What is BARMM?
The establishment of Bangsamoro was the
culmination of several years of peace talks
between the Philippine government and
several autonomist groups; in particular the
Moro Islamic Liberation Front (MILF), which
rejected the validity of the ARMM and called
for the creation of a region with more powers
devolved from the national government.

The Bangsamoro took the place of the ARMM as


the only Muslim-majority autonomous region in
the Philippines. Currently in transition until 2025.

REPUBLICT ACT 11054 (BOL)

BARMM was established in view of the ratification of


Republic Act No. 11054, referred to as the Bangsamoro
Organic Law (BOL), to serve as a basic law for the region
which was signed into law by President Rodrigo R.
Duterte on July 26, 2018 adopting a parliamentary
system in an area of a country with a presidential
system of government, via a two-part legally-binding
plebiscite in Western Mindanao.

scrutinize and deliberate in detail
and line by line the legislative proposal.

POPULAR STAND AGAINST THE MAJORITY OF
PARLIAMENT (BECAUSE THEY WOULD BE SIMPLY
REMOVED THROUGH A NO-CONFIDENCE VOTE IF
THEY WERE TO LOSE THE SUPPORT OF THEIR PARTY).
KEY DIFFERENCES BETWEEN PARLIAMENTARY AND
PRESIDENTIAL FORMS OF GOVERNMENT
• THE PARLIAMENTARY SYSTEM OF GOVERNMENT IS WHERE THE LEGISLATIVE AND EXECUTIVE BRANCH WORK COOPERATIVELY. THE JUDICIAL BRANCH
WORKS INDEPENDENTLY. IN A PRESIDENTIAL GOVERNMENT, THE THREE BRANCHES OF THE GOVERNMENT WORK INDEPENDENTLY.
• IN A PARLIAMENTARY FORM OF GOVERNMENT, THE EXECUTIVE IS DIVIDED INTO TWO PARTS, I.E. THE HEAD OF THE STATE (PRESIDENT) AND THE HEAD
OF THE GOVERNMENT (PRIME MINISTER). THE PRESIDENT IS THE CHIEF EXECUTIVE OF THE PRESIDENTIAL GOVERNMENT.
• IN THE PARLIAMENTARY FORM OF GOVERNMENT, THE EXECUTIVE BODY, I.E. THE COUNCIL OF MINISTERS IS ACCOUNTABLE TO PARLIAMENT FOR ITS
ACTS. THE EXECUTIVE IS NOT ACCOUNTABLE IN A PRESIDENTIAL GOVERNMENT.
• A COMBINATION OF POWERS IS KEY TO A PARLIAMENTARY SYSTEM. THE POWERS ARE DIVIDED IN A PRESIDENTIAL SYSTEM.
• IN PARLIAMENTARY FORM, MINISTERS ARE APPOINTED FROM THE EXECUTIVE BODY. IN PRESIDENTIAL FORM, ONE DOES NOT NEED TO BE A MEMBER.
• IN PARLIAMENTARY GOVERNMENT, THE PRIME MINISTER HAS THE POWER TO DISSOLVE THE LOWER HOUSE BEFORE THE COMPLETION OF ITS TERM.
THE PRESIDENT CANNOT DISSOLVE THE LOWER HOUSE. THE MEMBERS WILL SERVE THEIR TERM.
• THE TERM OF THE EXECUTIVE IS NOT SET IN A PARLIAMENTARY GOVERNMENT. IF A NO-CONFIDENCE MOTION IS PASSED, THE COUNCIL OF MINISTERS
IS REMOVED. IN A PRESIDENTIAL GOVERNMENT, THE EXECUTIVE HAS A SET TERM.

the BARMM
government today
AND How they
respond to those
challenges
The beginning of the bangsamoro armed struggle
for self determination

An Overview:
The armed struggle of bangsamoro for self determination started way back in the marcos regime and
fiercely fought back the AFP when marcos declared PD 1081 the suspension of the writ of habeas
corpus otherwise known as declaration of martial law in the entire nation. The bloody event where
everyone can be detained without warrant and even salvaged/killed the person without due process of
law. Many bangsamoro and non bangsamoro alike have died. Men young and old, women were killed
and raped and children alike burnt houses, farms and mosques among others.

Until 1976, when the tripoli peace agreement was signed between MNLF,GRP and OIC (organization
of islamic conference) mediated the agreement. However, this bogged down and the fighting between
bangsamoro and GRP sparked again in the marcos regime.
In 1986, Jeddah Peace Accord of MNLF-GRP was established in Cory
Administration and failed again.
In 1996 finally made a Peace Agreement (GRP-MNLF Final Agreement in
Jakarta, Indonesia.) It happened and the rest is HISTORY.

The Pres. Duterte Legacy (The BARMM Government)


Pres. Duterte made a separate agreement with MILF instead of the mainstream
MNLF. During his term the continuation of Bangsamoro peace process was
awarded to MILF thus BARMM was created and CHALLENGES were
addressed and BOL was formulated. Duterte emphasized and advised the
BARMM leaders to do it now for there is no more tomorrow for the
Bangsamoro, quote and unquote.” Meaning Do the BOL during his tenure.
There were lots of challenges encountered during this bangsamoro transition period.
Among them were on Political issues, military issues, economic issues as well as
religious issues.

Bangsamoro Transition Authority (BTA) legislative body formulates laws. Of course we


are one nation thus they only formulate laws suitable and applicable in BARMM
constituents.

The penal code of the Philippines remains in effect as well as labor code applies to the
Bangsamoro Autonomous Region in Muslim Mindanao (BARMM). However,
amendments were made only suitable for the BARMM autonomous region in nature
and still adapt the national laws.
BARMM don’t have any separate military or police power, signed in a peace agreement
process. That is why the existence of security is always integrated on Philippine
National Police (PNP) and Armed Forces of the Philippines (AFP) and not as separate
bangsamoro military power.

The parliamentary form of government is much encourage in BARMM. Its economic


growth indicates that many investors come to BARMM and invest more to help its
constituents.

The exploration Liguasan Marsh natural gas in Buluan, Maguindanao, the exploration
of gold deposit in Daguma Range among others. These explorations of natural gas and
gold deposit is definitely sustainable for the entire BARMM and even a big contribution
to the national government.
The judiciary of the national government encourage sharia court to
handle cases in muslim communities. However, case between non
muslim and muslim usually handled by the national court authority.

Nonetheless, the making of BARMM thru the inspiration of BOL marks


the bangsamoro struggle for self determination.

It may not be the beginning nor the end but perhaps the end of
beginning and BARMM IS CONTINUOUS PROCESS.
