CONTRACT TO SELL REAL PROPERTY

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL is made, executed and entered into by:

PRISCELLA L. CABALLERO MARRIED TO ANTONIO P. CA-


BALLERO, of legal age, Filipino citizen, a resident of Block 3, Lot 10, Al-
tamonte Executive Village, Danlag, Consolacion, Cebu, Philippines
6001, hereinafter referred to as the “SELLER,”

-AND-

SPOUSES MICHAEL ANTHON SOLEDAD SUICO and REY-


CHILL DEL SOCORRO DARUNDAY, of legal ages, both Filipinos, and
with residence and postal address at 1918 Sitio San Miguel, Apas, Cebu
City, Cebu, Philippines, hereinafter referred to as the “BUYERS.”

WITNESSETH;

WHEREAS, the SELLER is the absolute and registered owner of a


house and lot located at Lot 10, Block-3 covered and embraced by
Transfer Certificate of Title No. 111-2014001728 issued by the Registry
of Deeds, Province of Cebu consisting a total area of FIFTY SEVEN (57)
SQUARE METERS, more or less, particularly described as follows:

“A parcel of land (Lot 10, Block 3 of the Consolidation-


Subd. Plan, PCS-07-003090, being a portion of Consolida-
tion of Lot 1 & Lot 2, Block-10, PSD-07-03-2979), situated
in the Barangay of Danlag, Municipality of Consolacion,
Province of Cebu, Island of Cebu. Bounded on the SW.,
along line 1-2 by Lot 9; Block 3; on the NW., along line 2-3
by road Lot 1; on the NE., along line 3-4 by Lot 11; on the
SE., along line 4-5 by Lot 25; along line 5-1 by Lot 24, all of
Block 3, of the Consolidation-Subd. Plan. Beginning at a
point marked “1” on the plan being N 32 DEG. 13.’W.,
1613.12 M. From BLLM no. 1, Consolacion, Cebu; thence
N 30 Deg. 39 W., 9.50 M. To point 2; thence N 59 Deg.
21’E., 6.00 M. To point 3; Thence S 30 Deg. 39’E., 9.50 M.
To point 4; thence S 59 Deg. 21’W., 3.45 M. To point 5;
Thence S 59 Deg. 21’W., 2.55 M. To point of beginning;
containing an area of FIFTY SEVEN (57) SQUARE ME-
TERS, MORE OR LESS. ALL POINTS REFERRED TO
ARE INDICATED ON THE PLAN AND MARKED ON THE
GROUND BY P.S. CYL. CONC. MONS. 15 X 40 CMS.,

bearings true; date of original survey January 21-31, 1991
and that of the consolidation-subd. Survey executed by Ge-
odetic Engr. Maximo W. Gudarido on March 15-21, 1995,
and approved on June 10, 1996."

WHEREAS, the BUYERS have offered to buy and the SELLER


has agreed to sell the above-mentioned property under the terms and
conditions herein below set forth;

NOW THEREFORE, for and in consideration of the sum of ONE


MILLION TWO HUNDRED THOUSAND PESOS (Php 1, 200,000.00)
Philippine Currency, and of the covenants herein after set forth, the
SELLER agrees to sell and the BUYERS agree to buy the aforesaid
property subject to the following terms and conditions:

1. The total consideration of TWO MILLION TWO HUNDRED THOU-


SAND PESOS (Php 1,200,000.00), Philippine Currency, shall be
payable as follows:

a.) The amount TEN THOUSAND PESOS (Php 10,000.00), repre-


senting earnest money shall be payable by the BUYERS to the
SELLER upon signing of this Contract to Sell;

b.) The BUYER shall apply for a house and lot purchase loan with
PAG-IBIG for the remaining balance in the amount of ONE MIL-
LION ONE HUNDRED NINETY THOUSAND PESOS (Php
1,190,000.00), Philippine Currency;
c.) For purposes of the loan, the SELLER shall allow the transfer of
the title in the name of the BUYER, but only after the issuance of a
letter of guarantee from PAG-IBIG.

2. Capital Gains Tax and Real Estate Tax, shall be for the account of the
BUYERS.

3. Documentary Stamps Tax, Registration Fee, registration expenses,


and all other miscellaneous fees and expenses shall be for the account
of the BUYERS.

4. Possession to the subject property shall be delivered by the SELLER


to the BUYERS upon full payment of the total consideration;

5. Upon full payment of the total price, the SELLER shall sign and exe-
cute a DEED OF ABSOLUTE SALE in favor of the BUYERS. The
SELLER shall likewise execute and/or deliver any and all documents, in-
cluding but not limited to the original copy of Transfer Certificate of Title,

Tax Declaration and all other documents necessary for the transfer of
ownership from SELLER to the BUYERS.
