carolina Department of Motor Vehicles continues to work towards


implementing traceable temporary license plates that go into effect on Monday,
November 11, 2019.

In this issue, you'll find a robust update on this process, information on Electronic
Vehicle Registration (EVR) participant errors, details regarding a NHTSA ruling, and
an introduction to the new Director of Vehicle Services.

45-Day Traceable Temporary License Plates


While Governor McMaster signed the bill into law in May 2018, it became effective
May 2019 and included a 180-day implementation period.

Vehicles sold on and after 12:01 a.m. on Monday, November 11, 2019 that require a
45-day temporary license plate must display a traceable temporary license plate.

Some dealerships may have already started issuing the traceable temporary license
plate.

Every 45-day temporary license plate issued on and after November 11, 2019 must
be a traceable temporary license plate and printed through an EVR provider (more
information below) or at the SCDMV. Any previous 45-day non-traceable
temporary license plate will not be valid and cannot be on any South Carolina
vehicle with a registration date of December 25, 2019 or after.

Traceable temporary license plates will not be available for purchase at SCDMV
branch offices until Tuesday, November 12, 2019 at 8:30 a.m. All SCDMV offices
are closed Monday, November 11, 2019 due to the Veterans Day holiday.

You'll see an example of the new traceable temporary license plate and temporary
registration card above.

The top portion of the plate contains the


customer's new temporary registration

plate that the dealer or customer will
secure to the newly purchased vehicle.
Customers must keep the registration
portion in their newly purchased
vehicle until their metal plate and
permanent registration card arrives in
the mail.

The traceable temporary license plate is underneath the temporary registration card.
The plate is printed on reinforced, Teslin paper that is water resistant. There are four
holes - two at the bottom, and two at the top - for dealers or customers to secure the
plate onto their vehicle's license plate well. Dealers are strongly encouraged to
secure the traceable temporary license plate to a vehicle using all four holes.
By law, the top 50% of the plate is designated for dealer or company identification. In
the example above, you'll see the SCDMV's logo in this space.

Underneath the logo, you'll see an alphanumeric sequence. This sequence changes
every time a vehicle is purchased in South Carolina. The numerals correspond to the
date the traceable temporary license plate expires. The alpha sequence is issued by
the SCDMV. The numbers on November 12 will be 1226 to show an expiration date
of December 26, 2019. In the example above, this traceable temporary license plate
expires on November 8, 2019.

EVR Providers
To issue a traceable temporary license plate, dealers must enroll in the South
Carolina EVR program and contract with an EVR service provider. There are
currently three approved EVR providers: CVR, DDI, and TitleTec.

The total enrollment time is 2-4 weeks. This includes enrolling with the SCDMV,
signing up with a provider, configuring your system, and completing any required
training. Do not wait until the last minute to enroll. If you have questions about the

Once a dealer has started the EVR transaction to issue a traceable temporary


license plate, the dealer must finalize the transaction in the EVR system. Dealers are
highly encouraged to submit titling information in the EVR system and mail the
packet to the address below as soon as possible. For those who have been using
the EVR process, this is not a process change. This is simply included as a
reminder.

Once a dealer starts an EVR transaction, you will not be able to walk into an
SCDMV branch to complete the transaction since there will already be a pending
title in the system. The SCDMV cannot override the pending title, and the
SCDMV cannot issue you a traceable temporary license plate.

Dealers will, however, still be able to walk into the SCDMV with the proper
paperwork if they have not started the EVR process or cannot process a transaction
via EVR. If visiting an SCDMV branch, the dealer must bring the completed
Application for a Temporary License Plate (SCDMV Form 45-A), signed by the
buyer, to complete the transaction. This form is available at scdmvonline.com.
The buyer also has the option of following these steps if desired.

The bill of sale must be presented to affirm the purchase date of the vehicle. The
dealer has the option to either obtain a traceable temporary license plate or metal
plate at the SCDMV. The dealer should immediately deliver either license plate and
all corresponding paperwork to the vehicle's buyer so he or she can legally drive the
newly purchased vehicle away from the dealership. If the dealer chooses to leave
the SCDMV branch with a traceable temporary license plate and not a metal plate,
the dealer or the vehicle's new owner is required to submit all the required
documentation and remit the appropriate fees to complete the titling and registration
prior to the expiration date of the traceable temporary license plate.

Traceable Temporary License Plates for CMVs


Dealers may issue 45-day traceable temporary license plates for the power unit,
trailer, or other commercial motor vehicles (CMV).

The 45-day traceable temporary license plate allows the driver to haul, within the
state, cargo and passengers or conduct commerce while an intrastate CMV is
being permanently titled and registered. The temporary registration card must
include the gross vehicle weight (GVW) and may have the USDOT number.

As a reminder, the GVW declared on the temporary registration card must reflect
what the customer intends to register the vehicle at for hauling purposes.

Transferring a License Plate


If a buyer is transferring a license plate from an existing vehicle to a newly
purchased vehicle, the dealer will issue a traceable temporary license plate only if
the customer does not have the metal plate he or she is transferring at the time of
the sale.

If the customer does have the existing metal plate he or she is transferring, the
dealer should submit the registration information of the newly purchased
vehicle through the EVR system to alert law enforcement of the plate transfer. The
customer must maintain all of the following in the newly purchased vehicle:
Bill of sale,
Proof of insurance, and
Existing registration card for the vehicle from which the plate was transferred.

At no time should a customer have both a 45-day traceable temporary license


plate and the transferred metal plate displayed on a vehicle at the same time.

Stolen Traceable Temporary License Plate


It is the responsibility of the issuing dealer to replace traceable temporary license
plates that vehicle buyers have reported as stolen.

Customers must present a police report and complete the Application to Issue or
Replace a 45-Day Temporary Plate (SCDMV Form 45-A) in order to receive a new
traceable temporary license plate. Dealers are required to make a copy of the police
report and keep it on file for auditing purposes.

A customer who receives a traceable temporary license plate from a dealer cannot
replace that plate at an SCDMV branch.

Lost Traceable Temporary License Plate


It is the responsibility of the issuing dealer to replace traceable temporary license
plates that vehicle buyers have reported as lost.

The customer must complete the Application to Issue or Replace a 45-Day


Temporary Plate (SCDMV Form 45-A) and submit it to the issuing dealer. The
issuing dealer must keep the form on file. A customer who receives a traceable
temporary license plate from a dealer cannot replace that plate at an SCDMV
branch.

30-Day Out-of-State Temporary Tags


There are no changes to the use and requirements for this temporary tag. Dealers
should continue to use this product for out-of-state registrations.

EVR Participant Errors


The SCDMV has seen an increase in errors on documentation that it receives from
dealers completing EVR transactions. The agency asks that you submit your EVR
transaction to the SCDMV in an error-free manor. Error-free paperwork facilitates the
title release and reduces potential issues caused by errors.

The agency notices issues with dealers failing to submit a correct bundle report or, in
some cases, no bundle report at all. Even more common, the agency notices
dealers do not provide the correct title number or odometer reading. Please take an
extra minute to ensure your submissions are error-free.

NHTSA Odometer Exemption Ruling


The National Highway Traffic Safety Administration (NHTSA) issued a final rule this
fall on odometer disclosure requirements.

Beginning January 1, 2020, vehicles that would have become eligible for exemption
from odometer disclosure at ten years old will now not be eligible for exemption
until the vehicle is at least 20 years old. Model year 2009 vehicles and older remain
eligible for exemption even with this new rule.

Vehicles of model year 2010 or newer must now continue to report the odometer
reading for an additional ten years on the way to a 20-year odometer disclosure
requirement for all vehicles.

Model year 2010 vehicles will not become eligible for exemption from odometer
disclosure until January 1, 2030. Model year 2011 vehicles will not become eligible
for exemption from odometer disclosure until January 1, 2031. Model year 2012
vehicles will not become eligible for exemption from odometer disclosure until
January 1, 2032, and so on.

The SCDMV is working on adjusting policies, procedures, business processes, and


forms as needed in preparation for full implementation of this change. Again, there
have been no changes to vehicles of model year 2009 or older. These vehicles
became eligible for exemption on January 1, 2019 and remain eligible for exemption
from odometer disclosure.
