Broken English Designs LLC (β€œBroken English,” β€œwe,” β€œus,” β€œour”) provides our customers (β€œyou,” "your") with a unique shopping experience featuring uniquely designed jewelry. The items on the Broken English website, accessible from www.brokenenglishjewelry.com (the β€œwebsite”), were designed and fabricated by artists, meeting Broken English's criteria of originality and quality of workmanship. Each piece is individually made, and production schedules attempt, as much as possible, to accommodate customers' delivery requests. However, orders not in stock are subject to the availability of raw materials, production, and delivery schedules. Also, all of the jewelry is manufactured in a studio setting and features subtle variations in detail and finish from items photographed on our website.



SALES TAX


We are a California and New York business. Sales tax will be applied if you live in California, New York, or as otherwise required by law.



RETURN POLICY


If you are dissatisfied with any item that you purchased online or wish to exchange it, you may return it to Broken English Designs LLC under the following conditions, which are strictly observed:

  • How to Initiate a Return

    • Contact Customer Service within 24 hours of Delivery: To initiate a return, you must first contact customer service at [email protected] within 24 hours of delivery of your order to determine eligibility and approval for a return or exchange.
    • Shipping Label: If the item(s) wish to return are eligible for return or exchange, you will be emailed a shipping label to return your item(s). Returned items sent to us with a label other than the label provided by us will not be accepted.
    • Items Not Approved for Return: Unapproved items for return will not be accepted for return under any circumstances.

  • Exchange Requests for Returning Items Purchased on our Website: Items purchased on our website may only be returned for online credit and cannot be returned to our store locations for credit. Exchange requests for credit will be issued in the form of online credit. Credit will not be valid for use in-store. Exchange requests must be received within 7 business days of delivery of your order.

  • Exchange Requests for Returning Items Purchased from our Store: Items purchased from our store may only be returned for store credit and cannot be returned for online credit.

  • Condition of Returned Items: Returned item(s) must be without wear and in pristine condition.

  • Packaging: Returned item(s) must be returned in their original packaging.

  • Returning Special Orders: In the event that an item is not in stock or an item has to be made specifically for a particular customer, that item is designated as a special order. In the event of an item not being in stock after ordering, we will notify the customer via email. The customer can then choose to cancel their purchase for a refund to the original form of payment within 24 hours of receipt notification.

    Otherwise, all special order sales and sale items are final sales and are not subject to return, including any alterations and/or modifications requested by the customer. Please see β€œSpecial Orders & Limited Inventory” section in this Terms of Use for more information on special orders.
  • Shipping Costs on Returned Items: All applicable shipping charges will be deducted from any applicable credits and refunds.

  • Original Payment: Please note that all refunds will be in the original form of payment.

REPAIRS


In the unlikely event that an item purchased arrives damaged in any way, or should an item purchased online or through our store need reparation over time, we are happy to facilitate the necessary repairs. Please send a photo of the damaged item to [email protected]. We will work with our designers or our local experts and give you an estimated timeline for the repair. We will also let you know in advance any fees and shipping charges that may be associated with the repair.


LOST OR STOLEN MERCHANDISE


We require a signature upon delivery for all packages sent with insurance. Any items that are lost or stolen before signature are insured and are eligible for replacement or store credit until the package is signed. After signature, we are no longer liable for lost or stolen merchandise. In the event that you waive the signature requirement, the sale is deemed final, and we are not liable or responsible for replacing lost or stolen merchandise.



SPECIAL ORDERS & LIMITED INVENTORY


We try to maintain our website with currently featured items available in inventory. However, due to the unique, handcrafted nature of our jewelry, this is not always possible. In fact, often, our inventory is one-of-a-kind and limited in availability. If the piece you are interested in is out of stock, we will contact you via email with an estimated shipping date, and you can choose to cancel your order within 24 hours of receipt of such notice. If you choose to go forward with your order, it will be a final sale, and the above return policy pertaining to special orders will apply to your purchase. The return policy pertaining to special orders also applies to any altered or changed jewelry pursuant to your request.

SHIPPING OPTIONS
  • Standard shipping rates will apply for all orders totaling $249 or less.
  • Free Ground Shipping on orders in the US for orders totaling $250-$1,000.
  • Free 2nd Day Shipping on Orders in the US for orders over $1,000.
  • Free Next Day Shipping on Orders in the US for orders over $5,000.
  • International Shipping flat rate of $100, some additions may apply.
  • Non-jewelry and most items under $100, USPS shipping rates calculated at checkout.


If you would like to upgrade your shipping options, please contact our Client Care Team within 24 hours of your order at [email protected]. Additional shipping costs may apply with your upgrade(s).

All orders are subject to merchandise being held in stock and will be processed, if possible, within 1-3 days of receipt of the customer's order. All shipments are subject to payment in full by the customer.

Additions:

  • We do not mail to PO Boxes.
  • We require a signature on all packages sent with insurance attached at the time of delivery. (i.e., not on USPS packages or non-insured packages).
  • The signature can be waived upon request by the customer only; we cannot be responsible for this action by the customer.
  • The signature required at delivery is for insurance purposes. If you choose to waive the signature, you accept full responsibility should loss, theft, or damage occur during shipping. All waived signature purchases will be deemed final and are not subject to the Return Policy listed above.

INTERNATIONAL ORDERS


We are happy to ship worldwide. We are not responsible for any duties or taxes incurred by the country we ship to. We offer flat rate international shipping for $100 on most orders; however, there could be the rare occasion that the cost of shipping could be more than the standard flat rate.

For refunds on international orders, all applicable shipping charges will be deducted from any applicable credits and refunds.



CREDIT INFORMATION SHARING


We do not share customers' credit card information with any third parties or vendors.
