of paper publication in Kannada daily newspaper “HOSADIGANTHA”, in

the circumstances of the case and in the interest of justice and equity.

MEMORANDUM OF FCATS

I, Sujnaneshwari Shetty, Advocate, No: 33, Sriram Complex,

Doddakallasandra, Kanakapura Main Road, Bangalore-560062, do

hereby solemnly affirm and state as follows:-

1. I state that I am the advocate for complainant in the above

complaint I am aware of the facts and circumstances of the case.

Hence this memorandum of facts.

2. I submit that the above complaint is filed against the opposite

parties for deficiencies of services rendered by them; I submit that

the notice from this Hon’ble court has been served on opposite

parties; however, the opposite parties are intentionally avoiding

service of notice on him from this Hon’ble court. As per petitioner

knowledge the opposite parties, are having their offices at the same

address as mentioned in the cause title and it is the last known

address to Opposite parties.

3. I submit that the opposite parties are intentionally avoiding notice

from this Hon’ble court and it is very much necessary to permit me

to take steps against the opposite in Kannada daily newspaper

“Hosa Digantha”, to proceed with the matter in the interest of

justice and equity.

4. I submit that if the application is allowed the opposite parties will

not be put to any harm or injury whereas if publication is not

taken then I shall be put to a lot of hardship and injury which

cannot be compensated in any manner whatsoever.

WHEREFORE, it is prayed that this Hon’ble court be pleased to

allow the accompanying application as prayed for, in the interest of

justice and equity.
