Letter from the Executive Vice President & Executive Director of the Division of Minority &
Women’s Business Development

Minority and women-owned business enterprises (MWBEs) are the backbone of New York
State’s economy. Local MWBEs embody the “can-do” New York spirit and has made our State
a global leader for commerce and culture. The work represented in this report highlights New
York’s commitment to creating opportunities for communities that historically have been left
outside in the cold. I firmly believe that by investing in our MWBEs, we are investing in
ourselves and in our future.

The Division of Minority and Women’s Business Development (DMWBD) is here to provide
assistance for New York MWBEs. For 35 years, we have advocated to increase equity in
economic opportunities and achieve greater participation in New York State contracts for NYS
MWBEs. Through our certification and business development services, we provide businesses
with the tools to grow, succeed, and thrive in our vibrant economy. The DMWBD has also
worked in close partnership with State Agencies and Authorities to achieve the highest MWBE
utilization rate of any state in the country. Together, we have built a more vibrant and
dynamic MWBE community.

As we reflect back on 35 years of supporting MWBE excellence and embark on a new chapter,
we are encouraged by our past accomplishments and invigorated by the milestones we hit
this year:

New York Continues to Lead the Nation in MWBE Utilization. We are proud to report that
New York State not only met its nation-leading 30 percent MWBE utilization goal but boasts
a record breaking 32.30% MWBE utilization rate for FY 2022-23 – the highest MWBE
participation rate in the history of our State.

Elimination of the Certification Backlog. In her 2022 State of the State address, Governor
Kathy Hochul delivered a clear mandate supported with funding to achieve this goal: clear
the MWBE certification backlog. Earlier this year, DMWBD hit this critical milestone, meaning
the Division is operating without a backlog of unresolved certification applications for the first
time in decades This means our team can commit more time and resources to helping
certified NYS MWBE businesses and participate in state contracting opportunities.

Faster MWBE Certification Application Review. Thanks to the additional resources provided
by Governor Hochul, as well as internal improvements made to our review process, we’ve cut
the certification processing time to 90 to 120 days, slashing the wait time for businesses by
over 75 percent. The best part: we managed to do so while also expanding the quality of our
review process.

Rest assured, New York and the DMWBD is not planning to rest on our laurels. We’re gearing
up to do more. With bold new ideas in the pipeline and more improvements on the horizon,
the DMWBD looks forward to continuing to provide New Yorkers and MWBEs with
exceptional service, integrity, and innovative solutions.

We’re just getting started, and the best is yet to come.

The Division of Minority and Women’s Business Development

Executive Law Article 15-A (§§ 310-318) governs requirements for the participation of
minority and women-owned business enterprises (“MWBEs”) in New York State
contracting. The objective of Article 15-A is to promote equality of economic opportunities
for MWBEs and to eliminate barriers to their participation in state contracting.

The Division of Minority and Women’s Business Development (“DMWBD) oversees the
statewide MWBE program operated by “state agencies” (which includes, inter alia, state
agencies and public authorities) as defined by Article 15-A. The Division is charged with
three primary functions: (1) to encourage and assist state agencies that are engaged in
contracting activities to award a fair share of state contracts to MWBEs; (2) to review
applications by businesses seeking certification as a MWBE and to maintain a directory of
certified MWBEs; and (3) to promote the business development of MWBEs through
education and outreach to agencies and MWBEs.

FY 2022-23 MWBE Statistics


The mission of the DMWBD is to promote equality of economic opportunities for Minority
and Women-owned Business Enterprises (“MWBEs”) and to eliminate barriers to their
participation in state contracting. Each year, the DMWBD provides a report on program
progress and success which includes information on the annual New York State (NYS) MWBE
utilization, overall NYS MWBE expenditure, and the total number of certified NYS MWBEs.

The DMWBD is proud to announce that, for the third year running, NYS has exceeded
Governor Hochul’s 30% aspirational MWBE utilization goal. New York State, the DMBWD,
and NYS Agencies and Authorities continue to deliver, and exceed, on their commitment to
championing greater equality of economic opportunities for MWBEs.

NYS MWBE Certified Firms

With Governor Hochul’s support and additional funding, the DMWBD has been able to
improve application processing times, application submission and review processes, and
provide in-person support across all 10 NYS regions. Due to these improvements the
certification processing time is now averaging 90 to 120 days. DMWBD will be able to
certify MWBE businesses faster, growth the size and range of the certified directory, and
increase overall MWBE participation in state contracting.

NYS MWBE Expenditure by Industry
During FY 2022-23, overall NYS 15-A eligible expenditure was down by 6.36% from $9.3B in
FY 2021-22. Despite a reduction in expenditure and existing economic constraints, NYS was
able to continue to surpass the aspirational 30 percent MWBE utilization goal.

The continuation of strong NYS MWBE utilization demonstrates the resilience and robust
nature of the MWBE program, MWBE businesses, and the ongoing commitment of NYS
Agencies and Authorities to supporting the MWBE community.

NYS MWBE Regional Statistics

Increased regional engagement and support is a key component of the DMWBD’s strategic
plan. To that end, the DMWBD is providing a breakdown of MWBE certification and
expenditure by region. This information will create a more robust understanding of the
current state, successes, and opportunities for improved support and service by NYS region.
Now more than ever, the DMWBD is committed to strengthening its support for NYS
MWBEs through increasing its work and presence throughout all NYS Regions.

In FY 2022-23, the DMWBD provided enhanced regional MWBE business development


events and outreach, including training sessions, webinars, business growth opportunities,
and programs aimed at connecting MWBEs with NYS Agencies, Authorities, and local
contracting opportunities.

FY 2022-23 NYS MWBE Waivers and Violations

Waivers occur at or after the time of award of a contract and may result in a reduction or
elimination of the MWBE goals that were established by the agency. Waivers may be granted
following consideration and review of various regulatory factors (for example, the
availability, number, or types of certified MWBEs, contract dollar value, scope of work,
project size and term) as well as documented good faith efforts to meet the contract goals.
Requests for partial or total waivers may be considered.

A contractor may be held liable for the willful or intentional failure to comply with MWBE
program requirements; such violations may result in sanctions including monetary damages.
