On May 15, 2024, the Office of the Data Protection Commissioner delivered a decision regarding the post-employment use of videos featuring former employees. Here's why this decision deserves a closer look: 𝐂𝐚𝐬𝐞 𝐁𝐚𝐜𝐤𝐠𝐫𝐨𝐮𝐧𝐝 The complainant alleged unauthorized use of his image in a video post-resignation. Initially created for marketing purposes during his employment, the video continued to be used by the employer even after his resignation. ⚖️ 𝑻𝒉𝒆 𝑫𝒆𝒄𝒊𝒔𝒊𝒐𝒏 The ODPC determined that the employer failed to obtain the complainant’s consent for continued use of their image after separation from employment. Consequently, this was deemed commercial exploitation of the complainant's image and awarded KES 500,000 to the complainant. 🚩 𝑷𝒓𝒐𝒃𝒍𝒆𝒎𝒔 𝒘𝒊𝒕𝒉 𝒕𝒉𝒆 𝑫𝒆𝒄𝒊𝒔𝒊𝒐𝒏 While the decision rightfully focuses on data subjects’ rights, it failed to take into account the employment context under the "𝒘𝒐𝒓𝒌 𝒅𝒐𝒏𝒆 𝒇𝒐𝒓 𝒉𝒊𝒓𝒆" principle in this particular case.Had the ODPC considered the following aspects, a different conclusion might have been reached: 🔑 𝙒𝙤𝙧𝙠 𝘿𝙤𝙣𝙚 𝙛𝙤𝙧 𝙃𝙞𝙧𝙚 𝘾𝙤𝙣𝙘𝙚𝙥𝙩 This principle dictates that work created within the scope of employment belongs to the employer, unless otherwise agreed. Employees' legal recourse depends on whether the usage of their image or video aligns with 𝐩𝐫𝐢𝐨𝐫 𝐜𝐨𝐧𝐬𝐞𝐧𝐭 𝐚𝐧𝐝 𝐣𝐨𝐛 𝐞𝐱𝐩𝐞𝐜𝐭𝐚𝐭𝐢𝐨𝐧𝐬. This balance is key to protect employees' rights as data subjects while respecting employers' business needs and practicalities. Employees who consented to their video or image being used while employed can request removal after leaving by sending a cease and desist letter. This process respects their rights to control their personal data, ensuring their privacy is maintained. 📘Every case tells a story. As with last year, the final report will include actual compensation information, as reported by you, as well as an aggregation of open positions that include base salary ranges (#paytransparency ❤️). Here are 7 open head of #legalops roles with base salary ranges, listed in alphabetical order. Some great companies here: ⚡️ Manager, Legal Operations at Asana: $196k–$265k (shout out Mina Sen) ⚡️ Vice President, Head of Legal & Compliance Operations at Prudential Financial: $202k–$273k ⚡️ Senior Director, Legal Operations at Rocket Software: $206k–$258k ⚡️ Director, Legal Operations at Sony Music Entertainment: $95k–$125k ⚡️ Director, Legal Operations at The New York Times: $130k–$165k (shout out Diane Brayton) ⚡️ Director, Legal Operations at The Orchard: $95k–$125k ⚡️ Director, Legal Business Operations at The Walt Disney Company: $164k–$219k Some observations on the data: 💵 The base salary ranges are consistently narrow (1.3:1 high:low ratio). This is in stark contrast to non-head of legal ops openings, where it's closer to 1.5:1 and often much higher. 📊 There's quite a bit of variability: as low as $95k for a head of legal ops to as high as $265k. This *largely* tracks legal department size, something our survey has seen each year. 📉 This is a small and early sample, but base salaries do seem to be down for newly-opened positions.
