Airport Noise Notification Rule To Be Partially Suspended In Loudoun County

Due to a new state law taking effort, Loudoun County will suspend notifying homebuyers who aren't first owners of new properties.

LOUDOUN COUNTY, VA — In preparation for a new Virginia law, the Loudoun County Board of Supervisors acted last week to partially suspend notification requirements to homebuyers affected by Dulles International Airport noise.

A new state law taking effect on July 1 stops localities from enforcing mandatory disclosures on airport noise after the initial deed is recorded. That means the disclosure cannot be required for homebuyers who are buying previously owned properties.

Loudoun County has an Airport Impact Overlay District specifying where properties experience airport noise at a particular level. Loudoun County has required developers of properties within the overlay district to disclose airport noise to homebuyers for many years. In January 2023, that guidance was updated to add "every subsequent owner" to the notifications.

However, the new state law means Loudoun County cannot require the notification to subsequent owners. The county will still be able to enforce the disclosure requirements to first owners of brand-new properties within the overlay district.

County government said in a statement it will work with Dulles International Airport operator Metropolitan Washington Airports Authority on a legislative change in the 2025 Virginia General Assembly session to again allow notifications to subsequent owners.
