    ORDER OF DISMISSAL WITHOUT PREJUDICE

    Petitioner Neil Joseph Gillespie, a detainee of the Marion County Jail, initiated this

    action on September 13, 2021, by filing a pro se Petition for Writ of Habeas Corpus Under

    28 U.S.C. § 2241 (Doc. 1). In the 107-page hand-written Petition, Petitioner seemingly

    challenges his pre-trial detention with no bond, and the foreclosure of his federal home

    equity conversion mortgage. He further asserts he has been denied reasonable medical

    accommodations under the American with Disabilities Act. He requests immediate

    release, transfer of his state criminal cases to federal court, that his charges be dismissed,

    his bonds be exonerated, and the state court proceedings stayed.

    It is not clear what type of lawsuit Petitioner intends to bring. Petitioner’s claims

    challenging the conditions of his confinement should be raised in a civil rights action. To

    the extent Petitioner requests that this Court interfere with his ongoing state court

    proceeding, the Court declines to do so. If Petitioner is convicted in state court, and he

    seeks to challenge a state court judgment of conviction or sentence, he may initiate a

    habeas corpus case. The Court has approved the use of forms for civil rights and habeas

    corpus cases, and Petitioner will be provided with copies of these forms.

    Accordingly, it is now

    ORDERED AND ADJUDGED:

    1. This case is DISMISSED without prejudice.

    2. The Clerk shall enter judgment dismissing this case without prejudice,

    terminate any pending motions, and close this case.

    3. The Clerk shall send Petitioner a civil rights complaint form and habeas

    corpus petition form. If Petitioner chooses to refile his claims, he may do so on the

    appropriate form in the appropriate venue. He should not put this case number on the

    form because the Clerk will assign a new case number upon receipt.
