COMPLAINT FOR DAMAGES AND INJUNCTIVE RELIEF
Plaintiff Simply Mossy Art Inc. (“Mossify”) brings this Complaint against Defendants,
the individuals, partnerships, entities, and unincorporated associations set forth on Schedule “A”
hereto (collectively “Defendants”), who are promoting, selling, offering for sale, and/or
distributing goods infringing on and, confusingly similar imitations of, Mossify’s products and
intellectual property within this Judicial District through Amazon.com, Walmart.com, Etsy.com,
and others using the seller identities as set forth on Schedule “A” hereto (the “Seller IDs”). In
support of its claims, Mossify alleges as follows:
NATURE OF THE CLAIM
1. Mossify brings this action for patent infringement pursuant to 35 U.S.C. § 271.
THE PARTIES
2. Mossify is a federal corporation organized under the laws of the Dominion of
Canada. Mossify is in Markham, Ontario, Canada.

3. Defendants are individuals and/or business entities of unknown makeup, each of
whom, upon information and belief, is organized, resides, and/or operates in foreign jurisdictions
set forth in Schedule A, redistributes products from the same or similar sources in those
locations, and/or ships their goods from the same or similar sources in those locations to shipping
and fulfillment centers within the United States, including several fulfillment centers within this
Judicial District, to redistribute their products from those locations.
4. On information and belief, none of Defendants is registered or licensed to do
business in any jurisdiction in the United States, and has no agent authorized by appointment or
by law to receive service of process.
JURISDICTION AND VENUE
5. This is an action for patent infringement under 35 U.S.C. § 271, and injunctive
relief and damages under 35 U.S.C. §¶ 281-285.
6. This Court has jurisdiction over the subject matter of this action pursuant 28
U.S.C. §§ 1331 and 1338.
7. Defendants are subject to personal jurisdiction in this district because they
purposefully direct their activities toward and conduct business with consumers throughout the
United States, including within the state of New York and this Judicial District, and are operating
under Defendants’ Seller IDs, through one or more online stores, including on at least

https://www.aliexpress.com (“Aliexpress.com”) and https://www.Etsy.com (“Etsy.com”)
(collectively the “Platforms”) that are accessible in New York.

8. Defendants are subject to personal jurisdiction in this district because their illegal
activities directed towards the State of New York cause Mossify injury in New York, and
Mossify’s claims arise out of those activities.
9. NY CPLR § 302, New York’s long arm statute, permits this Court to exercise
personal jurisdiction over defendants because they conducted business through the Platforms on
the internet intentionally targeting New York consumers.
10. Alternatively, Defendants are subject to personal jurisdiction in this district
pursuant to Federal Rule of Civil Procedure 4(k)(2) because (i) Defendants are not subject to
jurisdiction in any state’s court of general jurisdiction; and (ii) exercising jurisdiction is
consistent with the United States Constitution and laws.
11. Venue is proper pursuant to 28 U.S.C. § 1391, including subsection (b)(3) and
(c)(3) because Defendants are, upon information and belief, not residents in the United States
and therefore there is no district in which an action may otherwise be brought.
RELEVANT FACTS
A. MOSSIFY
12. Mossify designs, manufacturers, and sells a variety of plant-growing accessories
and products throughout North America—online through its own store at mossify.ca and through
over 1,300 garden centers. Mossify sells products in the United States through more than 1,000
garden centers, including through multiple locations in this District.
13. The founder of Mossify realized that there was a need for a new design for moss
poles—which are structures covered by moss, coir, or similar material, for support or training
plants to grow—that was adjustable and flexible to form into shapes other than straight.

14. The result was a novel design for a flexible moss pole which was recognized and
granted by the United States Patent and Trademark Office as U.S. Design Patent No. D989,355
(the “’355 Patent”), a copy of which is attached as Schedule B. Mossify is the owner by
assignment of all rights in and to the ’355 Patent.
15. Mossify’s itself offers for sale and sells flexible plant poles throughout the United
States under the trademark The Bendable Moss Pole™ and has done so continuously since at
least June 2020.
16. The consuming public associates The Bendable Moss Pole™ and the design of
the ’355 Patent with Mossify.
B. DEFENDANTS
17. Defendants are competitors of Mossify and make, use, sell, offer for sale, and/or
import in the United States, including in this District, flexible plant poles based upon and
utilizing the design of the ’355 Patent.
18. Many Defendants are also utilizing Mossify’s The Bendable Moss Pole™ mark in
connection with their own respective products.
19. On information and belief, Defendants did not have any flexible plant pole
products or designs prior to Mossify introducing The Bendable Moss Pole™ and copied
Mossify’s The Bendable Moss Pole™ design to infringe on Mossify’s rights and confuse
consumers.
20. Mossify has lost, and will continue to lose, sales of its products to Defendants as a
result of Defendants’ activities.

FIRST COUNT
(Patent Infringement)
21. Mossify incorporates the preceding paragraphs as though fully set forth herein.
22. The ’355 Patent shows and claims an ornamental design for a bendable moss pole
assembly, and includes the following Figures:

23. Each of Defendants is each making, using, selling, offering for sale, and/or
importing into the United States, one or more bendable plant pole assemblies such that an
ordinary observer familiar with the prior art designs would be deceived into believing are the
same as the patented design of the ’355 Patent (collectively, “the Accused Products”).
24. The Accused Products are identified as part of Schedule A, and representative
images of Defendants Accused Products are set forth in Schedule C.
25. Upon information and belief, by its infringing acts, each Defendant has made and
will continue to make substantial profits and gains to which it is not entitled in law or equity.
26. Upon information and belief, each Defendant intends to continue its infringing
acts unless restrained by this Court.
27. Defendants’ respective conduct has damaged and will continue to damage
Mossify, Mossify is suffering irreparable harm, Mossify has no adequate remedy at law, the

balance of hardships between the parties warrants a remedy in equity; and the public interest
would not be disserved by an injunction.
SECOND CLAIM
(False Advertising or Promotion, 15 U.S.C. § 1125(a))
28. Mossify incorporates the preceding paragraphs as though fully set forth herein.
29. Defendants are advertising and offering the Accused Products utilizing (i)
Mossify’s The Bendable Moss Pole™ mark and/or (ii) images confusingly similar to those used
by Mossify that are likely to cause confusion, or to cause mistake, or to deceive as to the
affiliation, connection, or association of such person with another person, or as to the origin,
sponsorship, or approval of his or her goods, services, or commercial activities by Mossify.
30. In addition, at least Defendant 17 (DUSPRO) is further confusing, misleading, or
deceiving consumers by representing that they were the inventor of, or the first person to offer,
flexible moss poles in the United States:1

31. Defendants’ respective product statements, advertising, and offerings are and
were (i) made in connection with commercial advertising and promotion, (ii) material, and (iii)
made in interstate commerce.
32. These statements are and were commercial speech for the purpose of influencing
consumers to buy Defendants’ goods or services, and made as part of a classic advertising
campaign or otherwise disseminated sufficiently to the relevant purchasing public.
33. These statements are literally false or imply a falsehood that is likely to mislead or
confuse consumers.
34. Upon information and belief, Defendants’ false advertising and promotion is
willful and intentional. Therefore, this case constitutes an exceptional case under 15 U.S.C.
§ 1117(a).

35. Upon information and belief, by its acts, Defendants have made and will continue
to make substantial profits and gains to which each is not entitled in law or equity.
36. Upon information and belief, Defendants intend to continue their wrongful acts,
unless restrained by this Court.
37. Defendants’ respective conduct has damaged and will continue to damage
Mossify; Mossify is suffering irreparable harm; Mossify has no adequate remedy at law; the
balance of hardships between the parties warrants a remedy in equity; and the public interest
would not be disserved by an injunction.
PRAYER FOR RELIEF
WHEREFORE, Mossify respectfully requests that this Court:
A. enter an injunction ordering each Defendant, its agents, servants, employees, and all other
persons in privity or acting in concert with them be enjoined and restrained from:
1. engaging in any course of conduct likely to cause confusion, deception, or
mistake, or to injure Mossify’s business reputation or weaken the distinctive
quality of The Bendable Moss Pole™ mark;
2. falsely stating or representing that they invented flexible moss poles, were the
original or first to offer flexible moss poles in the United States, or have a patent
or patent pending in the United States;
3. further infringing The Bendable Moss Pole™ mark by marketing, advertising, or
promoting goods or services embodying The Bendable Moss Pole™ mark; and
4. making, using, selling, offering for sale, or importing to the United States any
product infringing the ’355 Patent design or colorable imitations thereof;

B. order an accounting by Defendants of all gains, profits and advantages derived from its
wrongful acts;
C. award Mossify all of Defendants’ respective profits and all damages sustained by
Mossify as a result of each Defendant’s wrongful acts and such other compensatory
damages as the Court determines to be fair and appropriate pursuant to the Lanham Act
and patent laws;
D. award Mossify its costs of this action, together with reasonable attorneys and
investigators’ fees and pre-judgment interest in accordance with the Lanham Act and
patent laws;
E. award Mossify damages in an amount to be determined at trial, together with pre-
judgment and post-judgment interest thereon; and
F. award such other and further relief as the Court deems just and equitable.

THE INDIVIDUALS, PARTNERSHIPS, AND

COMPLAINT FOR DAMAGES AND INJUNCTIVE RELIEF

NATURE OF THE CLAIM

2. Mossify is a federal corporation organized under the laws of the Dominion of

Canada. Mossify is in Markham, Ontario, Canada.

3. Defendants are individuals and/or business entities of unknown makeup, each of

Judicial District, to redistribute their products from those locations.

4. On information and belief, none of Defendants is registered or licensed to do

quality of The Bendable Moss Pole™ mark;

or patent pending in the United States;

3. further infringing The Bendable Moss Pole™ mark by marketing, advertising, or

product infringing the ’355 Patent design or colorable imitations thereof;

and patent laws;

E. award Mossify damages in an amount to be determined at trial, together with pre-

judgment and post-judgment interest thereon; and
