CONSUMER PROTECTION ACT, 1986

Consumer protection means protection of consumers from their exploitation against the unfair trade practices of producer or seller. For the protection of consumers Consumer Protection ct, 1986 was passed by both the chambers of parliament and got the consent of then president Giani Zail Singh in Dec 1986. However it was enforced with effect from April15,1987. The last amendment in this Act was made in 2002.

Scope or extent of the Act

This Act is applicable to whole of Indian except the state of Jammu & Kashmir. This Act shall apply to all goods and services that comes under the scope of this Act. Provisions of this Act are in addition to the provisions made previously in the context of the consumers.

OBJECTIVES OF CONSUMER PROTECTION ACT, 1986

Better protection of the right and interest of the consumers.


Establishment of consumer protection councils. Establishment of consumer disputes redressal agencies. Easy and speed up grievances solutions.

IMPORTANCE OF CONSUMER PROTECTION ACT, 1986

Business is a means of human welfare : Business serves the customer and thus not an end itself. To serve well is in the interest of both the consumer as well as business person. Ignoring the interest of consumer may be a sure death of business. Growth with social justice : India is a socialist secular democratic republic and growth with social justice is the corner stone of our economic philosophy. Exploitation of consumer is against the directive principle of state policy laid down in the constitution.

Self centre : After globalization and liberalization, it is the interest of firm to produce quality goods and maintain its reputation as corporate citizen. Moreover govt. has enacted laws to protect consumers. Business person who violates the laws is likely loose their goodwill and clients all time to come.

Impact of other countries : In countries like USA, European Unions, Australia etc consumer measures are strigent and effective. Following their example, India has also felt the necessity of consumer protection.

Consumer organizations : -

There exist more than 500 consumer organizations across the country. These have contributed to spread and protect the interest of consumers. Some of these are Common cause, New Delhi Consumer action forum, Delhi, Madras Lok Adalats : The concept of Adalat in India is catching up fast. Lok Adalat have become a part of speedy, effective, economical redressal system. Lakhs of cases concerning to accidents, DDA, MTNL, DESU have settled. The concept of Lok Adalat is now extended to other areas as well.

Consumer awareness : -

With the spread of education people now are wide aware of their rights as a consumer. The relief granted to consumers and important judicial decisions are often covered by newspapers. Consumers are now expect better services for their durable goods. Legislative measures in respect of consumer protection have created an awareness among consumers about their rights and remedies available to them.

National award on consumer protection : Government of India has been conferring award since 1988 on individual as well as consumer organizations in their contribution to the consumer care. As a result peoples interest in consumer protection has been stimulated.

CONSUMER PROTECTION COUNCILS

To promote the interest of consumers and to advise the government in this respect there is the provision in the Act to set up consumer protection councils at the following 3 levels in the country central consumer protection council at central level State consumer protection council at state level District consumer protection council at district level

District forum (up to 50 lakh)

State commission(50 lakh to 1 crore)

National commission (more than 1 crore)

SUMMARY

Hence enactment of Consumer Protection Act,1986 is an one of the most importance step taken to protect the interest of consumers. Establishment of consumer protection councils is its cornerstone. Although the various efforts are being taken both by government and non-government organizations but exploitation of consumers will not be stopped till consumers will forward to safeguard their interest first.
