Burr Ridge May Settle With Code Violator: Village

The homeowner continued a construction project, despite a stop work order, according to public records.

BURR RIDGE, IL – Burr Ridge trustees are set to decide Monday on settling with a resident who started a home construction project without a building permit last year, the village says.

Last August, the village ordered Curtis Eshghy to stop the project, but the work continued, according to public records. His house is on 89th Street, east of Madison Street.

Patch left a message for comment Wednesday with Eshghy, the CEO of C&N Construction in Hillside.

At a recent hearing, the village's hearing officer found Eshghy liable for code violations, prompting him to appeal the finding in DuPage County Court, the village said.

Both sides agreed the violations have been resolved, according to the Village Board's meeting packet for Monday.

Under the settlement, Eshghy would accept the finding of liability, withdraw the lawsuit and pay the village $10,000 to resolve the matter, the village said.

The village said $10,000 is what it would have ultimately received if the court upheld the hearing officer's ruling, taking into account legal costs.

Burr Ridge retains the right to continue code enforcement should Eshghy commit violations again, the village said.

Also at the meeting, the board plans to vote on making two exceptions to the zoning code for Eshghy.

Eshghy's project included a pool, hot tub, patio, fence, landscape berm and paver walkway, according to Burr Ridge records.

At a meeting last month, the village's attorney said a homeowner can be charged a $700 fee for every day that an owner violates a stop work order.
