    2nd APPLICATION FOR GRANT OF REGULAR


    BAIL UNDER SECTION 437 OF Cr.P.C.

    R/Sir
    The applicant/accused most humbly and respectfully
    submitS as under: -
    1. That the above noted case is pending before this Hon'ble
    Court and the same is fixed for 10.04.2024.
    2. That the applicant/accused has been falsely implicated
    by the Police of P.S. Kharkhoda, Sonepat in the above
    noted case on the basis of the false story concocted made
    by the complainant. whereas, the applicant/accused has
    committed no offence.
    3. That the contents of FIR are full of malafide, false
    contents and unsustainable in the eyes of law and the
    applicant/ accused has been wrongly, illegally and
    falsely framed and victimized in the impugned FIR merely
    on the basis of disclousure statement of the co-accused,
    which is has no mean in the eyes of law and is a grave
    misuse of process of law.
    4. That no recovery has been affected from the possession
    of the applicant/accused and if any recovery has been
    effected from the possession of the applicant/accused
    same is planted one.

    5. That the applicant/accused is in judicial custody since


    his arrest i.e. 15.12.2023. It is pertinent to mention here
    that the investigation of the case has already been
    completed and the police of P.S. Kharkhoda has
    submitted it final report U/s 173 of Cr.P.C. and the trail
    of case will take long time and no useful purpose will be
    served by keeping the applicant/accused behind the
    bars.
    6. That the first bail application U/s 437 Cr.P.C. of the
    applicant/accused has been dismissed by this Hon'ble
    Court vide order dated 06.01.2024, thereafter, bail
    applications U/s 439 Cr.P.C. was dismissed vide order
    dated 24.01.2024 and again dismissed as withdrawn
    vide order dated 01.03.2024 by the Hon'ble Court of Sh.
    Narender Kumar, Ld. ASJ, Sonepat.
    7. That the applicant/accused has fixed abode of living
    and there is no apprehension of his absconding or
    tempering with the prosecution evidence.
    8. That the applicant/accused is ready to furnish the bail
    bond and surety bond to the satisfaction of this Hon’ble
    court and also ready to abide by any condition, which
    may be imposed by this Hon'ble Court.
    It is, therefore, humbly prayed that the
    applicant/accused may kindly be admitted to bail in the
    above noted case till the decision of the case, in the
    interest of justice.
