There are three categories for business registration:

1) Sole proprietorship 2) Partnership 3) Corporation.

The DTI registration provides legal identity to a business and is


not a license or permit to run a business. To operate a business,
you'll need to secure a business permit and other related
documents from the local government unit where your business
is located.

Business Permit-issued to ensure that a business pays taxes


and complies with local regulations for safety, security, health,
and sanitation. This document also entitles an individual or
organization to any support provided by LGUs to businesses in
their area.

Business Name Registration-Your business name is the first


step for you to have a legitimate business, as it is a requirement
under Republic Act 3883 or the Business Name Law. To get a
business or mayor's permit to operate your business, you need
to have your business name registered first.
An implied warranty is an assurance that a product is fit for its intended purpose and
meets the buyer's expectations. These implied warranties can be written or oral. Implied
warranties are governed by state laws, not federal laws. The two key types of implied
warranties are merchantability and fitness. In every contract for the supply of services to
a consumer made by a seller in the course of a business, there is an implied warranty
that the service will be rendered with due care and skill and that any material supplied in
connection with such services will be reasonably fit for the purpose for which it is
supplied.

Limited warranty-s its name implies, a limited warranty is limited to just the specified
parts, certain types of defects, or other conditions. Often, it covers just the parts and
not the labor required to fully fix something. A limited warranty also may include the
stipulation that the manufacturer and the consumer split the cost of repairs for a given
period of time. Typically, both limited and full warranties cost extra as an add-on. One
example of this is a sale of a motor vehicle with a 10-year warranty. This allows the
manufacturer and retailer of the car to disclaim liability for any defects arising after 10
years. A limited warranty may also limit the types of damages a party can seek.
An example of a verbal express warranty is when an auto salesperson informs a
customer that "the engine in this car will last at least another 125,000 miles." If the
customer purchases the car and the engine doesn't last for another 125,000 miles, the
buyer can then contact the seller and ask for a remedy. An express warranty is an
agreement by a seller to provide repairs or a replacement for a faulty product,
component, or service within a specified time period after it was purchased. Buyers rely
on these promises or guarantees and sometimes purchase items because of them.

Pyramid schemes are illegal under state and federal law. If the plan's way of making
money is based not on selling a product or a service, but on recruiting new members into
the plan in order to get paid, it is an illegal pyramid.

The FTC's Bureau of Consumer Protection stops unfair, deceptive and fraudulent
business practices by collecting reports from consumers and conducting investigations,
suing companies and people that break the law, developing rules to maintain a fair
marketplace.

FAIR TRADE ENFORCEMENT BUREAU (FTEB)

was created to consolidate the business regulation, consumer protection, and


enforcement functions of the DTI pursuant to the Consumer Act of the Philippines or RA
7394.

BAGWIS AWARDS
The DTI-Bagwis Program gives due recognition to establishments that
uphold the rights of consumers while practicing responsible business
where consumers get the best value for money. The program also
encourages the setting up of Consumer Welfare Desks (CWDs) or an
equivalent customer relations office inside the mall that will provide
information to consumers and serve as a mechanism for the speedy
resolution of consumer complaints.

Who can join the program?

All retail establishments can join the program:

 Supermarkets
 Department Stores & Specialty Stores
 Appliance Centers
 Hardware Stores
 DTI Accredited Service and Repair Shops.

Levels of award

1. Bronze – Compliance to Fair Trade Laws + Consumer Welfare Desk


(CWD) or an equivalent customer relations office inside the mall
2. Silver – Achievement of Bronze requirements + Social Responsibility
3. Gold – Achievement of Silver requirements + some elements aligned to
ISO 9001

Criteria/Parameters used in the selection of awardees:

Compliance to Price Tag Law


• Product Standard (PS)/International Commodity Clearance
(ICC) marks for mandatory products
• Warranties (as applicable)
• Product under mandatory standards sold are genuine/original
• Reasonable prices based on SRP
• Provide discounts to senior citizens (RA 9257)
• Comply with the provisions of “No Return, No Exchange Policy”
• Do not practice deceptive, misleading & unconscionable,
fraudulent, misleading sales act and practice
