On 9/29/23 l responded to 700 Davega Dr room . i n reference to an assault.

On scene I met with the reporting party, Cindy Robbins who is the Executive Director, outside who told me that two
of her Med Techs, Victoria Lucas and Shaquadra Herring, had witnessed an assault by Roxanne Wilson on her
mother Martha Dusenbury. Cindy told me that she then contacted, Jennifer Raymond, who is the Director of
Residential Services and let her know what was going on.

I then went a spoke to Lucas and Herring in the nurse's break room. Herring stated that they tried giving Martha her
medicine this morning but she would not take it so when Roxanne arrived they notified her that Martha did not take
her medicine. Herring stated that they tried again to give Martha her medicine when Roxanne arrived but she kept
spitting it out. Herring said thafs when Roxanne got the medicine and Martha kept stating she did not want to take
it. Roxanne then told Martha "Your going to take this damn medicine" and forced it into her mouth with a fork.
Lucas said that's when Roxanne then began forcing water into Marthas mouth until she was choking. Herring said at
that point Roxanne then turned around and stated "See there she took it."

I then went and attempted to speak to Martha but I was told that Martha has dementia. I asked Martha if any of this
was true to which she stated no.

I then spoke to Roxanne and informed her as to why deputies there. I informed Roxanne that there was an alleged
assault to where she forcible put medicine and water into her mothers mouth. Roxanne stated that she never did such
thing and stated "I aint going there" I then advised Roxanne that the facility wanted her placed on trespass after the
alleged assault. Roxanne stated that she wasn't going to play this game and continued making several phone calls
and that she would stay in the facility until the caregiver arrived .

I then stepped away to contact Sgt. Ricciardi who arrived on scene.

Deputies asked about any camera footage but was told that there is no camera footage inside the room.

Roxanne ultimately left the facility without incident .

On September 29th, 2023, Deputy W. Aiken and I responded to the Columbia Presbyterian Community located at 700
DaVega DR in the Lexington area of Lexington County in reference to an allegation of elder abuse. Cindy Robbins,
the Executive Director/Administrator, called Lexington County Communications Center to report that a resident,
Martha R. Dusenbury, was being abused by her daughter.

Upon arrival, Deputy Aiken and I met with Jennifer Raymond (Director of Residential Services) and Cindy Robbins
{Executive Director/Administrator). Robbins initially informed us that two medical technicians witnessed Roxanne
Wilson use a fork to force medication down Ma11ha Dusenbury's throat and then "gagged" Dusenbury with water.
Cindy informed us that Dusenbury was a resident at the facility and individual that forced the medication on the
resident was Dusenbury's daughter, Roxanne Wilson. Robbins advised that she was mandated to report the abuse and
that the facility wished to place a trespass notice on Wilson for the property of the facility. Robbins stated that the
incident was reported to her around 1230hrs.

Robbins led us inside the facility and introduced me and Deputy Aiken to the two medical technicians that witnessed
the incident, Shaquadra Herring and Victoria Lucas. Herring stated that she and Lucas tried to give Dusenbury her
medication earlier in the morning, but she would not take it. Herring stated that Wilson took the medication and
"shoved it into her [Dusenbury's) mouth." Deputy Aiken asked Herring, "How did she get it into her mouth?" Herring
replied stating, "She used a fork." Lucas replied to Deputy Aiken's question stating that Wilson, "used a fork, then
took the water and tipped the water up until she was pretty much gagging." Lucas stated that Wilson was "screaming
and cursing" at Dusenbury during the incident.

Robbins and Raymond then led me and Deputy Aiken to room - where we met Dusenbury and Wilson. I spoke to
Wilson right outside her mother's room. I informed her of the allegations and Wilson stated that her mother refused to
take her medicine. Wilson then walked away and told me to "call Jay." Wilson then proceeded call Sheriff Koon.
Wilson appeared to agitated by the allegations and she stated multiple times that she was going to take legal action
against the facility. I informed Wilson that the facility wanted to issue her a no trespass notice for the property of the
retirement community.

At one point in the investigation, Raymond and Wilson, were both speaking in the hallway in front o- Raymond
had her back against the wall and Wilson approached her, stood directly in front of her placing both hands on her
(Raymond's) shoulders and stated something I could not hear. I did hear the end of Wilson's sentence where she
stated, "not to fuck with me." After observing this interaction, I do not believe that Wilson had any intent to assault
Raymond. When Wilson grabbed Raymond's shoulders, it appeared non aggressive. Raymond ultimately advised that
she wanted to prosecute Wilson for assault after this altercation, however, I do not believe that there was probable

I arrived on scene and was breifed by Deputy Aiken about the situation. l informed Roxanne that we would document
the incident as reported.

One of the staff members, Jennifer, approached me and told me that Roxanne had assaulted her. Jennifer said that
Roxanne stood in front of her, put her hands on her shoulders, shook her and said, "Im not mad at you but tell your
staff to stop fucking with me.''

I asked Roxanne about the incident and she admitted to doing it. I asked her if her intentions were to hurt Jennifer
and she replied no.

Deputy Smith was present when this incident happened and it was captured on his body worn camera(BWC).
reviewed the BWC footage of this incident and determined that the incident did not amount to an assault. In the video
I saw Roxanne place her hands on Jennifer's shoulder and make the comments mentioned above.

At the time of this report there was no probable cause to make an arrest. I explained to both parties that no charges
were being made.

On October 2, 2023, I was assigned this case for investigation.

I began reviewing body camera footage, which showed Deputies arrived at the reported incident location on September
29, 2023, where they \Vere informed the incident occurred around 1230 hours, but it wasn't reported to Lexington
County Communications Center until approximately 1357 hours. It appears the call for assistance from law
enforcement was delayed approximately 1 hour and 25 minutes. It took deputies approximately 19 additional minutes
to respond to the scene, after being dispatched. The call card noted the following text: "the Residents daughters is
abusing the resident" and "Resident was choked," implying that it was an active event.

Body-worn camera footage indicated two witnesses, Mrs. Herring and Mrs. Lucas, provided a verbal statement to the
responding Deputies (please refer to their supplements).

Mrs. Herring and Mrs. Lucas informed Deputies the incident began when they told Mrs. Wilson her mother did not
take her medication that morning. Mrs. Herring told the responding Deputies she then retrieved the medication, upon
Mrs. Wilson's request. Mrs. Lucas said she then attempted to administer the medication to Mrs. Dusenbury, and after
more failed attempts, Mrs. Wilson took the medication from her hand. Based on Mrs. Herring's visual demonstration
and Mrs. Lucas's description of the event, "She takes the fork and like puts it in her mouth." It was described that a
fork was used to transfer Mrs. Dusenbury's medication to her mouth because staff had previously tried to get Mrs.
Dusenbury to take the medication, and she spit it back into the cup.

The staff described multiple attempts to get Mrs. Dusenbury to take the medication, which included them placing the
medication in Mrs. Dusenbury's mouth, and attempting to give her water to swallow it. They said Mrs. Dusenbury
then spit the medication into a cup. As a result of the attempt to administer the medication, it was described as being
wet. Mrs. Wilson was then described as using a fork to transfer the wet medication back into her mother's mouth. The
way Mrs. Wilson was described using the fork does not appear to be unusual, extreme, or negligent in nature, as the
fork was simply used to re-administer the medication because it was wet.

Mrs. Wilson was then described giving Mrs. Dusenbury more water to swallow the medication, after transferring the
medication into her mouth with the aforementioned fork. The witnesses said Mrs. Dusenbury gagged on the water
Mrs. Wilson administered to her, but they said Mrs. Dusenbury swallowed the water and the medication, without
further incident. Even as described by the start: the actions described don't appear excessive from a reasonable
perspective. The facility alleged Mrs. Wilson of abuse for accomplishing what they had just been attempting to
accomplish for themselves, with the only notable difference that Mrs. Wilson was more persistent, and was alleged to
have used harsher language while interacting with her mother.

The incident was discussed with the Eleventh Circuit Court Solicitor's Office, at which time we were advised that the
case was without prosecutorial merit; however, after reviewing body-worn camera data, reviewing the witnesses'
statements, and supplements, the case was presented to a Lexington County Magistrate Judge. After providing the
judge with all involved parties· statements regarding this incident, including what witnesses observed, and discussing
the situation at significant length, a warrant was not issued for Mrs. Wilson regarding the incident due to a lack of
probable cause that a crime had been committed.

On October 02,. 2023, I was assigned this case for investigation.

On October 03, 2023, l began reviewing responding Deputies' body-worn cameras from the incident day.

While reviewing the body-worn camera, 1 was provided with Attorney Billy Newsome's telephone number and was
informed he represented Jennifer Raymond.

At approximately l 030 hours, I attempted to make contact via telephone with Mr. Newsome. I did not receive an
answer but was able to leave my name and contact information on his voicemail.

At approximately 1136 hours, I missed a call from Mr. Newsome and returned his call at 1141 hours. During the
conversation, Mr. Newsome and I agreed to meet on October 05, 2023, at approximately 1000 hours, at Lexington
County Sheriffs Department.

On October 05, 2023, at approximately 0950 hours, Senior Investigator Sherban and I met with Mrs. Raymond and Mr.
Newsome in Interview Room 3.

Mrs. Raymond explained that on Friday, September 29, 2023, the facility had an incident involving a resident. Mrs.
Raymond stated during the incident, Mrs. Wilson grabbed her by the shoulders. Mrs. Raymond advised that Mrs.
Wilson yelled at her," Jennifer, rm not mad at you, but tell your staff not to fuck with me." Mrs. Raymond stated she
was initially shocked, and she knew an officer was standing maybe twenty feet away from her. Mrs. Raymond advised
that she stated, "Roxanne you cannot threaten my staff". Mrs. Raymond stated that Mrs. Wilson replied, "Oh, that's no
threat" and dropped her hands off of her shoulders. Mrs. Raymond said she then leaned around her and asked the
officer," Did you just hear all of that?" Mrs. Raymond said he nodded his head, and then quietly said, "Yes." Mrs.
Raymond said she then walked off.

Mrs. Raymond said the supervising officer (Sergeant Ricciardi) then arrived, and was told what happened. Mrs.
Raymond said Sergeant Ricciardi asked if Mrs. Wilson put her hands on her, and she replied, "Yes." Mrs. Raymond
stated Sergeant Ricciardi then asked Deputy Smith, "Did you witness this?" She said Deputy Smith said, "Yes," and he
tapped his body-worn camera. Mrs. Raymond said she was then informed by Sergeant Ricciardi she could press
charges of assault and battery. Mrs. Raymond said Sergeant Ricciardi informed her of the charging process, but also
told her she did not have to decide at that moment.

Mrs. Raymond said she was then asked if she could wait until the CEO, Franklin Fant, arrived as she was informed yes.

Mrs. Raymond said when Franklin Fant arrived, they went inside of her office/ nursing station. Mrs. Raymond told
Mr. Fant about the incident, and they then contacted legal counsel by phone. While on the phone, Mrs. Raymond said
Mrs. Wilson entered the room, and said, "Are you claiming that l assaulted you? I did not assault you." Mrs. Raymond
told us that she took a step back, because Mrs. Wilson was in her face. Mrs. Raymond said she told Mrs. Wilson she
was not doing this with her. Mrs. Raymond said Mrs. Wilson then turned to Mr. Fant, and began speaking with him.
Mrs. Raymond stated as Mrs. Wilson entered the room, she had a cell phone on speaker and could hear someone telling
her to get out of there. Mrs. Raymond said Sergeant Ricciardi then entered the room, and instructed Mrs . Wilson to
leave. After Mrs. Wilson left the room, Mrs. Raymond said she wanted to move forward with charges. At this time,
she said Sergeant Ricciardi stopped to review the body camera footage of her earlier encounter with Mrs. Wilson.
After reviewing footage of the incident, Mrs. Raymond said Sgt. Ricciardi then informed her that the incident did not
meet the elements for an assault charge.

During our interview, Senior Detective Sherban read the South Carolina state statue regarding Assault and Battery 3rd
Degree. As Detective Sherban concluded the reading, he informed Mrs. Raymond that Sergeant Ricciardi did not have
probable cause to present that an assault occurred by Mrs. Wilson to Mrs. Raymond to a judge.

Mrs. Raymond expressed that during the incident, she felt that she wanted to get away because she had seen Mrs.
Wilson's temper, and it was unpredictable. Mrs. Raymond further advised that there were other occurrences, within the
past six months, of Mrs. Wilson and her sister yelling and barging into rooms. Mrs. Raymond said she was afraid of not
knowing what Mrs. Wilson was going to do.

I informed Mrs. Raymond that [ understood and agreed with Sergeant Ricciardi' s conclusion that there was not
probable cause for an arrest against Mrs. Wilson. However, I also understood due to her concerns, what she felt during
the incident, and wanting to move forward, I will present the following case to a judge.

While reviewing the body-worn camera, I observed Mrs. Raymond walking up as Deputy Smith and Mrs, Wilson were
standing in the hallway. The following conversation was as follows.

Mrs. Wilson: "Jennifer, I'm not mad at you. I'm just wondering why this was turned in."

Mrs. Raymond: "It's what the stuff we have to do". *Begins talking to a resident in the hallway.

Mrs. Raymond then stood adjacent to Deputy Smith's right side. During that time, Mrs. Wilson was standing to the
right of Deputy Smith. Mrs. Wilson then walked over and placed her hands on Mrs. Raymond's shoulders. Mrs. Wilson
stated. "Jennifer; rm not upset with you, but I want you to tell your buddy not to fuck with me." Mrs. Raymond
replied, 'Tm not going to tell anybody a threat, Roxanne." Mrs. Wilson stated, "That is not a threat". Mrs. Raymond
replied, "Yes, it is that is what you just did" as she looked over Mrs. Wilson's left shoulder asking Deputy Smith, "Did
you just hear that? 11 Deputy Smith replied, "Yes, ma' am."
Mrs. Wilson then became upset, expressing that her attorney would handle this on Monday and that her mother has
been at the facility for five years, with no reports. Mrs. Wilson then walks back into her mother's room with Deputy
Smith.

As Sergeant Ricciardi arrived on the scene, he engaged in a conversation with Mrs. Raymond and the CEO, Franklin
Fant of the facility. During the conversation, the three discussed possibly moving forward with pressing charges
against Mrs. Wilson on behalfof Mrs. Raymond advising she was assaulted by Mrs. Wilson. Sergeant Ricciardi
informed Mrs. Raymond that he would allow her to speak with the attorney before she made a decision. (This
conversation with Sergeant Ricciardi was held prior to Sergeant Ricciardi speaking with all involved parties, other
Deputies on the scene, and reviewing the body-worn camera from Deputy Smith.)

Shortly after, Sergeant Ricciardi makes contact with Mrs. Wilson. While informing Mrs. Wilson and her son via
telephone what was occurring at the moment, regarding possibly an assault charge, Mrs. Wilson walks av..,.ay. Sergeant
Ricciardi instructed Mrs. Wilson to come back as she continued to walk away. For approximately 5 seconds, Mrs.
Wilson is outside of the body-worn camera view. Sergeant Ricciardi then entered the room, and I could observe Mrs.
Raymond standing in an office to the right side of Mr. Fant, who was standing in the door frame of the office, as Mrs.
Wilson was standing to the left side of Mr. Fant.

Mrs. Wilson appears upset as she raises her voice stating that she did not assault anybody. After several attempts of
Sergeant Ricciardi asking Mrs. Wilson to depart from the room. Mrs. Wilson left the room.
Sergeant Ricciardi then made contact with Mrs. Raymond again. Mrs. Raymond then stated she would like to move
forward for pressing charges of assault. Sergeant Ricciardi then instructed Deputy Smith to provide his body-worn
camera to review the incident. After reviewing Deputy Smith's body-worn camera, Sergeant Ricciardi advised Mrs.
Raymond that he did not see probable cause to move forward with pressing charges for an assault as he explained to
her why.

The incident was discussed with the Eleventh Circuit Court Solicitor's Office, at which time we were advised that the
case was without prosecutorial merit; however, after reviewing body-worn camera data, reviewing the witnesses'

statements, and supplements, the case was presented to a Lexington County Magistrate Judge. After providing the
judge with all involved parties' statements regarding this incident, including what witnesses observed, and discussing
the situation at significant length, a warrant was not issued for Mrs. Wilson regarding the interaction with Mrs.
Raymond, due to the lack of probable cause that a crime occurred.
