    AFFIDAVIT OF ADVERSE CLAIM

    I, RESTITUTO C. ROSALES, of legal age, Filipino, married, and a resident


    of Brgy. 89, San Jose, Tacloban City, Philippines, after having been sworn to
    in accordance with law, depose and say:

    1. That on June 4, 2018, I entered into a Deed of Conditional Sale for the


    amount of FIFTEEN MILLION PESOS(Php 15,000,000.00)with Oscar S.
    Lapidario for the purchase of a property known as the Bacsal Island
    situated at Brgy. Iquisan, Daram, Samar which is denominated as Lot
    2558, Pls 1067-D-Case 2 with an area of 487,654 square meters which
    he acquired through inheritance as the sole heir of the late Justina S.
    Lapidario.

    2. That which document is more particularly identified as Document No.


    225, Page No. 48, Book No. 1, Series of 2018 in the
    Notarial Register of Notary Public Eric T. De Veyra and a copy of which
    is attached herein.

    3. That I have already made advance payments amounting to ONE


    MILLION FIVE HUNDRED THOUSAND PESOS;

    4. However, it has come to my knowledge that the said property was sold


    by Oscar Lapidario to another party despite the fact that he has
    already entered a Deed of Conditional Sale thereon to me as buyer.

    5. That unless an adverse claim is annotated on the aforedescribed


    Transfer Certificate of Title/Tax Declaration, I am in danger of being
    defrauded and deprived of my just and valid right over the afore-
    described parcel of land and, as such, I am executing this Affidavit in
    support of my request for the annotation of an adverse claim over the
    parcel of land described herein.

    FURTHER AFFIANT SAYETH NAUGHT.

    IN WITNESS WHEREOF, I have hereunto set my hand this
