EXECUTIVE ORDER NO. 23, SERIES OF 2024

ORGANIZING THE BARANGAY BLOOD COUNCIL OF BARANGAY TALISAY,


DEFINING ITS MEMBERSHIP AND FUNCTIONS THEREOF

WHEREAS, Republic Act No. 7719, otherwise known as the “National Voluntary Blood
Services Act of 1994”, prescribes the promotion and encouragement of voluntary blood
donation by the citizens collectively to bring the sufficient supply of blood all over the
country;

WHEREAS, to initiate local blood donation, RA 7719 likewise enjoins all local government
units to assemble for actions various sectors of the communities to participate in instrument
for voluntary and non-profit collection of blood, and organize them into local councils;

WHEREAS, Administrative Order No. 2010-0002 of the Department of Health prescribes


the policies and guidelines pertinent to the establishment and operation of local blood
councils to support the implementation of the National Voluntary Blood Services Program for
blood safety and adequacy, quality care and patient safety;

WHEREAS, the organization of the Barangay Blood Council will provide continuous supply
of safe blood and blood products and assure the public that only licensed blood service
facilities with adequate state, pieces of equipment, resources to perform all the required
procedures in collecting blood safely, efficiently and effectively from qualified healthy
voluntary non-remunerated blood donors can operate within the territorial jurisdiction of
every local government units;

WHEREAS, the Barangay Talisay supports RA No. 7719 and other national and local
policies related to safe blood and ensures the wellbeing of its constituents;

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, by thevirtue of the powers vested in me by law do hereby organize the
Barangay Blood Council defining its membership and functions thereof;

SECTION I: ORGANIZATION AND ITS COMPOSITION. There is a need to organize


Barangay Talisay Blood Council, hereinafer referred as the “Council” for the purpose of
planning, coordinating and sustaining the implementation of a local voluntary blood donation
program which endeavors to provide adequate safe blood for the community in accordance
with the Department of Health (DOH) policies and guidelines on local council.

SECTION 2. FUNCTION AND OBJECTIVES. The council shall have the following
functions and objectives:
a. Participate in the formulation of the Local Blood Donation Program that fulfills the needs
for blood transfusion in the community;
b. Plan, implement and monitor public education, advocacy and donor recruitment activities
to promote voluntary blood donation;
c. Organize mobile blood donation collection activities in coordination with the Blood Center
and authorized Blood Collection Units.

SECTION 3. Meetings. The meetings of the council shall be conducted quarterly, special
meetings shall be conducted as need arises.

Whereas, a Mothers' Club (MC) is an association of volunteer women who adhere to the
principles of the Red Cross, and come together to exchange and sensitize other members of
the community on topics they have previously been trained on such as maternal and child
health, wash, nutrition, etc.

Whereas, members of mother’s club have become aware of society, environment, primary
health care, food and nutrition, communicable diseases, diseases related with nutrition
deficiency and how all of these have a relationship to disability.

NOW THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, Balanga City, Province of Bataan, by virtue of the powers in me vested by
law, do hereby order:

BARANGAY (ECOLOGICAL) SOLID WASTE MANAGEMENT COMMITTEE

WHEREAS, SECTION 16 (General Welfare Clause) of Republic Act 7160, otherwise


known as the Local Government Code of 1991, provides that the Local Government Units
(LGU’s) within their territorial jurisdictions, shall ensure and support among other things. To
encourage a community to be responsible for the segregation and collection of solid waste
specially for biodegradable compostable and reusable wastes.

WHEREAS, The Department of the Interior and Local Government (DILG) Regional Office
III issued Regional Memorandum dated August 21, 1998, encouraging all local Chiefs
Executives (LCE’s) to organized Barangay (Ecological) Solid Waste Management Council,
Committees in the case of Barangays.

NOW THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, Balanga City, Province of Bataan, by virtue of the powers in me vested by
law, do hereby order:

2. Be responsible for the segregation and collection of solid waste specially for
biodegradable, compostable, and reusable wastes;
3. Established within the barangay or cluster a Material Recovery Facility (MRF)
4. Allocated barangay funds for the barangay ecological solid waste management program
approved by the Sangguniang Barangay;
5. Organize a Core of Area/ Street Coordinators through the conduct of training for
Barangay residents on segregation, composting, recycling and livelihood opportunities
from the use of recyclable wastes and to monitor their implementation;
6. Integrate the ecological solid waste management program in the barangay development
plan and /or annual investment plan;
7. Find alternative sources of funds other than the regular barangay budget funds;
8. Submit a monthly report to the city/municipal ESWMB on the progress of the program,
copy furnished the local DILG office.

Section 3. EFFECTIVITY – This order shall take effect immediately.

MANDATING THE CREATION, MAINTENANCE AND SUSTAINABILITY OF


PHASE 3, COMMUNAL GARDEN (KAANIB)

WHEREAS, this phenomenon has been the major dilemma of our aging generation because
somehow we are no longer innocent about the effect of population boom, not only does we
are going to learn to minimize space that we would need for homes but we are also going to
adapt ourselves to measures that would attend to our specific needs in response to land
conversion programs of the government in order to cater to industrial and commercial
development;

WHEREAS, a particular effect of land conversions is the shortage in food supply while
demand is constantly surging higher because of population increase hence the need to utilize
the remaining spaces within our own backyards for gardening is imperative;

WHEREAS, the barangay government to provide the community with the best example shall
establish the community garden to be managed by Kagawad Lee L. Sacdalan and its
member;

NOW THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, Balanga City, Bataan, by virtue of the powers vested in me by law, do
hereby order mandating the creation, maintenance and sustainability of Phase 3 Communal
Garden of Barangay Talisay, Balanga City, Bataan with the following features to wit;
1. A communal garden shall be established in the barangay, to be maintained and
sustained by Kagawad Lee L. Sacdalan and its member;
2. The Barangay government shall provide for the seedlings and seeds to be used in this
project;
3. Members of HAPAG Team are expected to benefit from this project;
4. Source of Fund: Barangay Fund

EFFECTIVITY. This Executive Order shall take effect immediately. Done this 12th day of

AN ORDER PROVIDING THE ORGANIZATION OF THE HALINA'T MAGTANIM


NG PRUTAS AT GULAY (HAPAG) SA BARANGAY TALISAY, BALANGA CITY,
BATAAN

WHEREAS, the economy of the Philippines depends heavily on the agricultural sector, thus
challenges encountered, especially by farmers, have negative effects on the food security in
the country. Given its geographic location, the Philippines experienced numerous threats to
food security brought about by strings of natural calamities that have rendered farm produce
unusable or increased food prices due to food shortage

WHEREAS, COVID-19 pandemic has further worsened the country's food security,
disrupting the availability and access to free and nutritious foods at affordable process.

WHEREAS, the Philippines ranks 68* of the 116 countries assessed for experiencing hunger
globally. With a score of 16.8, the Philippines had a moderate level of hunger (2021 Global
Hunger Index). In addition, the result of the latest Social Weather Stations (SWS) National
Survey released on September 11, 2022 with 1500 respondents shows that 11.6% of Filipino
or about 2.9 Million households have experienced involuntary hunger in the past three
months.

WHEREAS, to address the problem of hunger and food insecurity in the Philippines, the
national government enacted several laws and implemented various initiative and strategies
to ensure sustainable and resilient production and food availability throughout the country.
However, food insecurity remains a challenge in the country due to food shortage and rising
food prices brought by natural calamities and disasters, health crises such as the COVID-19
pandemic, among others, hindering economic growth and national development.

WHEREAS, the Department of the Interior and Local Government thru its Memorandum
Circular 2023-001 shows its support in cognizant of the role of barangay as essential partners
of the national government in contributing to address hunger and ensuring food security in
the country thru the Halina't Magtanim ng Prutas at Gulay (HAPAG) sa Barangay Talisay,
Balanga City, Bataan;

WHEREAS, HAPAG project aims to strengthen the capacities of barangay towards


sustainable agriculture initiatives. One of which is the intensification and fostering of
agricultural activities and communities will be encourage to produce fresh, healthy and
affordable fruits and vegetables from their backyard spaces, through the establishment of
community gardens in the barangays with vacant areas.

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay by the power vested upon me by law do hereby order that:

Section 2. Roles and Functions. The Barangay HAPAG Team shall have the following roles
and functions:
1. Establish and maintain a HAPAG Barangay Community Garden (BCG) which shall
be at least two hundred square meters (200 sqm) of land area whether continuous or
thru vertical gardens;
2. Set-up a community garden in a vacant area preferably owned by the barangay or the
Municipal Government. In case of unavailability, the Sangguniang Barangay can
make an arrangement with a lot-owner in the barangay for the temporary use of the
land for the HAPAG-BCG.
3. Manage the operations of the HAPAG- BCG;
4. Coordinate with the Municipal Agriculture Office for any available agricultural
training, seminars and capacity-building services as well as seeding materials and
other agricultural equipment and facilities, that would help in the operation of the
HAPAG-BCG;
5. Lead the promotion of the HAPAG-BCG to the community including its importance
and benefits as well as the products produced through the community garden;
6. Promote agribusiness, especially for high-value products in the areas;
7. Keep a record of the overall operations of the HAPAG-BCG such as the types of
seedlings planted, number of vegetables and fruits harvested (e.g. per sack, per piece,
per kilo etc), among others;
8. Ensure the adequate provision of agricultural services and facilities in the barangay
pursuant to Section 17 of the Local Government Code of 1991;
9. Enjoin a group of volunteers in the community to help in the establishment of and
maintenance of the HAPAG-BCG as well as spread the information in setting- up
household vegetable gardening and/or planting fruit-bearing trees; and
10. Submit reports to the Municipal Field Office of the DILG on their compliance with
the establishment of the HAPAG-BCG.

Section 3. Effectivity. This Executive Order shall take effect immediately. Done this 12th day

AN ORDER DESIGNATING A SANGGUNIANG MEMBER AS A FOCAL PERSON


IN THE MANAGEMENT AND MAINTENANCE OF BARANGAY COMMUNITY
GARDEN

WHEREAS, Ambisyon Natin 2040 states that, “By 2040, all Filipinos will have access to
safe, nutritious, and affordable food. The government will promote healthy eating habits and
physical activity, and will work to reduce the prevalence of malnutrition, including stunting,
wasting, and overweight and obesity”;

WHEREAS, DILG Memorandum Circular No. 2023-001 provides the guidelines in the
implementation of the Halina’tMagtanim ng Prutas at Gulay (HAPAG) sa Barangay Project;

WHEREAS, Barangay Talisay, has a community garden located at Phase 3, Talisay,


Balanga City, Bataan that is intended to provide fresh vegetables and fruits to the residents;
and

WHEREAS, the Barangay needs a focal person to manage and maintain the community
garden;

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, do hereby order as follows:

Section 1. Designation of Focal Person. Kagawad Lee L. Sacdalan, is hereby designated


as the focal person in the management and maintenance of the Barangay community garden.

Section 2. Duties and Responsibilities of the Focal Person. The focal person shall have the
following duties and responsibilities:
1. Oversee the day-to-day operations of the community garden;
2. Ensure that the community garden is properly maintained;
3. Monitor the production of vegetables and fruits;
4. Coordinate with the barangay officials and staff, including the barangay nutrition
scholar, in the operation and maintenance of the community garden;
5. Keep a record of the overall operations of the community garden, such as the types of
seedlings planted, and number of vegetables and fruits harvested; and
6. Perform such other duties and responsibilities as may be assigned by the Punong
Barangay.

Section 3. Effectivity. This Executive Order shall take effect immediately. Done this 12th day

AN ORDER CREATING THE BARANGAY INVENTORY TEAM (BIT) IN CONNECTION


WITH THE SYNCHRONIZED BARANGAY AND SANGGUNIANG KABATAAN
ELECTIONS

WHEREAS, Republic Act No. 11935, also known as “An Act Postponing the
December 2022 Barangay and Sangguniang Kabataan Elections, Amending for the
Purpose Republic Act No. 9164, as Amended, Appropriating Funds Therefor, and for
Other Purposes”

WHEREAS, Section 1 of the said Act provides that the Synchronized Barangay
and Sangguniang Kabataan Elections shall be held on the last Monday of October 2023;

WHEREAS, the Department of the Interior and Local Government (DILG) issued
Memorandum Circular No. 2023- _____ dated __________________ 2023, on the Conduct of
Inventory and Turnover of all Barangay and Sangguniang Kabataan (SK) Properties,
Financial Records, Documents (PFRDs) and Money Accountabilities by all Incumbent
Barangay and SK Officials;

WHEREAS, the said Circular mandates all Punong Barangays to convene and
create their respective Barangay Inventory Team (BIT), through an Executive Order and
submit a copy of the same to the concerned City/Municipal Mayor and the City
Director/C/MLGOO;

WHEREAS, the BIT shall be created primarily for purposes of conducting the
initial and inventory, and turnover of BPFRDs and money accountabilities; and ensuring
an orderly and smooth transition of barangay governance to the newly elected or re-
elected incoming barangay officials;

NOW, THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, City/Municipality of Balanga, Province of Bataan, by virtue of the
powers vested in me by law, do hereby order the creation of the Barangay Inventory
Team, with the following provisions:

The Team shall undertake the following:

1. Conduct an Inventory of Properties and Money Accountabilities:

1.1 Conduct an initial inventory of all Barangay Properties, Financial


Records and Documents (BPFRDs);

1.2 Accomplish the prescribed Turnover Form No.1;

1.3 Furnish the City/Municipal Mayor, Local COA and the concerned
DILG City Director/C/MLGOO copy of the initial inventory of
BPFRDs

1.4 Conduct final inventory of BFRDPs, to include an inventory of


money, e.g. cash on hand and in bank, used and unused checks and
loans, if any, using Turnover Form No. 2.

2. Conduct of Turnover Ceremony and Submission of Report:

2.1 Organize and conduct a Turnover Ceremony, to include a briefing


on the State of Barangay Governance, Financial Performance
Report and Key Challenges, among other information and
accomplishments to the new set of barangay officials;

2.2 Notify/Inform the City/Municipal Officials, DILG CD/C/MLGOO,


local COA and barangay residents of the conduct of the turnover
ceremony;

2.3 Submit a report and the accomplished Turnover Form No. 2 and
other relevant documents on the conduct of a turnover ceremony
to the Local COA, and the DILG City Director/C/MLGOO;

3. Ensure completeness of the following:

3.1 All barangay financial, legislative and administrative records;

3.2 Transcript, minutes of meetings, list and status of complaints filed


before the Lupong Tagapamayapa;

3.3 Updated Registry of Barangay Inhabitants (RBI) and Members of


the Barangay Assembly;

3.4 All other documents involving barangay transactions;

4. See to it that all supplies and properties of the barangay, that are in
actual possession or entrusted to the concerned barangay officials and
employees, are properly accounted and listed in the prescribed
Turnover Forms.

5. Submit reports on the given timelines indicated in DILG MC No. 2023-

SECTION III. EFFECTIVITY:

This Executive Order shall take effect immediately upon its approval.

ORGANIZING THE BARANGAY BIDS AND AWARD COMMITTEE

WHEREAS, Republic Act No. 9184 (RA 9184) entitled (An Act Providing for
Modernization, Standardization and Regulation of the Procurement Activities of the
Government for other Purposes. was signed into law on January 10, 2003 and took effect
on January 26, 2003. On the other hand, it’s Implementing Rules and Regulations Part A
(IRR – A) took effect on October 8, 2003.

WHEREAS, crucial to the implementation of RA 9184 and its IRR – A in the local
government level is the Creation of Bids and Award Committee (BAC) in all Local
Government Units (LGU’s) including the barangays.

WHEREAS, in compliance with the instruction of the GRPB, the DILG submitted a draft
proposal as to the composition of the BAC on January 29, 2004 and the members of the
GPPB, during its meeting on March 10,2004, unanimously agreed to adopt, with certain
amendments, the BAC composition in LGU’s including the barangays as proposed by GPPB-
TSO and DILG.

WHEREAS, for the effective dissemination of the BAC composition at the local government
level including the barangays, the DILG is hereby directed to issue a memorandum circular
reflecting the BAC composition contained herein for LGU’s compliance.

Sanctions
All concerned local authorities are hereby advised that:

 Failure of concerned local officials to appropriate a substantial portion of their respective


Annual Budgets to assist in or enhance the enforcement of RA 9165 as mandatorily required
by Section 51 of RA 9165 in all budget preparation in addition to those already mandatorily
required under 324 of the local government Code shall be ground for disapproval of the
Annual Budget on review and can be a ground for possible administrative case of dereliction
of duty pursuant to Section 60 of the Local Government Code.
 Failure of the Local Officials to take appropriate measures to enforce the pertinent provision
of RA 9165 after being made aware by the PDEA and or PNP and other law enforcement
agencies that illegal drugs sale, delivery and use is rampant with their LGU on shabu and
other illegal drug laboratories and marijuana plantation have been concerned within the area
of their jurisdiction shall be considered as prima facie evidence for administrative charges for
gross negligence or dereliction of duties as may be warranted by evidence.
 All local official engaged in the manufacture, sale, delivery, transportation and use of illegal
drugs or who may have benefited there from shall be dealt with criminally and
administratively pursuant to the provisions of RA 9165.

Repealing Clause

All previous issuances which are inconsistent herewith are hereby repealed or Effectivity.

This Memorandum Circular shall take effect immediately.

comprehensive women’s human rights law he seeks to eliminate the discrimination against women by
recognizing, protecting, fulfilling and promoting the rights of Filipino women, especially those in
the marginalized sectors.
WHEREAS, Chapter IV, Section 9, Protection from Violence of the same Act provides for the
establishment of a Violence Against Women (VAW) desk every barangay to ensure that violence
against women cases are fully addressed in a gender-responsive manner.
NOW, THEREFORE, I TERESITO REMO O. CAMACHO, Punong Barangay of Barangay
Talisay, Balanga City, Bataan by virtue of the powers vested in me by law, do hereby order.
SECTION 1. Established of Violence Against Women (VAW) Desk and Designating Barangay

1. Respond to gender-based violence cases brought to Barangay.
2. Record the number of gender-based violence handled by the Barangay and submit a quarterly

Development Office.
3. Keep VAW case records confidential and secure that only authorized personnel can access it.
4. Assist victims of VAW in securing Barangay Protection Order (BPO) and access necessary
services.
5. Develop the barangay’s gender responsive plan in addressing gender based violence, including
support services, capacity building and referral system.
6. Coordinate with and refer cases to government agencies, non-government organizations (NGO’s)
institutions, and other service providers as necessary.
7. Address other forms of abuse committed against women, especially senior citizen’s, women with
disabilities and other marginalized groups.
8. Lead advocacies on the elimination of VAW in the community, and
9. Perform other related functions as may be assigned.

SECTION 3. Effectivity. This Executive Order shall take effect immediately and any other prior
issuances is hereby repealed, modified and amended accordingly.

Whereas, Section 106 of the LGC of 1991 that “ each local government unit shall have a
comprehensive multi-sectoral development plan to be initiated by its development council approved

social development and coordinating efforts within its territorial jurisdiction;

Whereas, BDC plays pivotal role in the over-all development and progress of the barangay and is
considered the mother of all special bodies in the barangay being the umbrella organization of all
barangay-based institutions ( BBIs).

Whereas, Department issued DILG Memorandum Circular No. 2009-109 re Guidelines in monitoring
the functionality of the BDC’s . Given the recent development in the policy environment , there is
indeed a necessity to update the said issuance to harmonize the duties and functions of BDC pursuant
to existing laws.

NOW THEREFORE, I TERESITO REMO O. CAMACHO, Punong Barangay of Barangay Talisay,


Balanga City, Bataan, by virtue of the powers vested in me by the Local Government Code of 1991

SECTION 4.General Functions of the LGU GFPS. Pursuant to the MCW-IRR, the GFPS is tasked

advocacy, planning, monitoring and evaluation, and technical advisory in mainstreaming GAD
perspective GFPS shall perform the following functions:
a) Lead in mainstreaming GAD perspective in LGU policies, plans and programs. In the
process, they shall ensure the assessment of the gender-responsiveness of systems, structures,
policies, programs, processes, and procedures of the LGU based on the priority needs and
concerns of constituencies and employees, and the formulation of recommendations including
their implementation;
b) Assist in the formulation of new policies such as the GAD Code in advancing
women's empowerment and gender equality;
c) Lead in setting up appropriate systems and mechanisms to ensure the generation,
processing, review, and updating of sex-disaggregated data or GAD database to serve
as basis in performance-based and gender-responsive planning and budgeting;
d) Coordinate efforts of different divisions/offices/units of the LGU and advocate for the
integration of GAD perspectives in all their systems and processes;
e) Spearhead the preparation of the annual and performance-based LGU GAD Plan and
Budget (GPB) in response to the gender issues and or concerns of their locality and in
the context of the LGU mandate; and consolidate the same following the form and
procedures prescribed in this Joint Memorandum Circular (JMC). The GFPS shall
f) likewise be responsible for submitting the consolidated GPBs of the LGU;
g) Lead in monitoring the effective implementation of the annual GPB, GAD Code,
other GAD-related policies and plans;
Lead the preparation of the annual LGU GAD Accomplishment Report ( GAD AR)
and other GAD reports that may be required under the MCW and this JMC;
a) Strengthen linkages with other LGUs, concerned agencies or organizations
working on women's rights and gender and development to harmonize and
synchronize GAD efforts and various level of local governance;
b) Ensure that all personnel of the LGU including the planning and finance officers
(e.g. accountants, budgets officers, auditors) are capacitated on GAD. Along this
line, the GFPS will recommend and plan an appropriate capacity development
program on GAD for its employees as part of and implemented under its regular
human resource development program.

SECTION V. EFFECTIVITY. This Order shall take effect immediately upon approval.

WHEREAS, Republic Act 10361 otherwise known as “Domestic Workers Act of “


Batas Kasambahay was signed on January 18, 2013. Consequently, the
Implementing Rules and Regulations (IRR) of the said Act was promulgated on May
9, 2013.

WHEREAS, Rule IX of the IRR provides for the registration system for Kasambahay
and mandates the Department of the Interior (DILG) to issue a circular prescribing
the standard Form and Protocols to guide for registration.

WHEREAS, DILG Memorandum Circular No. 2013-61 dated July 8, 2013 signed by
DILG Secretary Mar Roxas relative to the Guidelines on the establishment of
Kasambahay Desk and designation of Desk Officer.

NOW, therefore, I, TERESITO REMO O. CAMACHO, Punong Barangay, Barangay


Talisay, Balanga City, Bataan, by the virtue of the powers vested upon me by Law
do hereby order the establishment of Kasambahay Desk and designating
Kasambahay Desk Officer in this barangay taking into consideration DILG-
Memorandum Circular No. 2013- 61, to wit:

SECTION 2: Function of BHERT – The BHERT shall have the following functions.

c. To report any occurrence of sudden increase of a certain disease in their community to the City
Health Office.
d. To assist in the dissemination of right information about the disease including the preventive
measure, character of the disease, etc.
e. To help the City epidemiological surveillance in the identification of the where about of the
deceased or afflicted individual/s in their community

SECTION 3. Meetings. The meetings of the council shall be conducted quarterly, special meetings shall
be conducted as need arises.

REORGANIZING THE SMOKE FREE BARANGAY TASK FORCE

WHEREAS, The 1987 Constitution of the Republic of the Philippines declares that the state shall protect
and promote the right to health of the people and instill health consciousness among them;

WHEREAS, The local Government Code of 1991 (republic Act. No. 7160) accords every local
government unit power and authority to promote the general welfare within its territorial jurisdiction,
including the promotion of health and safety of its constituents;

WHEREAS, In support of the afore-quoted provisions the Sangguniang barangay of Talisay, adopt the
City Ordinance no. 20, series of 2010, “AN ORDINANCE PROHIBITING THE USE, SALE,
DISTRIBUTION AND ADVERTISEMENT OF CIGARETTES AND OTHER TOBACCO PRODUCTS
IN CERTAIN PLACES WITHIN BALANGA CITY, IMPOSING PENALTIES FOR VIOLATIONS
THEREOF AND PROVIDING FUNDS THEREOF AND FOR OTHER PURPOSES.”

NOW, THEREFORE I, Teresito Remo O. Camacho, Punong Barangay of Talisay, City of Balanga,
Province of Bataan, by Virtue of the powers vested in me by Law, do hereby order.

SECTION 1. Creation /Organizing the Task Force Smoke Free Barangay, to be composed of the
following.

SECTION 2. Function of Task Force Smoke Free Barangay, shall have the following duties and

a. Plan, strategies, implement and evaluate programs and projects on the said City Ordinance.
b. Prominently post and display “No Smoking” signage in the locations most visible to the public in
the areas where smoking is prohibited.
c. For persons-in-charge of schools, public playgrounds and other facilities frequented by wieners
post the signage.
d. For persons-in-charge of point of sale establishment post signage in a clear and conspicuous
manner.
e. Establish internal procedure and measures through which the Ordinance shall be implemented and
enforced within the area of which he or she in charge including but not limited to warning
violators and requesting them to stop smoking and if they refuse to comply, report the incident to
the City Health Offices and nearest peace officer.
f. Perform other functions.

of the health and safety of its inhabitants from all forms of diseases, especially those of epidemic
effects.

e. Arrange meeting with other key leaders and members, discussing the topic on dengue.
f. Perform other functions.

WHEREAS, The Department of the Interior and Local Government (DILG) Regional office III
issued Regional Memorandum dated August 21, 1998, encouraging all Local Chief Executives
(LCEs) to organized Local Nutrition Councils, Committees in the case of barangays.

NOW, THEREFORE, I. TERESITO REMO O. CAMACHO, Punong Barangay of Talisay, City


of Balanga, Bataan, by virtue of the powers in me vested by law, do hereby order:

SECTION 1. Organizing and Composition of Barangay Health Emergency (BHERT)-

EXECUTIVE ORDER NO. 01, SERIES OF 2024


ADOPTING EXECUTIVE ORDER NO. 51
“A NATIONAL CODE OF MARKETING OF BREASTMILK SUBSTITUTES,
BREASTMILK SUPPLEMENTS AND RELATED PRODUCTS, PENALIZING
VIOLATIONS THEREOF, AND FOR OTHER PURPOSES.”

WHEREAS, in order to ensure that safe and adequate nutrition for infants is provided, there
is a need to protect and promote breastfeeding and to inform the public about the proper use
of breastmilk substitutes and supplements and related products through adequate, consistent
and objective information and appropriate regulation of the marketing and distribution of the
said substitutes, supplements and related products;

WHEREAS, consistent with Article II of the International Code of Marketing of Breastmilk


Substitute, the present government should adopt appropriate legislation to give effect to the
principles and aim of the aforesaid International Code.;

NOW THEREFORE, I, TERESITO REMO O. CAMACHO, Punong Barangay of


Barangay Talisay, Balanga City, Province of Bataan, by virtue of the powers in me vested by
law, do hereby order:

SECTION 1 Title – This Code shall be known and cited as the “National Code of Marketing
of Breastmilk Substitutes, Breastmilk Supplement and Other Related Products.”

SECTION 2 Aim of the Code – The aim of the Code is to contribute to the provision of safe
and adequate nutrition for infants by the protection and promotion of breastfeeding and by
ensuring the proper use of breastmilk substitutes and breastmilk supplements when these are
necessary, on the basis of adequate information and through appropriate marketing and
distributions.

SECTION 3 Scope of the Code – The Code applies to the marketing and practices related
thereto, of the following products: breastmilk substitutes, including infant formula; other milk
products, foods and beverages, including bottle fed complementary foods, when marketed or
otherwise represented to be suitable, with or without modification, for use as a partial or total
replacement of breastmilk; feeding bottles and teats. It also applies to their quality and
availability, and to information concerning their use.

SECTION 4 Definition of Terms – For the purposes of this Code the following definition of
terms shall govern’
a) “Breastmilk Substitutes” means any food being marketed or otherwise represented as
a partial or total replacement of breastmilk, whether or not suitable for that purpose.
b) “Complementary Food” means any food, whether manufactured or locally prepared,
suitable as a complement to breastmilk or to infant formula, when either becomes

insufficient to satisfy the nutritional requirements of the infant. Such food is also
commonly called “weaning food” or “breastmilk supplement”.
c) “Container” means any form of packaging of products for sale as normal retail unit,
including wrappers.
d) “Distributor” means a person, corporation or any other entity in public or private
sector engaged in the business (whether directly or indirectly) of marketing at the
wholesale or retail level a product within the scope of this Code. A “primary
distributor” is a manufacturer’s sales agent, representative, national distributor or
broker.
e) “Infant” means a person falling within the age bracket of 0-12 months.
f) “Health care system” means governmental, non-governmental or private institutions
or organizations engaged, directly or indirectly, in health care for mothers, infants and
pregnant women; and nurseries or child care institutions. It also includes health
workers in private practice. For the purpose of this Code, the health care system does
not include pharmacies or other established sales outlets.
g) “Health Worker” means a person working in a component of such health care system,
whether professional or non-professional, including volunteer workers.
h) “Infant Formula” means a breastmilk substitute formulated industrially in accordance
with applicable Codex Alimunterius standards, to satisfy the normal nutritional
requirements of infants up to between four to six months of age, and adapted to their
physiological characteristics. Infant formula may also be prepared at home in which
case it is described as “home-prepared”.
i) “Label” means any tag, brand, mark, pictorial or other descriptive matter, written,
printed, stenciled, marked, embossed or impressed on, or attached to, a container of
any product within the scope of this Code.
j) “Manufacturer” means a corporation or other entity in the public or private sector
engaged in the business or function (whether directly or through an agent or an entity
controlled by or under contract with it) of manufacturing a product within the scope of
this Code.
k) “Marketing” means product promotion, distribution, selling, advertising, product
public relations, and information services.
l) “Marketing Personnel” means any person whose functions involve the marketing of a
product or products coming within the scope of this Code.
m) “Sample” means single or small quantities of a product provided without a cost.
n) “Supplies” means quantities of a product provided for use over an extended period,
free or at a low price, for social purposes, including those provided to families in
need.

SECTION 5 Information and Education –


a) The government shall ensure that objective and consistent information is provided on
infant feeding, for use by families and those involved in the field of infant nutrition.
This responsibility shall cover the planning, provision, design and dissemination of
information, and the control thereof, on infant nutrition.

b) Informational and educational materials, whether written, audio, or visual, dealing


with the feeding of infants and intended to reach pregnant women and mothers of
infants, shall include clear information on all the following points:
1) the benefits and superiority of breastfeeding;
2) maternal nutrition, and the preparation for and maintenance of breastfeeding;
3) the negative effect on breastfeeding of introducing partial bottle-feeding;
4) the difficulty of reversing the decision not to breastfeed; and
5) where needed, the proper use of infant formula, whether manufactured
industrially or home=prepared. When such materials contain information
about the use of infant formula, they shall include the social and financial
implications of its use of it’s use; the health hazards of inappropriate foods or
feeding methods; and , in particular, the health hazards of unnecessary or
improper use of infant formula and other breastmilk substitutes. Such
materials shall not use any picture or text which may idealize the use of
breastmilk substitutes.

SECTION 6 The General Public and Mothers –


a) No advertising, promotion or other marketing materials, whether written, audio or
visual, for products within the scope of this code shall be printed, published,
distributed, exhibited and broadcast unless such materials are duly authorized and
approved by an inter-agency committee created herein pursuant to the applicable
standards provided for in this Code.
b) Manufacturers and distributors shall not be permitted to give, directly or indirectly,
samples and supplies of products within the scope of this Code or gifts of any sort to
any member of the general public, including members of their families, to hospitals
and other health institutions, as well as to personnel within the health care system,
save as otherwise provided in this Code.
c) There shall be no point-of-sale advertising, giving of samples or any other promotion
devices to induce sales directly to the consumers at the retail level, such as special
displays, discount coupons, premiums, special sales, bonus and tie-in sales for the
products within the scope of this Code. This provision shall not restrict the
establishment of pricing policies and practices intended to provide products at lower
prices on a long-term basis.
d) Manufacturers and distributors shall not distribute to pregnant women or mothers of
infants any gifts or articles or utensils which may promote the use of breastmilk
substitutes or bottle feeding, nor shall any other groups to the general public and
mothers.
e) Marketing personnel shall be prohibited from advertising or promoting in any other
manner the products covered by this Code, either directly or indirectly, to pregnant
women or with mother of infants, except as otherwise provided by this Code.
f) Nothing herein contained shall prevent donations from manufacturers and distributors
of products within the scope of this Code upon request by or with the approval of the
Ministry of Health.

SECTION 7 Health Care System –


a) The Ministry of Health shall take appropriate measures to encourage and promote
breastfeeding. It shall provide objective and consistent information, training and
advice to health workers on infant nutrition, and on their obligations under this Code.
b) No facility of the health care system shall be used for the purpose of promoting infant
formula or other products within the scope of this Code. This Code does not,
however, preclude the dissemination of information to health professionals as
provided in Section 8(b).
c) Facilities of the health care system shall not be used for the display of products within
the scope of this Code, or for placards or posters concerning such products.
d) The use by the health care system of “professional service” representatives,
“mothercrafts nurses” or similar personnel, provided or paid for by manufacturers or
distributors, shall not be permitted.
e) In health education classes for mothers and the general public, health workers and
community workers shall emphasize the hazards and risks of the improper use of
breastmilk substitutes particularly infant formula. Feeding with infant formula shall
be demonstrated only to mothers who may not be able to breastfeed for medical or
other legitimate reasons.

SECTION 8 Health Workers –


a) Health workers shall encourage and promote breastfeeding and shall make themselves
familiar with objective and consistent information on maternal and infant nutrition,
and with their responsibilities under this Code.
b) Information provided by manufacturers and distributors to health professionals
regarding products within the scope of this Code shall be restricted to scientific and
factual matters, and such information shall not imply or create a belief that bottle
feeding is equivalent or superior to breastfeeding. It shall also include the information
specified in Section 5.
c) No financial or material inducements to promote products within the scope of this
Code shall be offered by manufacturers or distributors to health workers or members
of their families, nor shall these be accepted by the health workers or members of
their families, except as otherwise provided in Section 8(e).
d) Samples of infant formula or other products within the scope of this Code, or of
equipment or utensils for their preparation or use, shall not be provided to health
workers except when necessary for the purpose of professional evaluation or research
in accordance with the rules and regulations promulgated by the Ministry of Health.
No health workers shall give examples of infant formula to pregnant women and
mothers of infants or members of their families.
e) Manufacturers and distributors of products within the scope of this Code may assist in
the research, scholarships and continuing education, of health professionals, in
accordance with the rules and regulations promulgated by the Ministry of Health.

SECTION 9 Persons Employed by Manufacturers and Distributors – Personnel


employed in marketing products within the scope of this Code shall not, as part of their job

responsibilities, perform educational functions in relation to pregnant women or mothers of


infants.

SECTION 10 Containers/Labels –
a) Containers and/or labels shall be designed to provide the necessary information about
the appropriate use of the products, and in such a way as not to discourage
breastfeeding.
b) Each container shall have a clear, conspicuous and easily readable and understandable
message in Pilipino or English printed on it, or on a label, which message can not
readily become separated from it, and which shall include the following points:
1) the words “Important Notice” or their equivalent;
2) a statement of the superiority of breastfeeding;
3) a statement that the product shall be used only on the advice of a health
worker as to the need for its use and the proper methods of use; and
4) instructions for appropriate preparation, and a warning against the health
hazards of inappropriate preparation.
c) Neither the container nor the label shall have pictures or texts which may idealize the
use of infant formula. They may, however, have graphics for easy identification of the
product and for illustrating methods of preparation.
d) The term “humanized,” “maternalized” or similar terms shall not be used.
e) Food products within the scope of this Code marketed for infant feeding, which do
not meet all the requirements of an infant formula but which can be modified to do so,
shall carry on the label a warning that the unmodified product should not be the sole
source of nourishment of an infant.
f) The labels of fool products within the scope of this Code shall, in addition to the
requirements in the preceding paragraphs, conform with the rules and regulations of
the Bureau of Food and Drugs

SECTION 11 Quality –
a) The quality of products is an essential element for the protection of the health of
infants, and therefore shall be of high recognized standard.
b) Food products within the scope of this Code shall, when sold or otherwise distributed,
meet applicable standards recommended by the Codex Alimentarius Commission and
also the Codex Code of Hygienic Practice for Foods for Infants and Children.
c) To prevent quality deterioration, adulteration or contamination of food products
within the scope of this Code shall, when sold or otherwise distributed, meet
applicable standards recommended by the Codex Alimentarius Commission and also
the Codex Code of Hygienic Practice for Foods for Infants and Children.

SECTION 12 Implementation and Monitoring –


a) For purposes of Section 6(a) of this Code, an inter-agency committee composed of the
following members is hereby created:

The members may designate their duly authorized representative to every meeting of
the Committee. The Committee shall have the following powers and functions:
1) To review and examine all advertising, promotion or other marketing
materials, whether written, audio or visual, on products within the scope of
this Code;
2) To approve and disapprove, delete objectionable portions from and prohibit
the printing, publication, distribution, exhibition and broadcast of, all
advertising promotion or other marketing materials, whether written, audio or
visual, on products within the scope of this Code;
3) To prescribe the internal and operational procedure for the exercise of its
powers and functions as well as the performance of its duties and
responsibilities, and
4) To promulgate such rules and regulations as are necessary or proper for the
implementation of Section 6(a) of this Code.
b) The Ministry of Health shall be principally responsible for the implementation and
enforcement of the provisions of this Code. For this purpose, the Ministry of Health
shall have the following powers and functions:
1) To promulgate such rules and regulations as are necessary or proper for the
implementation of this Code and the accomplishment of its purposes and
objectives.
2) To call the assistance of government agencies and the private sector to ensure
the implementation and enforcement of, and strict compliance with, the
provisions of this Code and the rules and regulations promulgated in
accordance herewith.
3) To cause the prosecution of the violators of this Code and other pertinent laws
on products covered by this Code.
4) To exercise such other powers and functions as may be necessary for or
incidental to the attainment of the purposes and objectives of this Code.

SECTION 13 Sanctions –
a) Any person who violates the provisions of this Code or the rules and regulations
issued pursuant to this Code shall, upon conviction, be punished by a penalty of two
(2) months to one (1) year imprisonment or a fine of not less than One Thousand
Pesos (1,000.00) nor more than Thirty Thousand Pesos (P30,000.00) nor more than
Thirty Thousand (30,000.00) or both. should the offense be committed by a juridical

person, the Chairman of the Board of Directors, the president, general manager, or the
partners and/or the persons directly responsible therefore, shall be penalized
b) Any license, permit or authority issued by any government agency to any health
worker, distributor, manufacturer, or marketing firm or personnel for the practice of
their professional or occupation, or for the pursuit of their business, may, upon
recommendation of the Ministry of Health, be suspended or revoked in the event of
repeated violations of this Code, or of the rules and regulations issued pursuant to this
Code.

SECTION 14 Repealing Clause – All laws, orders, issuances, and rules and regulations or
parts thereof inconsistent with this Executive Order are hereby repealed or modified
accordingly.

SECTION 15 Separability Clause - The provisions of this Executive Order are hereby
deemed separable. If any provision thereof be declared invalid or unconstitutional, such
invalidity or unconstitutionality shall not affect the other provisions which shall remain in full
force and effect.

SECTION 16 EFFECTIVITY – This order shall take effect immediately.
