MEDICAL ETIQUITTE
• Refers to conventional laws of courtesy observed between members
of medical profession.
• Code of Medical Practitioner:
Earliest – Hippocratic oath
Modern – International code of Medical Ethics
India – MCI in 2002 devised Medical Ethics code for all the Doctors registered
with Medical Council of India ( Now NMC)/State Medical Council.
 Not governed by any legislation
 Violation of code by any RMP is liable to Professional misconduct if proved he/she is
temporarily or permanently debarred from practicing.

• Chapter 1: Code of Medical Ethics
• Chapter 2: Duties of Physician to their patients
• Chapter 3: Duties of Physician in consultation
• Chapter 4: Responsibilities of physician to each other
• Chapter 5: Duties of Physician to the public and to para-medical
profession
• Chapter 6: Unethical acts
• Chapter 7: Misconduct
• Chapter 8: Punishment and disciplinary action
DUTIES OF RMP TOWARDS PATIENTS
1. Exercise reasonable degree of skill and knowledge
2. Attend the patient and examine him
3. Furnish or prescribe proper medication
4. Give proper instruction
5. Third parties (insurance claim, blue cross etc)
6. Relation to operation
7. Relation to poisoning cases
8. Professional secrecy
9. Relation to X-ray examination

1. Not to criticize colleague
2. Never take fees
3. Always help
4. Duties with regard to consultation
DUTIES OF RMP TOWARDS STATE
1. NOTIFY CERTAIN DISEASES
2. INFORM VITAL EVENTS
3. UNDER GENEVA CONVENTION
4. REGARDING MEDICOLEGAL CASES
DUTIES OF PATIENTS
1. Furnish all information
2. Follow instructions given by doctors
3. Pay fees to the doctor
4. If patient wishes for second consultation/opinion, the patient
should inform the first doctor
5. Patient should have faith in doctor
6. Patient should no contribute to medical negligence
7. Should cooperate for necessary investigations for proper diagnosis
RIGHTS AND PREVILEGES OF RMP
1. Practice medicine
2. Choose patient
3. Prescribe/dispense medicine
4. To Possess, dispense or prescribe drugs listed in the Dangerous Drug Act
5. Add professional titles to his name
6. To perform surgical operations
7. To issue certificates
8. Appointment to public hospitals
9. To give evidence as expert witness in the court of law
10. To claim payments of fees for professional services

PATIENTS
1. Choose doctors
2. Access health care facilities

7. To know information about procedures, its risks, results and prognosis

PROFESSIONAL SECRETS AND
CONFIDENTIALITY
1. Doctor comes to know in his professional capacity
2. It should not be divulged under any circumstances except
a) In a court of law
b) Privileged communication to appropriate authority in the interest of the
community or of the state
c) Notifiable diseases
THERAPEUTIC PREVILEGE
1. If the patient is anxious or anxiety prone or the information may
cause psychological harm to the patient RMP can choose not to
disclose diagnosis or information related to the disease.
2. Under such circumstance RMP can disclose the information to the
family/guardian
PROFESSIONAL MISCONDUCT
• Professional misconduct can be defined as something done by a
doctor in profession, which is considered as disgraceful and
dishonorable by his or her professional brethren of good repute and
competence, after the enquiry by the State Medical Council.
PUNISHMENTS
• Under disciplinary control the State/Indian Medical Council decides
this and depending on the type of misconduct.
• punishment can be:
Warning
Suspension
Penal erasure (professional death sentence).

1. Association with unqualified persons
2. Advertising
3. Adultery
4. Abortion (illegal)
5. Addiction
6. Alcohol

Apart from these, the councils can also consider any other form of alleged
infamous conduct, which is not in the above list for deciding the punishment.
