***MEDIA ADVISORY*** Carl DeMaio Voted TWICE to Deny Benefits to the Widows and Children of Fallen Officers Then Lied About It to the Media
The San Diego Police Officers Association recently released a commercial informing voters of mayoral candidate Carl DeMaios vote on benefits for the widows and children of fallen police officers. In news coverage of DeMaios claims that the ads were false, the mayoral candidate stated that he never voted against benefits for widows and orphans. The record is very clear. I have always supported survivor benefits. I have never voted against survivor benefits, DeMaio told 10 News at 40-second mark in this story: http://www.youtube.com/watch?v=DGKP2AAxgDc&feature=youtu.be In fact, DeMaio voted no on providing these survivor benefits not once but twice. What follows is all the information you need to report with confidence that DeMaio did, in fact, vote against granting health benefits to the widows and children of fallen officers, and that he also plainly lied about this to numerous news outlets.

DEMAIOS FIRST VOTE AGAINST DEATH BENEFITS:

In the city of San Diegos two-year labor contract with the Police Officers Association covering fiscal years 2011 and 2012, the police officers negotiated for the first time ever that the city would pay for health care benefits for the widow and dependent children of fallen officers. In this contract, the city also granted a $5,000 payment to the family of fallen officers. Prior to this agreement, widows and children did not receive city-paid health care or additional payment. The full labor contract that includes the new benefits for widows is here: http://dockets.sandiego.gov/sirepub/cache/2/yqgoyxmrc4cbor55r2m1hi2h/21271506022012083750124.PDF On page 84 of this labor contract, the death benefits for widows and children were enhanced. The bold in the document indicates a change from prior years. Again, prior to this labor contract, the dependents of police officers killed in the line of duty did not receive city-paid health care or the additional discretionary $5,000.

Here is an excerpt from the official minutes of the City Council meeting. As you can see, Carl DeMaio was the only NAY vote for this contract (vote highlighted in yellow, below).

ITEM-201: Approve and Ratify the Memorandum of Understanding Between the City of San Diego, and San Diego Police Officers Association (SDPOA), for Fiscal Years 2011 and 2012. COUNCIL ACTION: Start Time: 2:24 PM MOTION BY KEVIN FAULCONER TO ADOPT. Second by Ben Hueso. Passed by the following vote: Yea: Sherri Lightner, Kevin Faulconer, Todd Gloria, Tony Young, Donna Frye, Marti Emerald, Ben Hueso; Nay: Carl DeMaio; Recused: (None); Not Present: (None).

DEMAIOS SECOND VOTE AGAINST DEATH BENEFITS:

The second vote came on June 27, 2011, when the city of San Diegos Labor Relations department brought to the City Council an item to codify the new death benefits in the municipal code beyond the two-year labor agreement in which they were initially approved. In that meeting, Councilmember Marti Emerald pointedly asked Labor Relations Director Scott Chadwick whether the vote on the item was to provide death benefits to the survivors of officers killed in the line of duty. Chadwick affirmed that it was.

See the exchange between Emerald and Chadwick at 40:45 in the following video: http://granicus.sandiego.gov/MediaPlayer.php?view_id=3&clip_id=4815 Here is an excerpt from the official minutes of that meeting, with Carl DeMaios vote highlighted in yellow:

ITEM-S400: An Ordinance amending the San Diego Municipal Code by amending Sections in Chapter 2, Article 4, relating to the City Employees Retirement System and adding Chapter 2, Article 9, relating to other Post-Employment Benefits.

COUNCIL ACTION: Start Time: 2:37 PM MOTION BY MARTI EMERALD TO INTRODUCE. Second by Tony Young. Passed by the following vote: Yea: Sherri Lightner, Kevin Faulconer, Todd Gloria, Tony Young, Marti Emerald, David Alvarez; Nay: Carl DeMaio, Lorie Zapf; Recused: (None); Not Present: (None).
These public records should resolve any question of whether DeMaio voted against providing death benefits to the widows and dependent children of police officers killed in the line of duty. It also proves definitively that DeMaio blatantly lied, on camera, when he called the POAs ad false. Given that DeMaio is commonly presumed to be the front-running candidate in the San Diego mayors race, we believe his false denial of a vote he took in his official capacity as a councilmember bears reporting by the San Diego news media.
