Dear Mr. Perry:

On April 17, 2023, the U.S. Department of Education, Office for Civil Rights (OCR) received
your complaint against the University of Kansas (University), alleging discrimination based on
race, color, or national origin. Specifically, you alleged the University’s Summer Diversity
Research Scholarship for First- and Second-Year Medical Students, and the Department of
Plastic Surgery Sub-Internship in Plastic Surgery Diversity Scholarship discriminates against
non-minority students.

Section 110(d) of OCR’s Case Processing Manual1 states that OCR will dismiss an
allegation when it obtains credible information indicating that the allegation has been resolved.
OCR communicated with the University, which provided information showing that the Summer
Diversity Research Scholarship for First- and Second-Year Medical Students, and the
Department of Plastic Surgery Sub-Internship in Plastic Surgery Diversity Scholarship
requirements were revised in April 2023 and are not restricted by race and national origin. OCR
checked the University’s website and neither scholarship references race or national origin in its
eligibility requirements. Based on the evidence reviewed by OCR in this case, OCR is
dismissing the complaint as resolved pursuant to Section 110(d).

This letter sets forth OCR’s determination in an individual OCR case. This letter is not a
formal statement of OCR policy and should not be relied upon, cited, or construed as such.
OCR’s formal policy statements are approved by a duly authorized OCR official and made
available to the public.

Please be advised that the University may not harass, coerce, intimidate, discriminate, or
otherwise retaliate against an individual because that individual asserts a right or privilege under
a law enforced by OCR or files a complaint, testifies, assists, or participates in a proceeding
under a law enforced by OCR. If this happens, the individual may file a retaliation complaint
with OCR.
