Halle Berry is seeking sole custody of son Maceo, 10, amid bitter custody battle with ex Olivier Martinez

Halle Berry is taking her ex Olivier Martinez back to court regarding the current custody agreement over their child.

The Catwoman actress, 58, filed documents seeking sole custody over education and medical decisions for their son, Maceo, 10.

In her filing, the Oscar winner and her attorneys allege Martinez, 58, refuses to address the boy's learning and behavior problems, according to documents seen by TMZ

Berry claims the Unfaithful actor's 'turbulent behavior' and his prioritizing of their son learning soccer over school has resulted in Maceo falling behind his classmates.

She also alleged Martinez refused to get his son a tutor, because it would interfere with soccer practice.

The Moonfall actress also claims her ex is unloading on their son about the conflicts going on between his parents, putting his spin on it, and that after Maceo spends an extended period of time with his dad, he comes back angry and combative. 

Ultimately, she wants to judge to grant her the 'ability to make decisions related to education and therapy.' 

The former couple met in 2010 on the set of the film Dark Tide in South Africa.

At the time, the actress was going through a nasty breakup with her former partner Gabriel Aubrey, with whom she shared daughter Nahla, 16.

They married in 2013 and welcomed Maceo in 2014, but announced they were going their separate ways two years later. 

The main contention in the divorce was custody over their son, which was finally settled in 2023.  Court papers indicated Martinez would receive $8,000 a month in child support and 4.3-percent of the actress' income above $2 million.

She would also cover all of Maceo's medical expenses, health insurance, school tuition, and extracurricular costs.

The agreement also stated their son would attend individual and family therapy.

This comes after Berry lost her bid to force Martinez to attend co-parenting therapy to resolve conflicts around their son earlier this month. 

Berry had claimed Martinez was trying to delay their agreed co-parenting therapy to 'take the summer off' - but according to court documents obtained by Radar Online, a judge denied the actress' bid, citing a 'lack of exigent circumstance.' 

The pair agreed to attend therapy in May to 'resolve disputes and conflicts between them in an effort to successfully co-parent' their son - but per court documents obtained by TMZ, Berry claims her ex decided to delay the sessions until September so he can take the 'summer off - without clearing it with her or their therapist.

She claims he did not attend July sessions to travel to his native France and that he wants to cancel sessions in August due to his brother visiting.

The actress wanted a judge to force him to adhere to the schedule laid out in the agreement. She also says as the therapy sessions are conducted via Zoom, Martinez cannot use travel as an excuse.

The star said the six joint sessions were due to be completed by June 14.

Per Radar, Berry's legal team had claimed that Martinez's absence from therapy was hindering the 'development and best interests' of their son - with Berry claiming Martinez 'continuously' involves Maceo in their arguments - leading him to 'act out against her.'

Martinez’s team responded - arguing Berry is 'constantly attempting to strong-arm [him] by forcing him into ‘submission’ using her wealth, and the legal professionals at her disposal.'

His lawyer added that Maceo faced 'no immediate harm' and alleged Berry decided to file the request when she 'knew' Martinez would be traveling - and that Berry's request did not qualify for an emergency order.
