Developer Returns For New Spy Pond Lane Proposal

ARLINGTON, MA – A developer is giving his proposed development of a Spy Pond Lane property another shot, two years after he was shot down by the Arlington Conservation Commission. Scott Seaver presented a new proposal for 47 Spy Pond Lane at a meeting Thursday night.

The proposed development calls for dividing the single-family property into two homes, one 2,000 square feet and the other 1,634 square feet, according to the Arlington Advocate. He initially sought approval for a 2,000-square-foot home and 1,950-square-foot home in 2016.

The conservation commission rejected the original proposal due to its potential to harm the area's resources protected by town bylaw, and Seaver appealed to the MassDEP, which the town counsel argued did not have jurisdiction over the bylaw, the Advocate reported. After a subsequent notice of intent was rejected earlier this year, Seaver filed a lawsuit in superior court, which the conservation commission settled.

The commission on Thursday decided to continue the hearing to Nov. 1 and requested additional information on alternative home designs.
