AGREEMENT BETWEEN OWNER AND CONTRACTOR FOR CONSTRUCTION OF

HOUSE, AT RAMA DEVI KANPUR

THIS AGREEMENT made on this..05 FEBRUARY day of 2023

BETWEEN
SONALI SINGH D/O SATISH KUMAR AND W/O NEERAJ KUMAR hereinafter referred to
as "the Owner" of the one part
AND
TANMAY OMER hereinafter referred to as "the Contractor" (which expression shall unless
repugnant to the context or meaning thereof include its authorized representatives, successors and
assigns) of the other part.

WHEREAS

1. The Owner is seized and possessed of plot of land situated at ARAZI-180 PLOT- 47
BAPU NAGAR MAVAIYA KANPUR NAGAR-208007
2. The Contractor is engaged in construction activities for a long time and having good
experience in construction of Building/ Flat/Bungalow.
3. The Owner is willing to construct a One 1 storied house (hereinafterreferred to as the
said works) on the said plot of land as per sites plan prepared by Shyam and
Associates and approved by Er. S.S. Kushwaha, the copies thereof are annexed to this
agreement.

4. The Contractor has agreed to construct the said works as per the said sites plans on the
terms and conditions herein after appearing
NOW IT IS HEREBY AGREED AND DECIDED BETWEEN BOTH THE PARTIES AS
FOLLOWS:
1- All Material Commercial Range
2- GST will be extra.
3- Wall tile only in bathroom at door level at any place wall tile fixing then pay extra.
4- A.C. Plumbing Extra & Electrical not included in this Cost.
5- Only Provide Switch & Sockets, Wiring. Fan & Light Fitting provide at Extra Cost
6- Covered area outside the work pay extra.
7- Repairing Work Extra
8- Dismantling Extra
9- Basic Rate of Cement 285/- Per Bag & Steel -60/-per Kg Pay Tax Extra
10- Architect drawing will be provided by owner 5 days before the starting of the work as signed by
the owner for confirmation. Major changes if any will be charged extra.
11- All the material will be purchases by contractor inclusive of all government taxes (GST)
Government tax on billing by the builder will be paid by the owner.
12- All government permission and basement excavation earth filling in plinth area arranged by
owner.
13- Water supply & electricity main point to be provided by owner supply or D G supply with diesel
free of cost, the cost of diesel also as per actual.
1-Adavance Payment 50,000/- at Start of Work will be deducted at Payment Received.

CEMENT GST 28% STEEL GST 18% BRICK GST 12% AND ALL OTHER TAXES
PAID BY OWNER HER SELF ON BILL TO BILL BAISES.
SPECIFICATIONS AND CONDITIONS (INCLUDING ITEMS)

1. Total R.C.C. work 1: 1 ½: :3 (M-20)/(M-25).

2. STRUCTURE: Earthquake resistant RCC frame designed by Structural engineer ( as per ISI
code).
3. BRICK WORK: 1:4 with 4 ½ :” thick inner walls.1:6 with 9: inch thick wall.(as per Dwaring)

4. PLASTER WORK: 1:6 with 4 ½:” thick inner walls.

5. CHAUKHAT /WINDOW: Frame with Rjjak or equivalent wood work (2 ½”x5”) in Chaukhats.
Windows shutter will be built with teak wood or equivalent wood enamel paint aluminum fitting
(ISI marked) 3 ½ M M ISI marked glass.

6. DOOR PANNEL: Doors will be of ISI mark board both side pasted with 0.8 mm mica Flush
Door and Window Pannel wood /UPVC work with aluminum fitting and enamel paints.

7. FLOOR WORK: 2’X2’ Vitrified Tiles of Kajaria Johnson or equivalent approx @45/- per
sqr.ft. and Digital wall tiles approx. @ 40/- per Sqr.ft. Kitchen Granite @ 130 Sqr.ft.

8. PLUMBING WORK: CPVC/UPVC Prince Vectus, Parryware and C,P. fitting Hindware,
Jaguar, ISI brand commercial and SW pipe 4” or 6” of Supreme brand.

9. SAINITARY FITTING: Hindware, Parryware,Jaguar (Commercial range)

10. TOILETS: Good quality of ceramic tiles upto 7 FEET height seat wash basin & low level
cistern shall be of ISI quality fitting shall be of CP brass. (Hindware/Jaguar) Provisional will be
made for Geyser fitting.

11. WATTER PROOFING: In down Slab of bathroom & Kitchen and outer side basement wall.

12. ELECTRIC WORK: Good quality concealed conduit wiring with copper twisted wire switches
& Sockets of Havells/legrand or equivalent Adequate numbers of all circuits protected by MCB’s
TV in all rooms exhaust fan/geyser points in each toilet & kitchen of Havells/Legrand or
equivalent.

13. PAINTING WORK: wall and ceiling punning/putty primer and two coat snowcem/Oil bound.
outer putty with 2 coat Apex Paint. (Asian Berger)

14. STEEL WORK : as per architect design with local steel (Amba,Shakti, Kamdhenu, Rimzim etc
FE500)

15. CEMENT (PPC) : Birla, BANGUR, JP, Shree etc.(or Other any higher Brand)

16. GRILL:10 MM Sqr. bar only outer side.

17. RAILLING:SS in Stairs and MS in Balcony with enamel paint.

18. STAIRS FLOORING: Thread Granite & Riser with white marble. Equivalent Granite.

19. INTERNAL FINISHING: Wall will be finished with JK/Birla or equivalent putty will be
painted with plastic paint. Doors & Windows will be painted with enamel paint.

20. EXTERNAL FINISHING: Normal elevation with apex paint finish.


21. SLAB THICKNESS: 5 inch (125 MM)

22. CELLING HEIGHT:11.5 FIT

23. TOILET TILE: Tile fixing in toilet till celling height.

24. COMPLETING OF PROJECT: Completing the whole project within 100 to 120 Days.

1. Payment -Advance Payment 50,000/- at Start of Work will be deducted at Payment


Received.
The Owner shall reimburse the Contractor all the expenses incurred by him in connection
with the completion of the said works on actual basis at regular intervals and shall pay to
the Contractor a sum of within months after the Contractor has completed the
construction of the said works in accordance with the terms of this agreement and handed
over the same to the Owner.
2. Owners right of Inspection
The Contractor will permit the Owner to have access to the said works while the same are
under construction and to inspect the same.
3. Variation
If, in the opinion of the Contractor, any variation or deviation from the said sites plan is
necessary in order to satisfactory completion of the said works, the Contractor shall do so
only with the prior permission in writing of the Owner.
4. Account of Materials
The Contractor shall keep full and regular account of all the materials purchased, brought
on the site, consumed and balance lying on the site which shall be open to inspection of
Owner at all reasonable times. All materials or plants used or to be used in construction
shall remain at the contractor's risk and he shall not be entitled to any compensation for
injury to, or loss or destruction of such works or materials arising from any cause,
whatsoever.
5. Defect
If any defects, shrinkage or other faults appear in the works within six months after their
completion, it shall be the duty of Contractor to make good the loss.

6. Extension of Time
If due to certain unforeseen/uncontrollable circumstances, the Contractor requires any
extension of time for completing the works, he shall immediately make known the same
to the Owner and the Owner may, if he thinks such request reasonable, grant such
extension of time as he may think necessary.
7. Determination of Contract by Owners
If the Owner is not satisfied with the progress of the work or with the quality of materials
used or of the workmanship or violates any provisions of this Agreement, he may call
upon the architect to make a report on the progress of the work. If the architect in his
report also certifies that progress is not satisfactory, the Owner may, after giving 1 5
days’ notice, terminate the contract. In such an event, the Owner may then enter upon the
site of the works and may employ another Contractor to complete the same and may pay
such contractor the cost of such completion out of the sum payable to the Contractor
under this agreement or any other sum as agreed to between the Owner and the new
contractor.
8. Arbitration
Every dispute, difference, or question which may, at any time, arise between the parties
hereto or any person claiming under them, in respect of any clause of this agreement or in
respect of work done or quality of materials used or in respect of any delay in completion
of works, shall be first referred to the architect who shall state his decision in writing. If
any party is not satisfied with the decision of the architect, it may give a notice in writing
to the other party that the matter in dispute be referred to the arbitration of an arbitrator to
be agreed upon and appointed by both the parties. If he shall be unable or unwilling to
act, to another arbitrator to be agreed upon between the parties or failing agreement, to
three arbitrators one to be appointed by each party to the dispute or difference and the
two appointed arbitrators shall appoint the third arbitrator who shall act as the presiding
arbitrator and the decision of the arbitrator (or, arbitrators) shall be final and binding on
the parties. Subject as aforesaid the Arbitration and Conciliation Act, 1996 and the rules

made thereunder shall apply to the arbitration proceedings under this clause. The decision
so given by the Arbitrator(s) shall be final and binding upon the parties.
9. Indemnity
The Contractor shall keep indemnified the Owner from all claims, demands or actions
that may be raised against the Owner by reason of anything done by the Contractor in the
course of execution of works under this Agreement.
IN WITNESS WHEREOF, the parties hereto have signed this agreement and has caused the
common seal to be affixed on the agreement in the manner hereinafter appearing on the day and
year first here-in-above written.
